last revised 4/98 MINOR SUBDIVISION INSTRUCTION SHEET IN ORDER TO BE CLASSIFIED AS A MINOR SUBDIVISION, THE PROPOSED SUBDIVISION MUST MEET THE FOLLOWING CRITERIA: 1. Result in three or less lots (including the original tract if it remains a lot) with frontage on an existing street. 2. Property in question has not been subdivided within the past ten years. 3. Not involve the creation of more than one lot on a private right of way. 4. Not involve a planned development, any new streets or the extension of any off-tract improvements, the cost of which is to be pro-rated pursuant to Section 112-25 of the Development Ordinance. PHASE I - PRE-APPLICATION REVIEW (OPTIONAL) The Applicant may request a pre-application meeting prior to submission of the application. The pre-application meetings are held on Tuesday mornings at 10:30 am, 11 am or 11:30 am, whichever time is available when scheduling the meeting. The applicant will meet with our Construction Official, Planner, Zoning Officer, Director of Fire Prevention, Engineer, Assistant Director of Health, Economic Developer and Traffic Officer. This review is not considered as the start of the application submission. The Planning Board will obtain verification from the Tax Collector that no outstanding taxes or assessments are due on the property. PHASE III - PROCEDURES AFTER SUBMISSION (1) When an application is submitted, it is first reviewed to determine if it complies with all submission requirements noted above. If the application is incomplete, the applicant will be notified within 45 days of those items required to complete the application. The applicant will be provided the opportunity to make such corrections and additions necessary to complete the application. When all items required have been submitted, Step 2 below will begin. (2) The application will be transmitted to various township agencies and departments for review. When the required reports are received from these various agencies, a determination will be made as to whether the application will be presented to the Minor Subdivision Subcommittee for review or scheduled for a Planning Board hearing. If the subdivision application does not require any variances, the Minor Subdivision Subcommittee will schedule a meeting with the applicant and review the application. If variances are required, the application will be scheduled for a full Planning Board hearing as described in Phase IV below. (3) Within 45 days of submission, the Planning Board will determine if an escrow deposit as provided by Section 112-29 of the Development Ordinance is required. If required, the applicant will be notified of the amount of escrow which must be submitted prior to scheduling for a public hearing. Upon receipt of the escrow deposit a date for a public hearing by the Planning Board will be provided assuming all other submission requirements have been received. (4) The application may be approved by the Minor Subdivision Subcommittee as submitted or with conditions established as necessary. Once the subdivision is approved, a resolution will be MS sheet 2/6
drafted and adopted at the next available Planning Board meeting. The date of adoption of the resolution is the official date of approval of the application. PHASE IV - PUBLIC HEARING/ACTION/RESOLUTION The applicant will be advised of the date scheduled for public hearing on their application. (1) If corrections or revisions are required to the plans, the revised plans must be received at least 10 days prior to the scheduled hearing date. (2) If the application requires newspaper advertisement and notice to property owners, such notification must be completed 10 days prior to the scheduled hearing. Information and dates will be supplied to the applicant at the appropriate time regarding advertising and noticing. (3) A public hearing will be conducted on the scheduled date provided the applicant has complied with the requirements of Items (1) and (2) above. The hearing may be continued to another meeting date if necessary. However, action by the Board will be taken within 45 days of completeness for applications not involving any variances and within 120 days of completeness for applications involving variances or conditional uses as established in the Municipal Land Use Law. (4) Within 45 days of action by the Board, the action taken will be reduced to writing and presented to the Planning Board for adoption in the form of a resolution. The date of adoption of the resolution is the official date of approval of the application. PHASE V - PROCEDURES AFTER APPROVAL Upon adoption of a resolution by the Board, a copy of the resolution will be forwarded to the applicant within 10 days after adoption. The applicant must proceed to comply with all conditions of approval. Upon compliance with the conditions, the subdivision deeds/maps will be signed by the Chairman and Secretary of the Board and distributed to the applicant and township agencies. PHASE VI - FILING OF SUBDIVISION The Municipal Land Use Law requires that a minor subdivision be filed with the County Recording Officer within 190 days of approval. Minor Subdivisions can be filed by the filing of the subdivision map. In order to file the map, the map must comply with the Map Filing Law of New Jersey, but since a majority of minor subdivision maps do not comply the following alternate procedure of filing by deed is usually followed: One deed is prepared for purposes of filing the subdivision only. This deed does not transfer title to prospective purchasers or serve any other purpose than to file the subdivision. The deed should meet the following specifications: (1) The deed should be from the present owner(s) to the present owner(s) with no change in ownership. (2) Block and lot references within the deed format should refer to the original lot number. (3) A deed description of the parcels must be inserted or annexed as follows: MS sheet 3/6
Tract I - description of the parcel with the lowest new lot number (e.g. Lot 1) with a statement at the end that "this parcel shall be hereafter known as Lot (insert new lot number) in Block (insert Block number) on the Tax Map of the Township of Franklin, Somerset County, New Jersey. Tract II - description of the parcel with the next lowest lot number (e.g. Lot 2), same procedure as above. Tract III (if applicable) - same procedure as above. (4) The deed must contain a certification to the effect that "this deed is intended to effectuate a minor subdivision approval by the Planning Board of the Township of Franklin, Somerset County, New Jersey on (insert date of resolution). Signature lines for the Chairman and Secretary should be provided. Submit the deed to the Planning Office before filing with the County Recording Officer. It will be reviewed by the Township Engineer for description, the Board Attorney for form, and signed by the Chairman and Secretary. Upon approval and signature, the deed will be returned to the applicant for filing. PHASE VII - LENGTH OF APPROVAL The zoning requirements and general terms and conditions, whether conditional or otherwise, upon which minor subdivision approval was granted, shall not be changed for a period of two (2) years after the date of minor subdivision approval; provided that the approved minor subdivision shall have been duly recorded as provided in Section 112-12 of the Development Ordinance.
