IF THE BROKER REPRESENTS THE OWNER: The boke becomes the owne's agent by enteing into an ageement with the owne, usually though a witten listing ageement o by ageeing to act as a subagent by accepting an offe of subagency fom the listing boke. A subagent may wok in a diffeent eal estate office. A listing boke o subagent can assist the buye but does not epesent the buye and must place the inteests of the owne fist. The buye should not tell the owne's agent anything the buye would not want the owne to know because an owne's agent must disclose to the owne any mateial infomation known to the agent. The boke must obtain the witten consent of each paty to the tansaction to act as an intemediay. The witten consent must state who will pay the boke and, in conspicuous bold o undelined pint, set foth the boke's obligations as an intemediay. The boke is equied to teat each paty honestly and faily and to comply with The Texas Real Estate License Act.
