2014 [All rights reserved] NOTES 1. Part I Chapter I of the Act gives tenants of flats a collective right to acquire the freehold of their premises. This notice is the initial notice from qualifying tenants claiming to exercise that right. 2. This notice is properly given to the reversioner of the premises. The reversioner is normally the freeholder: see section 9 and Schedule 1 Part I (one freeholder) and Part IA (multiple freeholders). Where the entire freehold is not held by the same person, the recipient may be one of the freeholders. Where no freeholder can be found or ascertained, this notice may be served on a relevant landlord within section 9. 3. This notice must be given by qualifying tenants in the premises at the date this notice is given, comprising at least half the total number of flats in the premises. A qualifying tenant is defined by section 5 of the Act. Where the lease is vested in trustees, section 6 (4) and (5) apply. 4. This notice must specify any appurtenant property (such as a garage or yard) which it is proposed to acquire, as well as any property used in common which is to be included. 5. Specify them with care, using the accompanying plan and distinctive colours. For example: 'a vehicular right of way at all times over the road coloured brown on the accompanying plan' 'a free right of foul drainage through the pipe, the line of which is shown green on the accompanying plan' 6. Set out the grounds by reference to section 3. The right to enfranchise applies to premises (a) they consist of a self-contained building or part of a building; (b) they contain at least two flats held by qualifying tenants; and (c) the total number of flats held by qualified tenants is at least two-thirds of the total number of flats in the premises. Premises excluded from the right are set out in section 4. 7. Section 2 gives qualifying tenants the right to acquire intermediate leasehold interests and (where necessary) the interests of tenants in common parts and in the additional property referred to in paragraph 2 of this notice. 8. By virtue of section 36 and Schedule 9, Part II, the nominee purchaser is obliged to grant leases back where any flat is let under a secure tenancy, or where a housing association is the freeholder. 9. Where the freehold of the whole premises is not owned by the same person, the proposed price for each of the freehold interests should be given, specifying the relevant part. 10. Separate information sheets should be completed for each tenant. Information sheets are available on the Oyez Form HUD 7. 11. Section 15 provides that a nominee purchaser is to conduct on behalf of the participating tenants all proceedings arising out of this notice, with a view to acquisition by the nominee purchaser on their behalf of the freehold and other interests which fall to be acquired. 12. A copy of this notice must be given to every other person known or believed to be a relevant landlord: see Schedule 3 Part II.
