Highlights of Mar 22, 2012 BOD Meeting: The meeting was called to order at 8:30 A.M. by President Dam. Those also present were Vice President Korri, Treasurer Neff, Directors Lindsey, Joyce, McElligott and McCauley. Also in attendance were Superintendent Mark Thieme and Amy Bruener from Platinum Property Management. One resident was present. Review of Minutes: The minutes of the Feb 23, 2012 BOD Meeting minutes were approved as distributed. Treasurer's Report: (Treasurer Bob Neff) Financials and Special Assessment As of Feb 29, 2012: Operating Cash $82,925 (Iberia) Reserves $268,866 (CNL Bank) Total Cash & Reserves $351,791 Accounts Receivable $197,839 (Special Assessment $118,756) Total Current Assets $560,983 Long Term Liabilities $348,483 Treasurers Comments: During the Leap Year month of February 2012, Imperial HOA operated at a slight deficit of $3,692. For the two months YTD, we incurred an operating deficit of $12,205. The primary reason for the deficit was a large bad debt expense of $11,138 that occurred from the write off on the 1935 Empress Court property. While it is always painful to take a write off it is clearly a positive to get these bad accounts off the books. If it were not for this write off we would have had a positive operation results for both the month and the YTD. There still remains a $1,000 fine on the property that will be collected at the closing of the property. Related to the write off are the positive results of Account Receivable declines during the month. The outstanding Maintenance Fee A/R declined by $29,400 (27%) while the Special Assessment dropped by $14,710 (11%) for a total of $44,111 (18%) during February. This is the first time in a number of years that the total has been under $200,000. Clearly we are moving in the right direction at a rapid rate. As you know there are other properties that could be settled in the near future. During the month, we closed out the Shamrock Bank account due to the recent problem and the fact that the Marquis Gate loan was paid off. Later this year, we will also move the lockbox service to CNL after we send out new coupon books. A quick thank you to Len of accounting for his help on this project. 1

Also on a positive note, we are picking up new long-term advertisers who want to buy the larger profitable ads. Additional, we began the new free classifieds in the new March issue of The Estates. In terms of property transfer fees, we recorded $2000 for the month or 4 property transfers and $3500 for the YTD. While this is very good it does not tell the full story that Imperial home sales are increasing at a fast rate reflecting the true value of Imperial Golf Estates homes. Resident Balances (President Harlan Dam): Maintenance Dues owed: 23 residents past due as of 02-29-12 1 paid since that date 16 are at the attorney 22 are still owing (includes the 16 at the attorney) Backgate Special Assessments owed: 22 residents past due as of 02-29-12 2 paid since that date 12 at the attorney 20 still owing (includes the 12 at the attorney) Discussion of fee for placing classified ads in the newsletter: Imperial Golf Estates residents can place a classified ad in the Estates Newsletter to sell household items within Imperial Golf Estates at no charge. Ads should be 4 lines or less. GIB Report: (President Harlan Dam) For February, 2012 the GIB were over budget by $453.78 for the month with the largest expense items over budget---legal at $1,604.96 and Smart Passes at $703.05. The Legal expense category was related to research of the easements for the Boulevard and the change to our By-Laws for proxy voting. Year to date we are $3,249.96 under budget for our Operating Expenses. Reserve account balance is $190,272.49. A major Reserve expense this month was for the installation of a new Smart Pass Reader for residents ($5,888.30) and our Contingency Reserve was reduced by $15,000.00 to fund the Drainage Reserve. A contract was approved by the Executive Committee with Bonness, Inc. for the drainage project at a cost of $11,156.44 or just under $400.00 less than the combined bid of Haskins and Sewer Viewer. For 4% more the GIB does not have to manage two contracts and have two different contractors accomplishing the project with two mobilizations at the gate. Bonness will do the whole project with only one contractor responsible for the completion of the project. Our Land Use Attorney, Cheffy & Passidomo, did not find any specific language in the road access easements granted by Whispering Pines, the Imperial developer s company, related to responsibilities for maintaining the road. The GIB authorized the Executive Committee to proceed with the purchase of Galaxy Access Control / Management upgrades, a new administration computer and a Snap Shell Scanner for the monitoring each guest or vendor entering the gate. The have a not to exceed budget of $10,000.00. The GIB approved revisions to the revised and Restated By-Laws for Sections 2.8, 4.7 2 and 4.10 that allows a community that is a part of the GIB to submit a signed and time period related proxy in the absence of their designated representative for the assistance in maintaining a quorum throughout the year at each GIB Meeting. The Beautification Committee has decided to pursue a custom flower box to place on the blank wall east of the Guards Door so that it can be maintained with flowers, just like the other flower boxes. This eliminates any further discussion of a mural, painting, or metal sculpture. They are also going to refresh the painting at the entry walls at Rt. 41. They have had discussions with Greenspire on additional plant upgrades when the drainage work is completed. IGEHOA Superintendents Report: (Mark Thieme) Parks: Someone broke all of the planks on one bench in Regal Park. They have been replaced. The Princess cul-de-sac should be bored now waiting for the irrigation to be hooked up. Cypress Park is underway now. The Princess cul-de-sac has been watered multiple times. GIB: Just a half hour this month. Bids: We have bids in for the broken storm lid, the Princess swale, and sidewalk replacement in Phase 3. Called Wednesday but still waiting to meet with Fort Myers Trenchless. A tree fell on the perimeter fence so I took the opportunity to fell some other trees before Carter Fence repair. Weirs: 4 weir plates are being built for the Majestic and East Imperial weirs. Contacts: I contacted Terry King of DelASol about homeowner concerns along our fence and it is being worked on now. I contacted John Plecki of Secoya Reserve about the East drainage swale and a time frame. They keep putting it off due to the water level. Gate House: A number of gate instances were researched as every month. Signs: Many signs were worked on early in the month. Shop Computer: The 10 year old shop computer died this month requiring a system reinstall. I lost all monthly reports. Mark requested funds to purchase a new computer and will work with Treasurer Neff on a purchase. Beautification, Common/Park Areas Committee Report (President Dam) The pressure tank rusted out at Majestic Park last week and was replaced. Mark has finally been able to receive permission to acquire water from a resident s irrigation system at 1921 Princess Ct. This cul-de-sac had previously been watered from a home on the other side of the street, which has been in foreclosure for several years. The major new landscaping project along the County drainage ditch west of the Middle School has now begun. You will see the weedy Bahia grass being killed off, followed by a new irrigation system, 29 new trees (two Australian Flames and 27 Verawood trees) between the sidewalk and the street, and 92 pallets of new Floratam sod. The plan is to get all the trees planted so they can start to establish a root base prior to the summer storms. This is the only major beautification project scheduled for this year.

Roads and Walkpaths: (Secretary Ed Lindsay) We have awarded a contract to Bonness to repair the asphalt sidewalk just North of Regal Way on IGCB in the amount of $2,913.92. Work is now completed. Stormwater Drainage System: (Director McElligott) Sewer viewer came out and ran a camera 80 ft. into the failing Empress pipe. The pipe runs 300ft., but the water level was too high for the camera to go further than 80ft. I could see the pipe is rusted but it wasn t clear where the leaks were located, because the water level is still too high. I contacted Fred Tinsberg of Lanzo Lining Services and he has sent me information on lining the pipe instead of replacing it. Mark is also having Fort Myers Trenchless and Bonness give us two more bids. We tried to have Sewer Viewer look at the sewers by 2121 Imperial Golf Course Blvd., but the water level is still too high. They were able to take some still shots and it did look like some ficus roots had penetrated the pipe by 2118 Imperial Golf Course Blvd. I attended a storm water symposium with Mark March 20th that discussed storm water pond solutions. Collier County President s Council on 11-11-11: (President Dam): President s Council Meeting on 3-09-12 The guest speaker was Jeff Arendt, who does Legal Aid and is a member of the County Foreclosure Task Force. He also brought along Tim Cotton, a pro bono attorney that works with him at times. He indicated that 14% of Florida residential properties are current at least 30 days delinquent. The good thing is the number is finally holding steady and not continuing to rise. He indicated that Rep. Passidomo s bill before the state legislature did not pass at this latest session. One of the sections in the bill would have only allowed a bank to pursue a resident who defaulted on the loan to be pursued up to one year. That is currently between 5-7 years. Currently a resident who defaults on their mortgage can be pursued during this time frame for anything remaining on the loan after the property has been re-sold. The number of foreclosures started increasing in Collier County with 733 in 2007, reached a high of 8,203 in 2009 and has decreased to 2,270 in 2011. There have been 475 filed so far in 2012. The legislature is being called back in session for a 15 day period. It is unknown what additional bills may be brought forward for consideration. North Naples Task Force Meeting 03-20-12: (President Dam) No Meeting. Commissioner Hiller s District 2 Association s meeting: (President Harlan Dam) Commissioner Hiller has not scheduled her next meeting as of this report. Entrada (Marquis) Gate and Road (Director McElligott) The 3 new sign poles (replacing metal poles) from Sign Pro should be installed within the next couple of weeks. Dan House Electric will be doing our yearly maintenance on the back-up generator in mid-may to 3 insure we are ready for hurricane season. Since we have been having so many violations the last few weeks, it was decided to re-post the rules and penalties in the newsletter as well as on the web site. Problems gaining access through the gate, your first call should be to Charles McElligott 591-2313 Architectural Review Board Report: (Vice President Michelle Korri) Repainting home exteriors, new landscaping and new roof projects made up the (6) requests reviewed by the committee. The Board approved all requests. For details, see the ARB activity report for February, posted on the owners only area of our website, http://igenaples.info. There were no conditional approval or disapproval recommendations for the period January 27, 2011 to February 23, 2012. The ARB welcomes Imperial resident, Ron Mamrick to the review committee. Please remember that ARB approval is required for the use of Dumpsters and Port-a-Potties even if the renovations involve only interior changes. Perimeter Awareness Committee: (Director Joyce) It was reported that a black bear has been spotted at the back gate recently as well as a panther off of Empress Court. It is advised that all residents be aware of their surroundings while walking. Traffic Safety and Security Committee: (President Dam). No report. Violations and Fining Committee: (Director Joyce) The quarterly violations review has been completed and a date for the Fining Committee to meet is being selected. Comcast Issues: - (President Dam): We have only had a few minor items on calls from residents in the last 30 days regarding Comcast items. A number of Imperial s communities Comcast agreements are due to expire in the next couple years. They are grouping together and have already had a representative from Comcast speak with them. Their next joint meeting will be with a representative of the NuVu Company who originated on Marco Island. NuVu is now serving several communities in Collier County and are firming up a contract with the Vineyards to take over their service. It appears that the Vineyards will sign for a single provider of NuVu for telephone, cable and high speed internet. The committee has also met with Century Link to discuss their offerings. Notice to all residents: Please check your Comcast bill and make sure that you are not being charged for any DTA's or digital starter boxes under four. Our contract allows for the free use of up to 4 DTA's for the life of the contract.

No visitors, vendors, delivery vehicles, commercial vehicles (such as business owned, rented or governmental agency owned), public utility vehicles will be authorized to use the Entrada Gate. 2. All Bar Codes must be affixed to the side window of your personal, leased, or rental vehicles by the Property Manager s Office at the time of purchase. 3. Pre-authorized renters can purchase Bar Codes for the duration of the lease period. 4. No trailers will be allowed to use the unmanned Entrada Avenue gate. Trailers will continue to use the front gate. Motorcycles will continue to use the front gate unless they have a space on the side of their vehicle that a Bar Code can be affixed that can be read by the bar code reader. 5. Owners, residents, renters, and any other persons will be responsible for the costs for any damage they cause to the gatehouse, gates and gate systems. 6. Failure to follow the rules stated in this document or posted at the gate could result in the deactivation of an authorized bar code. These include allowing another vehicle to piggyback on your authorized entrance or exit through the gate system. Your bar code maybe deactivated for 90 days for a first offense. Your bar code maybe deactivated for 365 days for a second offense, and your bar code maybe deactivated permanently for a third offense. Reactivation of a deactivated bar code after either a first or second offense must be requested by the resident and there will be a charge of $10.00 for reactivation. 7. These rules will be strictly enforced to meet the requirements of the lawsuit settlement agreements. 8. Attempts to fraudulently obtain Bar Codes or personnel gate passes for non-authorized personnel could result in denial of your use of the Entrada Avenue gate system. 9. The Marquis Gate Special Assessment must be paid in full or quarterly payments must be current in order to obtain a Bar Code or personnel gate pass. The above listed rules were put in place to fulfill the requirements of the lawsuits that Imperial HOA settled with numerous parties and they are being strictly enforced for that reason.
