Certificate of Completion and Compliance (CCC)/ Integrated Mixed Developments: Practical issue arising and how can developers adapt to new requirement

Is it a New Requirement or an existing requirement been ignored? Existed since 2007, why the fuss now? REQUIREMENT HOUSING DEVELOPMENT (CONTROL AND LICENSING) ACT 1966 (Act 118 ) - As at 2 March 2016 Interpretation 3. In this Act, unless the context otherwise requires certificate of completion and compliance means the certificate of completion and compliance given or granted under the Street, Drainage and Building Act 1974 [Act 133] and any by-laws made under that Act certifying that the housing accommodation has been completed and is safe and fit for occupation but does not include partial certificate of completion and compliance;

Definition: Certificate of Fitness for Occupation STREET, DRAINAGE AND BUILDING ACT 1974 (Act 133) Interpretation 3. In this Act, unless the context otherwise requires Certificate of fitness for occupation, temporary certificate of fitness for occupation and partial certificate of fitness for occupation mean such certificates given or granted under the Uniform Building By-Laws;

Definition: Certificate of Fitness for Occupation AKTA JALAN, PARIT DAN BANGUNAN [AKTA 133] Sel. P.U. 26/1985 UNDANG-UNDANG KECIL BANGUNAN SERAGAM SELANGOR 1986 [mengandungi pindaan terkini Sel. P.U. 142/2012] 25. Perakuan kelayakan menduduki (1) Perakuan kelayakan menduduki sesuatu bangunan hendaklah diberi jika- (a) Orang-orang berkelayakan semasa kerja itu dijalankan telah memperakui dalam Borang E sebagaimana dinyatakan dalam Jadual Kedua Undang-Undang Kecil ini bahawa mereka telah mengawasi pembinaan bangunan itu, dan sepanjang pengetahuan dan kepercayaan mereka bangunan itu telah dibina mengikut Undang-Undang Kecil ini dan apa-apa syarat yang dikenakan oleh pihak berkuasa tempatan dan mereka bersetuju menerima tanggungjawab sepenuhnya mengenai bahagian-bahagian yang berkaitan dengan mereka masing-masing dan pihak berkuasa tempatan atau seorang pegawai yang diberi kuasa secara bertulis olehnya bagi maksud itu telah memeriksa bangunan itu. (b) Semua perkhidmatan perlu, termasuk jalan akses, pandangan darat, tempat letak kereta, parit, pemasangan alat-alat kebersihan, air dan elektrik, lif bomba, pili bomba dan lain-lain jika dikehendaki, kehendak-kehendak pembetungan dan pembuangan sampah telah disediakan. Tiada apa-apa pun yang terkandung dalam Undang-Undang Kecil ini boleh mencegah pihak berkuasa tempatan atau mana-mana pegawai yang diberi kuasa secara bertulis olehnya bagi maksud itu daripada memeriksa apa-apa kerja bangunan pada mana-mana peringkatnya dan menarik perhatian kepada apa-apa penyimpangan daripada pelan yang diluluskan atau tidak mematuhi mana-mana Undang-Undang Kecil ini yang didapatinya dan daripada memberi notis secara bertulis memerintahkan supaya penyimpangan itu diperbetulkan.

Perakuan kelayakan menduduki sebahagian 1) Pihak berkuasa tempatan boleh mengikut budi bicaranya memberi suatu perakuan kelayakan menduduki sebahagian bagi mana-mana bahagian bangunan yang telah siap sebahagian dan boleh mengenakan apa-apa syarat yang difikirkannya perlu bagi kekentingan awam: Dengan syarat bahawa tiada sesuatu permit sedemikian boleh diberi jikaa) tiada apa-apa permohonan bagi perakuan kelayakan menduduki sebahagian telah dibuat dalam tempoh pembinaan itu; b) semua perkhidmatan perlu, termasuk jalan akses, pandangan darat, tempat letak kereta, parit, pemasangan alatalat kebersihan, air dan elektrik, lif bomba, pili bomba dan lain-lain jika dikehendaki, kehendak-kehendak pembetungan dan pembuangan sampah belum disediakan; dan c) pendudukan bahagian atau bahagian-bahagian bangunan yang telah siap sebahagiannya itu akan memudaratkan kesihatan atau keselamatan awam. Sel..P.U. 40/2012] 2) Suatu perakuan kelayakan menduduki sebahagian apabila dikeluarkan hendaklah berkuatkuasa berterusan sehingga keseluruhan bangunan itu siap dan suatu perakuan kelayakan menduduki dikeluarkan. Tiada seorang pun boleh menduduki atau membenarkan diduduki mana-mana bangunan atau manamana bahagiannya melainkan jika suatu perakuan kelayakan menduduki, suatu perakuan kelayakan menduduki sebahagian atau suatu kelayakan menduduki sementara telah dikeluarkan di bawah Undang-Undang Kecil ini bagi bangunan itu dan apa-apa kemungkiran untuk mematuhi Undang- Undang Kecil ini boleh menyebabkan orang itu kena didakwa di bawah Akta ini.

Definition: Certificate of Fitness for Occupation AKTA JALAN, PARIT DAN BANGUNAN [AKTA 133] Sel. P.U. 26/1985 UNDANG-UNDANG KECIL BANGUNAN SERAGAM SELANGOR 1986 [mengandungi pindaan terkini Sel. P.U. 142/2012] By-Law 25of the Uniform Building By-Laws 1984 (amendment 2007) stipulates the following: (1) The principal submitting person may issue a partial certificate of completion and compliance in Form F1 as set out in the Second Schedule in respect of any part of a building partially completed subject to any condition imposed by the local authority which it deems necessary for reasons of public health and safety : Provided that no such certificate shall be issued unless all the essential services including access roads, landscape, car parks, drains, sanitary, water and electricity installation, fire hydrant, sewerage and refuse disposal requirements and, fire lifts where required, serving the partially completed portion of the building have been provided. (2) A partial certificate of completion and compliance once issued shall remain effective until the whole of the building is completed and a certificate of completion and compliance is issued in pursuance of by-law 23+. Note: + The Clause varies according to the relevant by-laws gazetted by each state.

At Practical Completion: The Contractor gives up possession of the site to the client The Client becomes the building owner and becomes responsible for insurance, security and maintenance A proportion of the retention monies are released Liability for liquidated damages ends The Defects Liability period begins

What should happen at Practical Completion: The Contractor hands over a building in which each of the statutory approvals have been met The Health & Safety file, a full set of Operation & Maintenance manuals, record drawings and test data and the Building Log Book is handed over A comprehensive maintenance regime starts The building owner has a full understanding as to how the building operates

LEMBAGA ARKITEK MALAYSIA GENERAL CIRCULAR NO. 2/2010 GUIDELINES ON ISSUANCE OF FORM F1 (PARTIAL CERTIFICATE OF COMPLETION AND COMPLIANCE) Description: Form F1 is meant to cater for a building that requires any part/s of the development to be completed ahead of the rest. An example would be a complex such as shopping mall with residential or commercial towers above. Therefore, terrace houses completed in different phases do not fall under this category.

LEMBAGA ARKITEK MALAYSIA GENERAL CIRCULAR NO. 2/2010 GUIDELINES ON ISSUANCE OF FORM F1 (PARTIAL CERTIFICATE OF COMPLETION AND COMPLIANCE) The part of the building to be completed must be demarcated clearly in the building plans submitted and approved by the local authority. The Form F1 is issued in relation to the part/s as approved. In instances where the original building plans are approved as a whole without indicating partial completion and the developer then decides to do so subsequent to the approved building plans, the Professional Architect has to obtain written consent to complete the development in section/s. Form F1 can therefore only be issued for planned section/s in the manner that has been permitted by the local authority. It is not up to the Principal Submitting Person s discretion to decide as and when he wishes to issue Form F1. Form F shall be issued for the whole building once all the parts are completed.

PENJELASAN MENGENAI ISU BERKAITAN SIJIL PERAKUAN SIAP DAN PEMATUHAN (BORANG F) SEMASA PENYERAHAN MILIKAN KOSONG (VACANT POSSESSION) Scenario 1 Bagi pemaju yang telah mematuhi setiap syarat dan keperluan yang telah ditetapkan dalam Kebenaran Merancang dan Pelan Bangunan bagi pembangunan berfasa di mana pemaju telah mematuhi semua keperluan mengikut yang ditetapkan dalam borang G1 hingga G21 (tanpa syarat), Arkitek Profesional sebagai Orang Utama Yang Mengemukakakan boleh mengeluarkan sijil Perakuan Siap dan Pematuhan (Borang F). Ini bermakna pemaju telah mematuhi semua peraturan yang telah ditetapkan bagi mengikut pembangunan berfasa yang telah dirancang;

PENJELASAN MENGENAI ISU BERKAITAN SIJIL PERAKUAN SIAP DAN PEMATUHAN (BORANG F) SEMASA PENYERAHAN MILIKAN KOSONG (VACANT POSSESSION) Scenario 2 Bagi pembangunan berfasa, setiap keperluan dan perancangan pembangunan tersebut telah mendapatkan persetujuan OSC, dan pemaju telah memenuhi semua keperluan mengikut yang ditetapkan dalam borang G1 hingga G21 (tanpa syarat) maka setiap pembangunan yang telah siap mengikut fasa, Arkitek Profesional sebagai Orang Utama Yang Mengemukakakan boleh mengeluarkan sijil Perakuan Siap dan Pematuhan (Borang F);

PENJELASAN MENGENAI ISU BERKAITAN SIJIL PERAKUAN SIAP DAN PEMATUHAN (BORANG F) SEMASA PENYERAHAN MILIKAN KOSONG (VACANT POSSESSION) Scenario 3 Bagi pembangunan integrated, pemaju boleh menentukan garis pemisah (demarcation) bagi keseluruhan integrated demarcation dengan syarat pemaju tidak membuat perubahan kepada Pelan Bangunan yang asal dan memastikan tidak mengubah plot ratio secara keseluruhan yang telah ditetapkan, maka bagi pembangunan integrated yang telah siap mengikut sub division, Arkitek Profesional sebagai Orang Utama Yang Mengemukakakan boleh mengeluarkan sijil Perakuan Siap dan Pematuhan (Borang F).

PENJELASAN MENGENAI ISU BERKAITAN SIJIL PERAKUAN SIAP DAN PEMATUHAN (BORANG F) SEMASA PENYERAHAN MILIKAN KOSONG (VACANT POSSESSION) Scenario 4 Bagi pembangunan integrated, pemaju hanya perlu menentukan outer setback sahaja dan pemaju telah memenuhi semua keperluan mengikut yang ditetapkan dalam borang G1 hingga G21 (tanpa syarat) maka setiap pembangunan yang telah siap mengikut fasa, Arkitek Profesional sebagai Orang Utama Yang Mengemukakakan boleh mengeluarkan sijil Perakuan Siap dan Pematuhan (Borang F).

PENJELASAN MENGENAI ISU BERKAITAN SIJIL PERAKUAN SIAP DAN PEMATUHAN (BORANG F) SEMASA PENYERAHAN MILIKAN KOSONG (VACANT POSSESSION) Scenario 5 Pengeluaran sijil Perakuan Siap dan Pematuhan (Borang F) adalah berdasarkan kepada permohonan Kebenaran Merancang dan Pelan Bangunan yang telah diluluskan. Sekiranya pemaju menjanjikan sesuatu di luar daripada kelulusan Kebenaran Merancang dan Pelan Bangunan kepada pembeli dan ianya adalah termaktub di dalam Perjanjian Jual Beli, maka pemaju harus bertanggungjawab kepada ketidak selarasan berkenaan iaitu di antara Kebenaran Merancang dan Pelan Bangunan bersama dengan Perjanjian Jual Beli yang telah ditanda tangani.
