RULES AND REGULATIONS UPDATED June 2002 WHEREAS, the Declaration creating Darlington Woods Condominium gives the Board the duty to power, distribute and enforce rules and regulations governing the details of the use and operation of the property and common elements. WHEREAS, the Board wishes to clarify and enhance the use the use restrictions contained in Article XVI of the Declaration, Restrictions on Use; Leases of Units, BE IT THEREFORE RESOLVED, that the Board has adopted the following rules and regulations for Darlington Woods Condominium Association BUILDINGS: 1. No Alternations, as specifically provided in the Declaration of Condominium shall be permitted to the exterior of the home. no awnings are permitted. Windows, garage doors, and all other doors replaced must provide the same exterior appearance. Patio extensions are prohibited. Alternations to the decks and/or patios must be approved by the Board. Awnings are permitted on rear patios and decks according to specifications adopted August 14, 2001. A homeowner must receive written approval from the Board prior to the installation. 2. Firewood shall be stored and neatly stacked on a metal or pressure treated wood storage rack, on the patio or deck, or in the garage. A maximum of one-half cord of firewood may be kept on the patios or decks. No firewood is to be stored on the grass. Each unit owner shall provide periodic cleaning of the chimney and flue of the fireplace in order to prevent the possibility of fire or fire damage. 3. Exterior color of homes may not be changed by any homeowner. 4. No clotheslines may be hung or used on the exterior of any home or on any common element area. 5. No statuary, lawn ornaments, adorations, benches, bird baths, or any permanent type of furniture may be placed on any part of the common elements including, but not limited to fencing, siding and railings. 6. No patio, deck, or any other part of the Lot may be used for storage of any item with exceptions as itemized in these Rules or in the Declaration. Page 1

7. Christmas Decorations may be displayed after December 1 and must be taken down by January 15th. Lights may be installed around the windows and door frames only. Any damaged caused by the installation of decorations will be assessed to the homeowner. No decorations are to be affixed to the roofs. 8. Patios, decks and balcony areas cannot be screened in. Swings attached to decks or porches must be removed when not in use. 9. All antennas must be interior, with no wires or antennas visible from the exterior of the building. This also applies to any alarm system and additional telephone lines. TV cables cannot be run on the exterior of the building. 10. Storage sheds, dog houses, animal cages, basketball backboards, playhouses, play equipment or out buildings cannot be added to the common areas. 11. All window coverings shall be white or off-white in color. Blinds and/or shades may be purchased as an alternative to colored draperies. Coverings such as sheets or lack of window coverings on a temporary basis must be replaced with permanent coverings with sixty (60) days of occupancy. LANDSCAPE: 1. No vegetables or tomato plants can be grown on the common area including the flower beds. 2. Only flowers may be added to the existing beds and are to be maintained by the owner. If they are not maintained, the landscaper will be instructed by the Board to return the bed to it's original condition. Cost will be borne by the owner. Additional plants, shrubs and trees must be approved by the Board of Directors. 3. No toys, bicycles, tools, or any other items may be left on the common area. Bicycles and toys should not be stored where visible from the street. 4. The Association is responsible for removal of dead trees and shrubs from the common areas. All replacements will be made at the discretion of the Board of Directors. 5. Activities which may cause damage to lawn areas such as, but not limited to bicycle riding, or repeated use of a particular lawn area for ball playing is prohibited. Vehicles are not permitted to be parked on any lawn area. 6. Baby/Kiddie pools and sandboxes are prohibited. Page 2

TRASH REMOVAL: 1. For the Longwood Units all trash must be put in plastic bags and placed in the provided trash removal areas only. For the Brandywine units all trash must be put in heavy duty plastic bags and/or in covered containers. The bags and containers shall not be put out until dark on the evening before trash day. It is the responsibility of the homeowner to remove any debris left by torn bags. Trash days are Monday, Wednesday and Friday for the Longwood units and Tuesday and Friday for the Brandywine units. 2. Residents must make individual arrangements with a trash collector or other private contractors for the removal of large items (e.g., furniture, mattresses, appliances, etc.) These items are not to be left on curb areas or in trash houses. all charges will be assessed to the homeowner. 3. Christmas trees are to be placed with your trash on regular pick-up days. Do not throw your Christmas tree in the open space areas when you are finished with it. USE OF PROPERTY: 1. Units are to be used for residential use only or for incidental use (as outlined in the Declaration). PARKING AND VEHICLE OPERATION: 1. Parking in front of the mailboxes is prohibited. 2. Vehicles that are not currently licensed, inspected and regularly operated cannot be parked in the parking areas. Such vehicles will be towed away at the owner's expense, or at the discretion of the Board; fines may be issued. 3. No car repairs are permitted in the driveway, roads or parking areas. Flushing radiators or changing oil in the street or driveway in prohibited. 4. No commercial, recreational vehicles or boats may be parked in the community unless garaged. 5. A maximum speed of 15 mph is to be observed from the time of entrance into the community and throughout the complex. The speed limited will be enforced and the Board is authorized to impose fines. The State Police will be notified of anyone passing a school bus and action will be taken by the police. 6. Parking is not permitted in any areas other than the striped parking spaces. No ON-STREET parking. Page 3

7. All parking areas, exterior on the property shall be used for four wheel passenger automobiles, motorcycles, sport utility vehicles, non commercial pickup trucks, not exceeding one ton capacity. A commercial vehicle shall be defined as: a. Those which are not designed and used for customary personal, family purposes. b. Those with commercial lettering, graphics, equipment or supplies, tool boxes or ladder racks located on the outside of the vehicle. c. Any vehicles exceeding nineteen (19) feet in length or eleven (11) feet wheelbase; or a front overhang of three (3) feet or a rear overhang of five (5) feet; or a width of seven (7) feet; or height of six (6) feet or having dual rear wheels on one or more axles. 8. The exterior parking and storage of commercial vehicles or campers, mobile homes, motor homes, house trailers of any type, RV's and boats is prohibited. PETS: 1. No more than one domesticated dog or two house cats are permitted per unit. No animals of any kind shall be bred in any unit. 2. Dogs and cats must be leashed and in control of the owner at all times when outside the unit and must be walked away from the lawn areas. Pooper scoopers must be used by each pet owner. 3. No stake or other device may be erected on the lot for the purpose of securing a pet. No unattended leashing is permitted. 4. Any damage done to the lawn, shrubs or trees by a pet will be rectified at the pet owner's expense. SAFETY: Because we live in close proximity, we are responsible for our safety and the safety of other lives and property. Please use common sense when dealing with any dangerous item(s). 1. Outdoor cooking should never be left unattended. A fire extinguisher should be on hand. When using a grill under the deck, caution should be taken to eliminate a potential fire hazard. Damaged done to the siding, soffit, and/or porch roofs will be assessed to the resident. 2. Skateboarding, rollerblading, scooters and tree climbing are not permitted. Page 4

3. Street hockey is limited to the area by the tennis courts. Street hockey may be played on the guest parking areas surrounding the courts or by the basketball court. Hockey playing is restricted to when cars are not in the vicinity. Street hockey or any other type of game(s) is/are not permitted on the tennis courts. 4. The discharging of fire arms, air guns or BB guns is prohibited. 5. The setting off of any type of fireworks is prohibited. 6. Since fireplaces are zero clearance, we recommend that you use doors specifically provided with the manufacturers requirements. 7. Whirlpools and Jacuzzis are prohibited on any common or limited common areas. EXCESSIVE NOISE: All residents are responsible for their own noise abatement, and for any disturbances created by their guests. Unusual loud noise that disturbs the tranquility of the surrounding home(s) is prohibited. Residents should respect other residents' privacy and conduct themselves accordingly. LEASING: 1. Leasing of less than the entire unit is prohibited. 2. No unit shall be leased for a term less than one (1) year. The homeowner is responsible for any tenant who forfeits their lease agreement. If a tenant must vacate, the unit owner must re- rent the unit for no less than one (1) year. 3. All leases must be written and a copy must be furnished to the Management Office within thirty days of execution. 4. Lessees are subject to and bound by Covenants, conditions, and restrictions contained in the Declaration and the adopted Rules and Regulations. Homeowners will be assessed fines and will be responsible to collect and enforce the Condominium Regulations. 5. All leases shall contain an addendum which states that the lessee agrees to abide by the Declaration and Rules and Regulations of the Association. The lessor is responsible to notify and provide a copy of all Association Rules to the lessee at the time of the execution of the lease. All fines levied will be assessed to the homeowner for collection by the tenant. Page 5

VANDALISM Any resident and/or resident's minor children and their guests caught vandalizing condominium property will be prosecuted, fined and assessed the cost of the damage. OPEN HOUSE/REALTOR POLICY: 1. No signs, sale or rent, or house numbers may be placed or hung upon the exterior of the houses, on the walls, on a stake or post which are visible from the exterior of the unit other than what was installed by the Developer. The numbers installed by the Developer must remain as originally located. No window signs 2. Open house signs are permitted from 12 Noon to 4:00 PM. Signs can be placed fifteen minutes prior and removed fifteen minutes after the times designated. All balloons and sale paraphernalia must be removed immediately. All unauthorized signs will be removed and discarded. 3. Signs may be placed as follows: a. One on Walnut Hill Blvd. and Brandywine Drive; b. One directional sign may be placed at the intersection of Brandywine Drive and Brandywine Circle; c. One sign may be placed in front of the unit; d. One sign at the court entrance; and e. Signs are prohibited to be placed in flower beds. 4. All homeowners are responsible for informing their realtor of the open house policy. All actions of the realtor are the responsibility of the homeowner. 5. Homeowners are required to notify the management office upon the sale of a unit. All homeowners are required to obtain a 3407 package or Certificate of Resale. A copy of the agreement of sale is required within ten (10) days of the sale of the unit. The cost for the resale package is borne by the seller and is subject to change.
