Variances are subject to a public hearing before the Planning and Zoning Commission and approval by the Lisle Village Board. This application is available on the Village s website at http://www.villageoflisle.org/home/index.asp?page=306. Submit a completed application including all materials noted in the plan and fee submittal requirements section of this application. Packets will not be accepted and/or processed until all of the submittal requirements are met. 2. Your completed application packet will be forwarded to Village staff for review and comment. Copies of any comments will be provided and may necessitate revisions to plans prior to the scheduling of a Planning and Zoning Commission and/or Village Board meeting. 3. Staff will work with the Applicant to schedule a public hearing/meeting before the Planning and Zoning Commission (if required). Once a hearing date has been scheduled, Village staff will complete all required public notices (mailed notice, sign on property and newspaper publication if applicable) on the Petitioner s behalf. 4. Following a public hearing/meeting and recommendation by the Planning and Zoning Commission (typically two meetings), the case will be scheduled for Village Board consideration (typically two meetings). Permits associated with the variance will only be granted upon Village Board approval of the variance request.

EXHIBIT 1: FINDINGS OF FACT FOR GRANTING ZONING VARIANCES All petitions for zoning variance shall be accompanied by a statement of Findings of Fact. The Findings of Fact shall include specific examples demonstrating the proposed project would result in practical difficulty or unnecessary hardship that would deprive the owner of the reasonable use of the land or buildings involved if strict application of the zoning regulations were applied. Section 5-19-1C: Findings of Fact for Granting Variances No variances in the strict application of the provisions of this Chapter shall be recommended for approval by the Board of Appeals unless it finds: 1. That there are special circumstances or conditions, fully described in the Findings, applying to the property (properties) for which the variance is sought, which circumstances or conditions are peculiar to such property (properties) and do not apply generally to properties in the zoning district, and that said circumstances or conditions are such that the strict application of the Village code would deprive the applicant of the reasonable use of the subject property (properties). 2. That, for reasons fully set forth in the Findings, the granting of the variance is necessary for the reasonable use of the property (properties) and that the variance as recommended for approval by the Board is the minimum variance that will accomplish this purpose. 3. That the result of granting of the variance will be in harmony with the general purpose and intent of standards set forth within this code and in harmony with the configuration and shape of lots within the subdivision in which the subject property lies, and will not be injurious to adjacent property or otherwise detrimental to the public welfare. 3

FOR VILLAGE USE ONLY Account/Permit #: Community and Economic Development Department 925 Burlington Avenue Lisle, IL 60532 REIMBURSEMENT OF FEES AGREEMENT (page 1 of 2) By signing below, the Petitioner and Owner acknowledge that each of them has read the following paragraphs and fully understands the provisions contained within Section 1-14-1 of the Village Code and agrees to comply with the provisions of Section 1-14-1 (Recovery of Professional Fees) and with the terms set forth herein. Further, by signing below, each signatory warrants that he/she/it possesses full authority to so sign. Section 1-14-1: Reimbursement of Fees: In the event that it is necessary for the village to retain the services of a professional, including, but not limited to, attorneys, engineers, planners, architects, surveyors, traffic or drainage experts, or other consultants, in connection with any petitioner's request for the village to consider or otherwise take action upon any zoning change, special use, planned unit development, variation from village code, subdivision or other improvement or development upon real property, then the petitioner and the owner of the property shall be jointly and severally liable for payment of such professional fees and reimbursement shall be made to the village within thirty (30) days of receipt of an invoice for same. In addition, any expenses incurred, including, but not limited to, mailing and copying, as a result of any such request, application, or development application shall be reimbursed to the village in the same manner. Further, any professional fees incurred as a direct or indirect result of a party requesting a professional opinion or otherwise requesting relief or assistance from the village, whether or not related to real property, shall be reimbursed in accordance with this section if, in the discretion of the village, a professional opinion is desired. (Ord. 89-1799, 2-6- 1989) Failure to reimburse the village in accordance with this subsection may, in the village's discretion, result in the refusal of any board, committee or other governing body to consider or take action upon any further requests from a petitioner or owner who has failed to pay in full all amounts due under this section. Further, the village may deny any application for a grading, building or other permit if such amounts have not been paid in full and the village may elect to file a lien against any real property associated with such a petitioner's request. Interest in the amount of a percentage, as established by the village, per month shall accrue on all sums outstanding for thirty (30) days or more. When any professional services contemplated by this section are rendered by the village staff, including any staff engineers, or services performed by the assistant village manager, then, the party making the request shall reimburse the village for its costs incurred by providing the professional services of the village staff, at the rate as established by the annual fee ordinance. The village manager or his designee is hereby authorized to assign requests for professional services to village staff or to consultants as the village manager deems appropriate.
