Buyer is responsible for removing and properly disposing of any live ammunition in accordance with any federal, state or local regulations. The container(s) are provided by Parks and Recreation Division. Buyer is responsible for returning the empty container(s) to the Markham Park Target Range. Special Notice/OSHA: Special notice: In accordance with OSHA regulation 29 CFR 1926.1101(k) (2), Buyers are notified of the presence of asbestos containing material and / or presumed asbestos containing material at some Broward County locations. Condition of Sale: The items are offered for sale on an as is basis and the County offers no guarantee or warranty, expressed or implied, as to their operational or physical condition. Basis of Award: The surplus property identified is hereby offered for sale to the highest bidder. The County reserves the right to award bids for surplus property to local governmental entities located within Broward County, even when the bids are not the highest obtained, provided they are judged to be fair and reasonable by the Purchasing Division.
The County reserves the right to waive technicalities and irregularities, and accept the bid deemed most advantageous, or to reject any or all bids. Pickup and Acceptance: Pickup must be completed within seven (7) calendar days after receipt of notification. Buyer who cannot meet pickup requirements may be considered non responsive. the subject matter of this Agreement including, without limitation, the removal of any property purchased by the Bidder from the County, the sale by Bidder of any such property to third parties, any defect in the operation or physical condition of any such property and any and all claims, losses, liabilities, expenditures, demands or causes of action of any nature whatsoever resulting from injuries or damages sustained by any person or property. In the event any lawsuit or other proceeding is brought against COUNTY by reason of any such claim, cause of action or demand, Bidder shall, upon written notice from COUNTY, resist and defend such lawsuit or proceeding by counsel satisfactory to COUNTY or, at COUNTY s option, pay for an attorney selected by County Attorney to defend COUNTY. To the extent considered necessary by the Contract Administrator and the County Attorney, any sums due Bidder under this Agreement may be retained by COUNTY until all of COUNTY's claims for indemnification pursuant to this Agreement have been settled or otherwise resolved; and any amount withheld shall not be subject to payment of interest by COUNTY. The provisions and obligations of this section shall survive the expiration or earlier termination of this Agreement.
The amount due from the successful bidder must be paid in full by government check, cashier s check, or money order made payable to the Board of County Commissioners, Broward County, Florida within seven (7) calendar days following written notification of award. Check to be submitted to Central Warehouse, Purchasing Division, 960 NW 38 Street, Oakland Park, FL 33309, between 9:00 A.M. and 3:00 P.M. daily, excluding holidays, telephone number (954) 8298. If the successful bidder fails to make payment within seven (7) calendar days from date of Notification of Award, the County reserves the right to award the items to the second high bidder or dispose of the item(s) in accordance with the County Procurement Code. Notification of Award will contain instructions as to submission of amount due. Removal of property must be completed within seven (7) calendar days from date of Notification of Award. Written acknowledgement of receipt of amount due will be sent to successful bidder by the Central Warehouse, Purchasing Division. This acknowledgement will serve as notice to release the property. THE FAILURE OF THE SUCCESSFUL BIDDER TO MAKE PAYMENT WITHIN THE PRESCRIBED PERIOD OF TIME MAY RESULT IN THE BIDDER BEING RESTRICTED FROM PARTICIPATING IN FUTURE COUNTY SURPLUS BIDS/OR QUOTES.
