This is a summary of the Silver Lakes Ranch POA Covenants and is not intended to replace the Declaration of CCRs For a complete copy of the Covenants, contact the SLR Web Admin: riohadley@hotmail.com Silver Lakes Ranch Subdivision Rules June, 2009 General Considerations: Silver Lakes Ranch is a Property Owners Association ruled by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) with specific By-Laws detailing how the Association will be administered. These documents have been filed with the Secretary of the State of Texas with our Articles of Incorporation. The Subdivision Rules are provided in accordance with Article 4 of the CC&Rs which states The Association shall be the primary entity responsible for enforcement of this Declaration and such reasonable rules regarding use of the Properties as the Board may adopt pursuant to Article 10. (Use Restrictions). The Subdivision Rules do not supersede, amend, change, or alter the CC&Rs and are intended only to provide information to the Property Owner which is not specifically given in the CC&Rs. 1. USE RESTRICTIONS a) Privately Owned Property. Each lot at Silver Lakes Ranch is privately owned. Unauthorized access onto property other than your own may constitute trespassing. b) Single Family Residential Use. In accordance with Article 10 of the CC&Rs all lots may be used only for residential purposes of a single family and for ancillary business or home office uses. Lots may not be used for duplex houses, condominiums, townhouses or apartment houses. Lots (homes) may be leased for single family residential purposes only. Leasing of guest houses, ancillary building space, or rooms in a residence is prohibited. Detached garages, 1
workshops and other accessory buildings may be constructed prior to the residence but shall not be used as a residence. c) Vehicles. Per Article 10.3 of the CC&Rs, automobiles and non-commercial trucks and vans shall be parked only in the garages or in the driveways, if any, serving the Lots unless otherwise approved by the Architectural Control Committee. d) Camping on Lots. Per Article 10.3 of the CC&Rs owners may locate motor homes, travel trailers or tents on their lots temporarily, not to exceed seven (7) consecutive days in any calendar month or up to 6 months while a residence is being constructed. e) Animals and Pets. Per Article 10.6, no hogs, pigs or poultry of any kind shall be raised, bred or kept on any Lots. On lots five (5) acres or greater, Owners shall be limited to one (1) horse, cow, goat or other large animal per acre, only if property is fenced with fencing capable of containing such animals. Dogs, cats, or other common household pets may be kept on a Lot. There shall be no more than four (4) adult dogs per household. Dogs must be kept in a kennel, dog run, or fenced in area that confines said dogs to that area. Dogs are not permitted to run loose in the subdivision and must be vaccinated for rabies once a year. f) Guns. Per Article 10.13, the discharge of firearms on the Properties is prohibited. g) Hunting. There is no general hunting of game animals at SLR. In accordance with Article 4.10 of the CC&Rs the Association has the right to manage and control any populations of wildlife through a variety of techniques, including organized hunting and trapping. The Wildlife Control Committee has been established to monitor and manage the wildlife habitat at Silver Lakes Ranch. h) Architectural Review Article 9 in the CC&Rs outlines the Architectural Standards for Silver Lakes Ranch. All improvements to the Lots including fencing, is subject to approval by the Architectural Control Committee (ACC). Refer to Article 9 of the CC&Rs for more information regarding improvements to the Lots. i) Wetlands. Lakes, ponds and streams exist throughout the development. Property Owners shall contact the Architectural 2
Control Committee prior to any excavation for ponds, or installation of culverts or dams on the Lots to ensure drainage easements are not compromised. Reference Articles 10.8, 10.9, and 10.15. j) Burn Bans. A burn ban issued by either Wise or Montague Counties shall be effective for all of Silver Lakes Ranch. Property Owners should contact the Sunset Volunteer Fire Department prior to burning during non-burn ban periods. Phone numbers are posted at the Firehouse. 2. USE OF AMENITIES GENERAL: The amenities at Silver Lakes Ranch Property are for the exclusive use of Property Owners and their invited guests. Guest use of an amenity while Property Owner is not present will be subject to confirmation of permission from the Property Owner. If permission cannot be verified the guest will be asked to leave. Property owners are allowed a maximum of 10 guests at any amenity at any time unless they have prior approval from the Board of Directors. a) Web Site http://www.athomenet.com/silverlakesranch/outside_home.asp is the address for the Silver Lakes Ranch web site. Access is available to Property Owners in good standing. Contact the Board of Directors for log-on id. b) Swimming Pool and Pavilion. The swimming pool and pavilion are for exclusive use of Property Owners in good standing and invited guests. Access to the pool gate is via an electronic card issued to each Property Owner. The pool and pavilion cannot be reserved for private parties. See pool rules in Appendix A. c) Clubhouse. The clubhouse can be reserved by Property Owners in good standing on a first come basis. A deposit of $300 is required. Reservations can be made on line at the SLR web site. See Clubhouse Rules in Appendix B. d) RV Park. The RV park is available to Property Owners in good standing. Reservations by RV spot can be made on line 3
at the SLR web site. See RV Park Rules in Appendix C e) SLR POA Office and Fire Hall. The POA Office is within the Fire Hall facility and is for official POA business only. The Fire Hall houses the Silver Lakes Ranch Station operations of the Sunset Volunteer Fire Department. f) RV and Boat Storage Area. Silver Lakes Ranch has a 5 acre parcel for RV and boat storage. There is a fenced area where Property Owners in good standing may park RVs and boats only. Space is available on a first come basis. Additional parking areas may be developed as the community grows. See Appendix D for storage area rules. g) Lake Amon Carter Boat Ramp. The Amon Carter boat ramp is located on City of Bowie property. It is available for use by SLR Property Owners. Trash and litter policy is: Haul out what you haul in. Activities on Lake Amon Carter are regulated by the State. h) Lake Horizon. Lake Horizon is a private lake for exclusive use by Silver Lakes Ranch Property Owners and invited guests. The common area for Lake Horizon includes the fishing pier, the dam area, the boat launch area, and parking lot. All other waterfront areas are private to the individual Property Owners whose lots front on the lake. Any watercraft on Lake Horizon are restricted to no wake, idle speed. Trash and litter policy is: Haul out what you haul in. i) Scout Lake. Scout Lake is a private lake for exclusive use by Silver Lakes Ranch Property Owners and invited guests. The common area for Scout Lake includes the dam area only on the lake. There is no boat ramp on this lake. All other waterfront areas are private to the individual Property Owners whose lots front on the lake. j) City of Bowie Property. The city of Bowie owns all waterfront on Lake Amon Carter up to the 920 elevation. 3. SAFETY AND SECURITY a) Security. Each Owner and occupant of a Lot and their respective lessees, invitees, licensees, and guests shall be responsible for their own personal safety and security on their Lot and on the Properties. 4
b) Security Patrol. The Silver Lakes Ranch Security Patrol operates on random schedules throughout the development. These officers are paid by the Association and authorized to question any suspicious activities / persons when deemed necessary. c) Vehicle Stickers. Silver Lakes Ranch vehicle stickers are available for display on the lower left side of the rear vehicle window. These stickers identify property ownership and are very helpful to the security patrol and Property Owners and Residents participating in the neighborhood watch. 5
