EXECUTIVE SUMMARY: The City f Nanaim has received an applicatin frm Maureen Pilcher & Assciates Ltd., n behalf f 0834824 BC Ltd., t amend the Cmprehensive Develpment District Zne Five (CD-5) in rder t mal<e changes t the Cmprehensive Develpment Plan. Staff supprts the applicatin and recmmends that Cuncil apprve the prpsed rezning. BACKGROUND: Subject Prperty The subject prperty is lcated n the east side f Metral Drive and backs nt the Island Highway, acrss frm Nanaim Nrth Twn Centre (previusly Rutherfrd Mall) (Attachment A). The site is apprximately 18,920m 2 (4.7 acres) in area and has recently been clear-cut. Metral Drive is classified as a majr cllectr. The west side f Metral Drive acrss frm the subject prperty cntains large single family lts. Abutting the prperty t the nrth and nrthwest are single family lts; with the mst nrthern lt being a 3.4-acre site cntaining a single family dwelling which als abuts the Island Highway. T the suth f the subject prperty is a cmmercial develpment cntaining 3 tw-strey buildings. Official Cmmunity Plan (OCP) Accrding t Map '1' f the OCP, the subject prperty is lcated within a Crridr designatin. The Crridr designatin supprts mixed land uses. Develpment within crridrs will be characterized by residential develpment at medium t high level densities; as well as mixeduse develpments cnsisting f residential and cmplimentary cmmercial retail and ffice uses. Additinally, develpment in crridrs will address the interface between crridrs and neighburhds. Design elements f building siting, height and massing will be used t ensure a transitin frm the crridr t the adjacent neighburhd scale. Primary parking areas between the frnt face f the buildings and the street in crridrs is nt permitted.
Page 2 Staff Cmments The verall develpment cntemplated under the CD5 zne is cnsidered t be a cmprehensive mixed use develpment. The riginal intent f the CD5 zne was t create a zne cnsistent with the gals and bjectives f the crridr designatin, as an apprpriate Crridr zne did nt exist at the time. Staff has cnsidered whether the subject prperty shuld be rezned t the recently adpted COR2 zne (Mixed Use Crridr); hwever, due t the lt cnfiguratin, private rad, and separatin f uses n different lts, the site is apprpriately zned as a Cmprehensive Develpment District Zne. Specifically, under the 'permitted uses' f the COR2 zne, there is a requirement that states where nn-residential uses are prpsed that at least an equal amunt f residential uses be prvided. This requirement wuld make subdivisin f the prpsed develpment unattainable as sme f the prpsed future lts will cntain nly cmmercial buildings, while thers will be strictly residential. Therefre, maintaining the CD5 zne is required in rder t facilitate future subdivisin f the land. Hwever, the COR2 zne (Mixed Use Crridr) is imprtant as it prvides the general regulatins fr cnstructin f mixed use develpments in crridr designatins and can act as a guide in reviewing prpsed amendments and future CD znes within crridrs. Within any zne in the Zning Bylaw, there is the ability t refer t specific subsectins f ther znes, where apprpriate. As such, there is the ability t cnnect Cmprehensive Develpment District Znes t specific crridr regulatins within the bylaw. The gal is t create a CD zne that is site specific, cmprehensive, and flexible, while meeting the intent f the crridr designatin. Therefre, the regulatins cntained within COR2 fr 'density' and 'size f buildings' have been included in the CD5 zne fr the subject prperty in rder t prvide fr mre flexibility and a mre cnsistent apprach t crridr style develpments. Allwing fr greater flexibility can ptentially eliminate further amendment applicatins in the future. The prpsed amendments, described belw, are cnsidered t be in keeping with the intent f the crridr designatin. In additin, the develpment, as a whle, will result in greater residential flr area than cmmercial flr area, which is intended under the mixed use crridr regulatins cntained within the COR2 zne. As such, Staff cnsiders the prpsed amendments t be acceptable and supprts the applicatin. Prpsed Develpment The Cmprehensive Develpment District Zne Five (CD5) reflects a cmprehensive mixed use develpment that was designed t meet the intent f the crridr designatin; and was adpted by Cuncil n 2010-MAY-17 (RA218). The applicant prpses t amend the CDS zne in rder t make changes t the cmprehensive develpment plan and t allw fr future subdivisin f the parent parcel. A cpy f the existing CDS zne is attached (Attachment B). In general, the prpsed CDS changes include the fllwing: Remving the requirement fr the tw buildings n prpsed Lt 4 t be nly fr live/wrk and mixed-use and allwing fr cmmercial buildings. Creating a new lt - prpsed Lt S - and allwing fr a cmmercial building. Amending prpsed Lt 1 (due t the creatin f Lt 5) by reducing lt area and unit cunt n Lt 1 and changing frm tw-strey twnhuses t three-strey twnhuses. Remving the requirement fr residential units frm prpsed Lt 3. Updating the CD5 zne t prvide fr mre flexibility by referring t the COR2 zne requirements fr 'density' and 'size f buildings'.
