For The City will consider a variety of proposals that would restore and reuse the historic school building for commercial, residential, or mixed uses that would benefit the community. A single bidder may offer separate proposals for purchase or leasing the East Side School. /. OPTION ONE: Sale of Surplus Real Property (former East Side School): A. The City of Livingston, Montana is accepting sealed bids for the purchase of surplus City-owned real property described as follows: Tract A-1 and Tract B-l of Subdivision Plat 410 - Office of the Park County Montana. Purchaser must agree to grant the City of Livingston the right of first refusal in the event of future sale of the real property, or a portion thereof. 2. The City of Livingston makes no warranties or representations as to the condition of the building, or suitability of its use; i.e. the land and all improvements are being sold as is, where is and with all faults condition, subject to any and all conditions of record in the office of the Clerk and Recorder of Park County, Montana and subject to conditions set forth in the conveyance document. 3. The prospective purchaser must rely upon their judgment in presenting a bid for the purchase of the property. 4. The City of Livingston is willing to consider bids from individuals/organizations that seek to enter into a long-term lease (minimum 10 years) for the redevelopment, re-use, and occupancy of the former East Side School. ///. BID SUBMISSIONS All bids submitted in response to this Request for Proposal must contain, at a minimum, the following information/documents: > Name, Address, Contact information of the organization/individual submitting a response. > Detailed description of the intended re-development project for re-use of the former East Side School building; to include proposed timelines for construction and occupancy, desired/intended uses,' conceptual floor plans (and any intended alterations), any financial proposals related to capital investment as lease payment credits (if applicable), and/or other related project details critical to evaluating the project's desirability by the City Commission (and in the community's best interest). > (5) Five professional references, including contact information, for the submitting individual, organization, or partnership. > Statements regarding the bidder's intention, plans, and/or feasibility, in utilizing local businesses, services, contractors, or other vendors in completion of the project; > Estimated Project Costs & Financial Plan. IV. BID PROCESS This Invitation for Bids contains the instructions for submitting a bid. Compliance with all requirements must be met or the bid will be considered non-responsive. Bidders shall promptly notify the City in writing of any ambiguity, inconsistency or error which may be discovered upon examination of the Invitation for Bids. Bidders may submit bid, by mail or hand-delivery, to City Manager's Office, 414 East Callender Street, Livingston, Montana, 59047, which must be complete and free from ambiguity. Bids will be accepted by the City of Livingston, until June 10, 2009, at 3:00 p.m. The City reserves the right to issue any Addenda, to the original Request for Proposal, which are deemed necessary.
2. Each bidder must complete and sign the attached BID FORM. A person authorized to bind the bidder to a legal document must sign the form. All bid submissions will be the property of the City of Livingston and are non-returnable. 3. All bids submitted shall be valid for a period of not less than ninety (90) days. Bids must be submitted in a sealed envelope with the following information marked on the outside of the envelope: "Invitation for Bid: East Side School." Bids may be mailed or hand-delivered to the City Manager's Office. Bids by facsimile transmission will not be accepted... 4. The City may select a bid deemed by the City to be in the City's best interest to include: > The highest and best use of the property, in the greatest interest of the community, as determined from evaluation of the described project proposals; > Credibility, experience and financial sustainability of the bidder; > A desirable exchange of property; > The highest bid amount. Prior to final award, the City of Livingston reserves the right, upon approval of the City Commission, to negotiate with any bidder in order to finalize necessary contracts, memoranda of understanding, financial arrangements, or other documents necessary to complete a successful transaction. ; The bidder shall have ten (10) business days, unless specifically extended at the sole discretion of the City, from the date of final award to submit a cashier's check for the total amount of the bid for the subject property. In the event of a lease agreement, the bidder shall have ten (10) business days, unless specifically extended at the sole discretion of the City, from the date of final' award to submit a cashier's check for the total amount of three (3) months lease payments (or another number of months, as negotiated by the City and Bidder). Failure to submit a cashier's check for the total amount and/or an executed letter of agreement to all conditions may result in rejection of the bid, at which time the City may select the next bid deemed to be in the City's best interest or reject all bids. 5. The City reserves the right to reject any or all bids, to waive any minor irregularities or technicalities and to accept any bid it deems to be in the City's best interest. The City further reserves the right to reject a bid if more than one bid is received from an individual/entity, and/or if it is found that collusion exists amongst bidders. Incomplete bid submittals may not be considered. 6. Selection and Award of successful bidder(s) is subject to the approval of the Livingston City Commission.
7. A pre-bid meeting will be held on the 29th day of May, 2009, at the hour of 10:00 a.m. Any interested bidders are invited to attend, however such attendance is not mandatory. 8.
