BACKGROUND The Essex-Windsor Solid Waste Authority (EWSWA) is a municipal agency created in 1994 by the County of Essex and the City of Windsor. The Authority is responsible for, among other programs, the operation of the region s sole landfill and for recycling collection and processing. The EWSWA also manages approximately 782 acres of farmland on behalf of the City of Windsor and the County of Essex. The land is currently being farmed under a lease arrangement between a local farmer and the Authority. The lease expires on November 1, 2011. The land is in proximity to the Essex-Windsor Regional Landfill located in the Town of Essex. B. RFP DESCRIPTION The Essex-Windsor Solid Waste Authority is seeking proposals from those parties interested in renting some or all the lands for farming or non-farming purposes. C. TERM The term of the eventual agreement will be for a minimum five year period commencing November 2, 2011 and ending on October 31, 2016. The Authority will accept proposals which include terms longer than five years and may choose to accept the proposal if it deems it beneficial to do so. D. DISQUALIFICATION OF PROPOSALS Under no circumstances will proposals be considered which: 1. are received after the time specified; 2. are not properly signed by an appropriate company official who has the authority to bind the company. F. CONSIDERATIONS Interested parties, when preparing their proposal, shall take into consideration the following: The attached Property List which details the parcels location, roll number and size. The attached map showing the locations of the parcels in relation to the Essex-Windsor Regional Landfill. It is the responsibility of the respondent to ensure that the proposed land use is in compliance with any applicable laws, regulations, legislation, bylaws or any other statutes governing the use of the lands. It is the responsibility of the respondent to satisfy themselves that the land will be suitable for the use being proposed. The respondent should visually inspect the land and also ascertain that appropriate zoning is in place. The respondent should also confirm the tiling and drainage conditions and any other criteria which would impact satisfactory use of the land. Title to the lands are in the name of the County of Essex. The lands have been farmed since 1996. The Authority at its own discretion, during the term with sufficient notice, may elect to remove from the total land available to the respondent up to 100 acres of land for use by the Authority. ACCEPTANCE OR REJECTION OF PROPOSALS The EWSWA reserves the right to reject any and all proposals, and to not enter into a contract with any proponent. A proposal shall be considered to be accepted only when it is approved by a resolution of the EWSWA Board, and an agreement is entered into between the respondent and the EWSWA. The EWSWA shall not be responsible for any liabilities, costs, expenses, loss or damage incurred, sustained, or suffered by any respondent prior to or subsequent to or by reason of the acceptance or rejection of any proposal, or for delay in the acceptance of a proposal.
