Full Cost Recovery Through Fees As shown in the Planning Division s current budget, fees collected in previous years are less than the costs currently incurred by the development review process. All Claremont taxpayers do not undertake property development; therefore, it is the City s policy that most development review costs should be paid for by the users of these services and not supported by the taxpayers through the City s General Fund. Deposits All applications requiring deposits shall be charged the hourly rate. A deposit will be collected when an application is first submitted. The Director of Community Development may modify or waive a deposit amount, depending on the complexity of the application. The review costs will be charged against the deposit. Staff Estimates of Costs After an application is submitted for which an initial deposit is required, City staff shall prepare and provide to the applicant an estimate of the total costs for such application. The estimate shall include costs for staff time, legal review, and private consultants. If the staff estimate is more than the initial deposit, an additional deposit shall be required before additional work on the application is undertaken. The applicant shall only be responsible for actual costs up to, but not exceeding, staff s estimate unless the scope of the proposed project changes, all submittal requirements are not met, or the number of public meetings exceeds that which is projected in the estimate. If any of these situations occur, staff shall prepare a revised estimate of the total costs, for which the applicant shall be responsible. The applicant shall be notified of the reason for the revision and the amount of the revised estimate. If the amount of the deposit(s) exceeds the cost of the review for which the applicant is responsible, the excess deposit amount shall be refunded to the applicant upon final disposition of the application. Hourly Fees for Review Services City Staff - Staff review, research, analysis, report preparation, and attendance at commission and City Council meetings through final approval will be billed at $98.50 per hour unless noted as a flat fee on the above fee schedule. Most staff members for whose time will be charged hourly are planners and engineers in the Community Development Department. When review is required from staff in other departments, hourly charges may be made for their time. The hourly fee is an average, hourly cost for salaries and benefits for City staff involved in department review and related services, which also Effective 9/1/2008 Updated 8/20/2008 Page 4
includes City and departments overhead costs attributed to development review on an hourly basis. Charges for staff time will be rounded to the nearest quarter hour. City Attorney - Review, advice, report preparation, and meeting attendance by the city attorney will be billed at actual cost to the City. Private Consultant - Review, report preparation, and meeting attendance by engineering, environmental, and other special consultants will be billed at actual cost to the City. Building Permits, Plan Checks and Inspections - All building permits, plan checks, and inspections shall be subject to fees as set forth in the Building Division s Fee Schedule. Multiple Applications Development requests comprised of two or more applications for which deposits are noted on the above schedule shall require the full deposit for the most extensive application plus 50 percent of the deposits for all other applications which can be considered concurrently. Requests comprised of multiple applications for which flat fees are charged shall require the full payment of the fees for all applications. Requests comprised of multiple applications for which both flat fees and deposits are noted on the above schedule shall require the full payment of the flat fees and the full deposit for the most extensive application plus 50 percent of the deposits for all other deposit applications which can be considered concurrently. The director may modify the above deposit amounts. Unlisted Applications A deposit shall be required for all applications not listed on the above schedule. The director shall determine the amount of the deposit by applying the deposits of other applications of similar complexity. Minimizing Your Fees Applications that are complete, clear, accurate, and in conformance with Claremont s codes and standards can be reviewed and approved more quickly than those applications that are not. The less time that staff, the city attorney, and other consultants need to spend on a project, the lower the costs will be to a project applicant. Refunds If an application is withdrawn prior to completion of processing, the City shall deduct for actual time multiplied by the normal hourly rate for all work permitted from the filing of the application up to and including issuance of the refund.
