CA BACKGROUND/RELATED STRATEGIC GOAL: Stuart Jet Center, LLC (Stuart Jet) entered into a Fixed Based Operators Lease (Stuart Jet FBO Lease) with Martin County on January 31, 1995. Article IX, Paragraph F of the Stuart Jet Lease provides that any subletting of a portion of the leased premises requires written consent of Martin County; which consent shall not be unreasonably be withheld. Stuart Jet is presenting for Board approval a new Sublease Agreement with Executive Jet Management, Inc. for office space known as Hangar 5 Office, Located at 2324 SE Liberator Lane, Suites 202, 203 and 204 Stuart, Martin County, Florida to be used for a commercial office and no other purpose. This sublease is in standard form for Stuart Jet Center subleases; said form was reviewed by the Martin County Legal Department and approved by the Board of County Commissioners on November 27, 2007. The sublease rent is contained in a separate Lease Memorandum which, per prior agreement with the Board, is not included herein. The Airport Director has confirmed that the use stated in this sublease is consistent with Airport Zoning as permitted uses in the General Aviation I Zone. The Airport Director has confirmed that this sublease and the uses stated therein are in compliance with the Minimum Standards for Aeronautical Activities of Martin County Airport/Witham. ISSUES: The initial term of this new lease for the Subtenant will commence on or before April 1, 2011and expire on March 31, 2014. Per the terms of the approved sublease form, the sublease automatically renews for additional periods of (1) year each, unless terminated by either party for cause stated in Paragraph 15 of the sublease, and by either party by notice to the other party at least sixty days prior to the expiration of the initial term or any renewal term. RECOMMENDED ACTION: RECOMMENDATION Approve the new Office Lease Agreement dated on or before April 1, 2011 between Stuart Jet Center and Executive Jet Management, Inc. for office space identified as Hangar 5 Office, Located at 2324 SE Liberator Lane, Suites 202, 203 and 204 Stuart, Martin County, Florida to be used for a commercial office and no other purpose. 80151b91 PDF Page 2 of 13
