Deutsch City Manager Resolution R-66-15 TLBT, LLC 13401 Annapolis Road Annexation Plan DATE: September 3, 2015 In accordance with the Annotated Code of Maryland, Local Government Article, Title 4, Subtitle 4, Section 4-401 et seq., the legislative body of a municipal corporation shall, in addition to, but not as a part of the (annexation) resolution, adopt an Annexation Plan for the area proposed to be annexed. The attached Resolution R-66-15 approves the Annexation Plan for Parcels 2, 87, 91, 96 and 133 located in Grid C-1 of Prince George s County Tax Map 46, the premises of which are also known as 13401 Annapolis Road which is not currently within the City limits. The Annexation Area is comprised of approximately 4.107 acres of land. According to State requirements, the City must provide copies of the adopted Annexation Plan to Prince George's County government and the Maryland Department of Planning and any regional and State planning agencies having jurisdictions within the County at least 30 days prior to the holding of the public hearing on the annexation. Recommendation Because the proposed Annexation Plan meets all applicable requirements of State law, it is recommended that Council APPROVE Resolution R-66-15 and direct staff to provide copies of the adopted Annexation Plan to Prince George's County government and the Maryland Department of Planning and any regional and State planning agencies having jurisdictions within the County at least 30 days prior to the holding of the public hearing on the annexation. R-66-15 RESOLUTION OF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND ADOPTING AN ANNEXATION PLAN FOR THE ANNEXATION OF PARCELS 2, 133, 87, 91 AND 96 LOCATED IN GRID C-1 OF PRINCE GEORGE S COUNTY TAX MAP 46, ALSO KNOWN AS 13401 ANNAPOLIS ROAD, BOWIE, MARYLAND 20720 WHEREAS, the Annotated Code of Maryland, Local Government Article, Title 4, Subtitle 4, Section 4-401 et seq., authorizes municipalities to annex land; and WHEREAS, the Annotated Code of Maryland, Local Government Article, Section 4-415, requires municipalities to prepare an Annexation Plan for each new annexation that: (1) includes a description of the land use pattern for the area to be annexed; (2) demonstrates the available land for public facilities which may be considered reasonably necessitated by the proposed use; (3) describes the schedule for extending to the area to be annexed each municipal service performed within the municipality at the time of annexation; and, (4) includes a statement as to the general methods by which the municipality anticipates to finance the extension of municipal services into the area to be annexed; and WHEREAS, the Council of the City of Bowie, in approving R-12-06 on March 6, 2006, adopted an annexation policy establishing the principles to be used by the City to facilitate the annexation process; and WHEREAS, pursuant to the aforesaid provisions of R-12-06, the City has determined that the proposed annexation of Parcels 2, 87, 91, 96 and 133 located in Grid C-1 of Prince George s County Tax Map 46, the premises of which are also known as 13401 Annapolis Road, will meet the City Council's criteria for annexation; and WHEREAS, the memorandum attached as Exhibit A constitutes the Annexation Plan for the proposed annexation and demonstrates that the proposed annexation meets all of the applicable requirements of State law. NOW THEREFORE BE IT RESOLVED, by the Council of the City of Bowie, Maryland in legislative session assembled approves the Annexation Plan for the referenced annexation as further described in Exhibit A. This Annexation Plan memorandum fulfills these requirements. I. Property Description and Land Use Pattern for the Area The Annexation Area includes approximately 4.107 acres of land and consists of Parcels 2, 87, 91, 96 and 133 located in Grid C-1 of Prince George s County Tax Map 46, the premises of which are also known as 13401 Annapolis Road (see Attachment #1). The Annexation Area is zoned C-S-C (Commercial Shopping Center). The subject property lies within the Established Communities tier identified in the County s General Plan (Plan Prince George s 2035). The area of the subject property is shown as a Commercial land use in the General Plan s Generalized Future Land Use Map. The Approved 2006 Bowie and Vicinity Area Master Plan includes the subject property at the westernmost edge of the Mixed Use Activity Center Boundary of West Bowie Village, where it is shown for commercial use. The site has a vehicular connection to the remainder of West Bowie Village via the MD 450 frontage road and Old Annapolis Road. The subject property is located at the signalized intersection of MD 450 and Highbridge Road/Church Road. Access is available directly from Church Road to the signalized intersection. There is no direct access to MD 450. To the north lies The Shoppes at High Bridge, a 60,000 square foot retail center. To the south and east, within the current City limits, is the single-family subdivision of Stewart s Landing, which is a

TBLT, LLC Annexation Plan 2 cluster development in the R-R (Rural Residential) zone, with lots having a minimum size of 10,000 square feet. Immediately east of the subject site is Homeowners Association (HOA) open space owned by the Stewart s Landing HOA. To the west, across Church Road, is the large lot subdivision of Woodmore North in the R-E (Residential Estate) zone. Lots in Woodmore North have a minimum lot size of 40,000 square feet, although the subdivision was approved under the lot-size averaging provisions of the Prince George s County Subdivision Ordinance and lots may be as small as 30,000 square feet. A small sliver of undeveloped land (Parcel A, Plat 10, Westwood), which is a residue of the Woodmore North subdivision, lies immediately west of the subject property, between it and Church Road. The property is mostly developed with an automobile sales business, which has existed on the property for many years. According to tax records, the service garage building on Parcel 2 was constructed in 1969. The sales building on Parcel 2 is much older and includes a former single-family dwelling. There is an open area surrounded by trees that exists at the southern end of Parcel 91. The majority of the property consists of existing impervious surface. According to PGAtlas, there are no streams, wetlands or 100 year floodplain located on the property, which is generally flat but slopes slightly away from MD 450 toward the southeast. The site is not part of the County s Green Infrastructure Network. This annexation is well within the growth limits identified in the City's Annexation Policy approved in R-12-06 and is therefore consistent with the general growth and development pattern of the City. The annexation is consistent with the land use recommendations and policies of the Bowie and Vicinity Master Plan and County General Plan. II. Availability of Public Facilities and Services On the effective date of annexation, the Annexation Area shall be eligible to receive all applicable City services, including police service. A. Water and Sewer The Annexation Area lies within Category 3 for water service and Category 3 for sewer service shown on the Prince George s County Water and Sewer Plan Map, meaning public water and sewer service to the site exists or is planned in the future. The Washington Suburban Sanitary Commission (WSSC) currently serves the Annexation Area with public water. A water main exists in Maryland Route 450 in front of the site, and a fire hydrant also abuts the site. Sewer service exists in the adjacent subdivisions of Woodmore North and Stewart s Landing. An 8-inch sanitary sewer connection is proposed to the southeast, connecting a sewer manhole on the subject property via an 8- inch line to the Stewart s Landing HOA property. B. Electric Service The Baltimore Gas and Electric Company (BGE) provides electric service to the Annexation Area and Washington Gas provides gas service. According to the ALTA Survey prepared for the property, several electric and gas service lines exist on the property.

Public Safety and Fire/Rescue Services The Annexation Area is within the service area of the Prince George s County Police Bowie/Upper Marlboro Substation District II, Sector E, and the City's Police Department. Upon the effective date of annexation, the City s Police Department will provide primary police service to the Annexation Area. Fire engine, basic life support/ambulance personnel and medic personnel will be dispatched from Bowie Station #39 on Annapolis Road and Bowie Station #19 on 9 th Street (MD 564) in Old Town Bowie. III. Extension of Municipal Facilities and Services to Annexation Area The City will extend all applicable municipal services and facilities (as described above) to the Annexation Area depicted in Attachment #1 upon the effective date of annexation. At that time, the Charter and Code of the City shall have full force and effect within the Annexation Area. IV. Cost to the City in Having to Provide Each Service The City will not incur any significant increases in operational costs as a result of the annexation.
