1 Purpose This document was developed to provide homeowners living in the Clublands of Joliet, their Family and Guests with a clear set of Administrative Rules and Regulations applicable to all property owned and under the control of the Clublands of Joliet Homeowners Association, and as a vehicle to consolidate, review, and edit existing rules and polices if necessary. 2 Definitions 2.1 Association shall mean and refer to The Clublands of Joliet Homeowners Association, an Illinois not-for-profit corporation. Said corporation shall be the governing body for all the Owners with respect to the administration, maintenance, repair and replacement of the Common Area and other responsibilities all as provided by the Declaration and the By-Laws. 2.2 Board shall mean the Board of Directors of the Association as constituted at any time, or from time to time, in accordance with the applicable provisions of Article III of the Declaration. 2.3 The Committee Shall mean the Rules & Policy Review Committee as authorized by the Board. 2.4 Common Area Shall have the meaning given to the term in the Declaration and includes, but is not limited to, the following areas: the Clubhouse, Swimming Pool area, Tennis Courts, Basketball Courts, Volley Ball Courts, Parks, Tot Lots, Lakes, Ponds, Parking Lots and all association property adjacent. 2.5 Member / Homeowner Shall mean and refer to any person or entity who holds membership in the Association. 2.6 Family shall mean one or more persons each related to the other by blood, marriage, or legal adoption, or a group of not more than two (2) persons not all so related, together with his or their domestic servants, maintaining a common household in a Dwelling Unit. 2.7 Guest shall mean anyone invited onto any part of the Common Areas by a Member or a Member s Family. 2.8 Household Consists of Members and Family that reside in a single Dwelling Unit. 2.9 Incident Report A written document regarding any potential violation of any section of these Rules and Regulations filed by any member of the Association, an employee of the Association or any person authorized by the Board of Directors. Incident reports must contain the following information: date, time and location of the incident, name and contact information of the person filing the report, names of any witnesses, the specific section of this document pertaining to the violation and a description of the incident. A copy of the Incident Report form that should be used is attached hereto as Exhibit A. 2.10 Violation Notice Written documentation of a specific violation or infraction of any provision of these Rules and Regulations where some type of enforcement action is either necessary or requested. Violations can only be issued by the Board of Directors or their authorized representatives (i.e., Property Manger, Clubhouse Manager, Clubhouse Assistant Manager) or other persons as authorized from time to time by the Board. A copy of the Violation Notice form that should be used is attached hereto as Exhibit B. 2.11 All definitions contained in the Declaration and By-Laws are incorporated as part of these Rules and Regulations. 3

3 Scope and Authority 3.1 The authority for preparing and enacting these Administrative Rules & Regulations is granted within the By-Laws of the Clublands Homeowners Association, Article V, Powers of the Board. 3.2 All rules, regulations, restrictions and covenants contained in the Declaration and By-Laws are incorporated as part of these Rules and Regulations. To the extent that the provisions of applicable law, the Declaration, the By-Laws or the Rules and Regulations are in conflict, the provisions of applicable law shall first control, followed by the Declaration, By-Laws, and the Rules and Regulations, in that order. 3.3 Nothing in this document shall forbid remedies jointly, or in combination with, any criminal, administrative and/or civil actions. 3.4 Upon resolution, these Administrative Rules and Regulations may be changed or altered at any time by the Board. 4 Policies and Rules of Conduct for all Association Property, Structures & Common Areas 4.1 No Member, Family, Guest or other person(s) shall violate any local, state or federal laws while on or in the Property. 4.2 Members will be responsible for the actions of their Family and Guests and are financially liable for any damage to Common Area and/or Association equipment resulting from their misuse. 4.3 No persons shall engage in any disorderly conduct such as spitting, pushing, rough play, fighting, quarrelling, loud, threatening or profane language, assembling for any unlawful purpose, harassment of any kind or any breach of the peace. No person, or group of persons, shall assemble for the purpose of riotous assemblage or to annoy, harass, or inflict property damage or bodily injury upon another person or persons or inflict damage to the Common Area or any assets owned by the Association. 4.4 Members or Families must accompany any and all Guests when they are on the Common Area and using facilities located on the Common Area, unless otherwise specified. 4.5 Members that are not in good standing with the Association and their Families are not entitled to use the Association facilities including the Clubhouse, Swimming Pool, Parks, Tot Lots and Lakes. 4.6 Association staff may ask a Member, Family and/or Guest to leave the Common Area if such individual(s) are not complying with the Declaration, By-Laws, and/or these Rules and Regulations. 4.7 No person shall have, or ride, any unlicensed or off-road motorized vehicles on the Property, except for wheelchairs, battery powered children s power wheels or other similar vehicles. 4.8 Gang clothing, signs, symbols, activity, etc. are strictly forbidden. 4.9 No person shall leave garbage, cans, bottles, papers, or other refuse anywhere other than in the receptacles provided. 4.10 No person shall disturb any bird s nest or eggs. 4.11 No person shall discharge any firecracker or fireworks on the Property. 4.12 No person shall use radios, tape machines, CD players or amplification systems in a loud manner that will interfere with others or cause a breach of the peace. 4.13 No person shall perform or engage in any lewd, obscene, illicit, or indecent act of behavior and no person shall make any indecent exposure of his or her persons. 4

5 Policies and Rules of Conduct for the Association Clubhouse 5.1 Clubhouse Hours: 7:00 a.m. to 9:00 p.m., Monday through Friday 9:00 a.m. to 9:00 p.m. Saturday and Sunday Private parties may extend the hours until midnight on Friday and Saturday evening. 5.2 Members and Family are required to sign in and show their Association ID to the Clubhouse staff upon entering the building. Permission to enter the Clubhouse may be denied to any Members or Family without a Clubhouse ID. ID s or duplicate IDs may be obtained any time during regular hours with proof of residency. There is a fee of $5.00 for duplicate IDs. 5.3 Proper attire is required in all areas of the Clubhouse. 5.4 Homeowners, Families, and their Guests using the facility are expected to respect the property. Please do not lounge, prop up your feet, or use the furniture or facilities in any way not intended. Horseplay, excessive behavior, and climbing or jumping off of anything, including stair rails, inside or outside of the building, is not permitted. 5.5 No one under the age of eighteen (18) is allowed in the Clubhouse without adult supervision, except during supervised programs. That adult may not supervise more than three (3) unrelated people under age eighteen (18) at any one time. 5.6 The Clublands of Joliet staff has been instructed to ask any Member, Family, and/or Guest, to leave the building for any inappropriate behavior and/or failure to follow the Declaration, By-Laws, these Rules and Regulations, and/or any other policies. 5.7 Guest Policy - Each Household can bring two (2) Guests per day into the Clubhouse. 5.8 Pets, with the exception of service animals, are not allowed in the Clubhouse. 5.9 Exercise Room 5.9.1 Members or Family must register at the front desk and are required to leave their ID with the staff in exchange for an exercise facility key. 5.9.2 No persons under the age of thirteen (13) are allowed to use the exercise equipment. Persons ages thirteen (13) to seventeen (17) may use the fitness facility when accompanied by a parent/guardian. 5.9.3 Shirts and appropriate clothing are required at all times. 5.9.4 Members, Family and Guests using the exercise area and equipment must wear athletic footwear such as tennis shoes, jogging shoes, aerobic shoes, etc. Athletic footwear must be clean, dry and free of debris such as rocks and/or salt. Association Staff may ask to inspect the shoes of anyone using the exercise area and if their shoes are found to be in violation of this provision, Association staff may restrict such individual s usage of the exercise area and equipment until proper footwear is worn. Members are responsible for any damage or need for unscheduled maintenance caused to any exercise equipment by any Member, Family, or Guest who use footwear in violation of this policy. 5.9.5 If there are other people waiting to use exercise equipment, limit yourself to thirty (30) minutes per machine. You may use the machines longer, providing no one is waiting. 5.9.6 Return accessories to the proper place. 5.9.7 Exercise equipment must be wiped down after use, towels and disinfectant are provided. 5.9.8 Adults may bring their children into the exercise area when working out. Adults must ensure that children play quietly in the enclosed play area and should not be allowed in or around the exercise equipment or left unattended. No more than six (6) children are allowed in the play area at any one time. Adults with children using the play area are responsible for picking up toys and using the sanitary spray provided on all surfaces. 5.9.9 Equipment in need of repair should be reported to Association Staff immediately. 5

5.10 Private Reservation Provisions 5.10.1 The Member who rents and signs the Party Reservation Agreement must be present at all times at the event. 5.10.2 Space rented is to be left in the same condition as it was at the beginning of the reservation time period. Returning the space to the same condition includes vacuuming, mopping the kitchen and washroom floors, cleaning tables and returning them to their storage areas, emptying all garbage, and returning furniture back to the original positions. The Clubhouse will provide a vacuum cleaner, mop and brooms. Members are required to bring trash bags. Members are required to take out all garbage to the dumpster located in the parking lot and not to the garbage can located in front of the Clubhouse. Failure to comply with these cleaning specifications will result in forfeiture of the security deposit. 5.10.3 The time allocated for cleaning the premises and returning them to the same condition as they were when you arrived is included in your rental time period. If your rental time is to end at 9:00 p.m., that means all clean-up is to be concluded by 9:00 p.m. If your clean-up or your event runs past 9:00 p.m., or past midnight on Friday or Saturday, you will be assessed twenty-five dollars ($25.00) per quarter hour that the event and/or clean-up extends. 5.10.4 Alcohol is permitted only upon prior reservation and with a copy of the current homeowner s insurance policy on file with the Association. No alcohol is allowed outside of the space being rented. Use of alcohol by minors is strictly forbidden. The Association has the right to prosecute any person who violates this provision. 5.10.5 Smoking is not allowed in any area of the Clubhouse. 5.10.6 Neither Guests nor Members are allowed in any part of the building other than the room space specifically reserved for the event, other than the restroom facilities. 5.10.7 Use of the pool and/or exercise equipment are strictly prohibited during private events by the Members, Family, and Guests who are attending the function. 5.10.8 Children under eighteen (18) must be supervised by an adult at all times during the event, and must be kept in the room being rented. 5.10.9 Decorations are permitted. If balloons are used, they must be secured. If helium balloons should get loose and float to the ceiling; it is the Member s responsibility to get them down before leaving. No tape or tacks are allowed on the walls. If tape is used on windows, it must be removed before leaving. Failure to do so will result in a clean-up penalty. No glitter decorations or plastic confetti is allowed in the Great Room. 5.10.10 Barbecue grills or any other type of cooking equipment other than those made available by the Association are not allowed. 5.10.11 Live animals, Moon walks or any other type of recreational equipment are not permitted on, or in, the Clubhouse property, with the exception of the use for Clubhouse/Association run events. 5.10.12 D.J. s or other music is permitted so long as the volume is not excessive. Volume will be deemed excessive if the Association staff on duty is unable to handle incoming telephone calls. 5.10.13 Foul or inappropriate language or behavior is strictly prohibited. This includes excessive and inappropriate language directed at any staff member. Verbal abuse to staff members can result in loss of security deposit and / or future loss of the use of the Clubhouse for private rental. 5.10.14 No cover charges, admission fees or contributions for public, private or non-for-profit organizations may be collected for events held by Members within the Clubhouse, without prior approval from the Board. 6

5.10.15 The Clubhouse will be inspected at the conclusion of the function by an Association Staff member for damages and cleanliness. The Member will be notified of any item not in compliance with the terms and conditions of this agreement. The Clubhouse attendant is required to be in the building during the entire event and may from time to time enter into the space being rented by the Member. 5.10.16 The Association and the Board of Directors are not responsible for lost or stolen personal property. 5.10.17 The Member is responsible for setting up all tables and chairs at the start of rental time period. Members must provide their own linens, ice and any other party supplies. No one will be allowed into the room prior to start time in order to set up for the party. 5.10.18 The Clubhouse attendant and the Member must complete a checklist at the conclusion of the event. 6 Polices and Rules of Conduct: Association Swimming Pool & Adjacent Area 6.1 The following rules are for the protection and benefit of all to insure safety and a sanitary operation of the pool and facilities. Your cooperation in complying with these conditions will afford pleasant relaxation and recreation for all. Parents are required to ensure their children observe and obey all of the rules. 6.2 Pool Hours (open seven (7) days a week during the season) Monday-Friday 7A.M. to 9 A.M. Adult swim only, no one under eighteen (18) is allowed on deck. NO LIFEGUARD ON DUTY 10 A.M. TO 7:45 P.M. All ages swim. Last fifteen (15) minutes of every hour is adult swim only 7:45 P.M. TO 9 P.M. Adult swim, no one under eighteen (18) is allowed on deck Saturday & Sunday 9A.M. 10 A.M. Adult swim only, no one under eighteen (18) is allowed on deck. NO LIFEGUARD ON DUTY 10 A.M. TO 7:45 P.M. All ages swim. Last fifteen (15) minutes of every hour is adult swim only 7:45 P.M. TO 9 P.M. Adult swim, no one under eighteen (18) is allowed on deck 6.3 All Members, Families and their Guests must abide by the pool rules and follow the directions of the Pool Attendants, Lifeguards, Association Staff, Clubhouse Manager and Property Manager. 6.4 Any Members, Families or their Guests who misbehave at the pool/clubhouse are subject to potential disciplinary measures as directed by the Clubhouse Manager or staff, which may include suspension of pool privileges. 6.5 All Members and Families must show their Clublands ID to the Clubhouse Staff upon signing in. 6.6 Guest Policy: Each Household may bring two (2) Guests per day. Guests may use the pool only when accompanied by a Member or Family. In addition to the two (2) Guests per day, each Household may request one (1) punch card with ten (10) additional guest passes at no charge. Additional punch cards may be purchased for twenty dollars ($20.00). The Clubhouse management has the right to refuse Guests and punch card passes at anytime if overcrowding occurs. 6.7 Family under the age of thirteen (13) years old must be accompanied by an adult eighteen (18) or older at all times. That supervising adult may not supervise more than three (3) unrelated children under thirteen (13) at any one time. 6.7.1 The following exception applies: Family ages eight to twelve (8-12) will be allowed in the pool with a responsible person aged sixteen (16) or above. Under these circumstances, the supervising person will be responsible for appropriate behavior of the child and will not be allowed any other Guests during this arrangement. 7

6.7.2 Family age twelve (12) years old will be allowed to use the pool unaccompanied after passing the swim test proctored by a certified lifeguard. The swim test requirements are available upon requests. (A parent or legal guardian must accompany the child at the time of the swim test.) 6.8 No diving is allowed. 6.9 No running, pushing, rough play or profane language will be tolerated. Spitting, spouting of water, blowing the nose or otherwise introducing contaminants into the pool will not be permitted. 6.10 No smoking, alcohol, glass containers or breakable objects are permitted in the pool area. Liquid refreshments are allowed in the pool area, provided they are in unbreakable containers. Food is permitted in the designated eating area only. 6.11 No pets are allowed in the pool area. 6.12 Showers with soap are required before using the pool. Persons using suntan preparations that leave a greasy or oily substance on their skin must rinse this substance off before entering the pool. Swimmers who leave the pool area for any reason are required to shower before returning to the pool. 6.13 Proper swim attire is required. Cut-offs and thong suits are not permitted. Street shoes must be removed before entering the pool area. 6.14 Kickboards, inner tubes, and inflatable rafts are not permitted in the pool. Only inflatable objects used as swimming safety aids will be allowed in the pool. Children who are unable to swim may use water wings. Pool toys are permitted at the discretion of the pool attendant. 6.15 Lockers are available. All items and locks must be removed daily. Locks that are not removed at the end of the day will be cut off. The Association is not responsible for any lost, misplaced, damaged, and/or stolen items placed in lockers. 6.16 Children not yet toilet trained must wear diapers and plastic protective pants at all times when in the pool area. Little swimmers are available at the front desk for a fee of one dollar ($1.00). 6.17 All trash must be put in the containers provided in the designated areas. 6.18 All person(s) found to be in the pool before or after pool hours will lose their pool privileges, the person(s) will be considered a trespasser and the trespassing will be reported to the police. 6.19 Only battery-operated radios equipped with earphones are permitted. 6.20 Persons having any skin disease, sore or inflamed eyes, cold, nasal or ear discharge, open sores or bandages or any communicable disease of any kind will not be admitted. 6.21 The pool attendants and Clubhouse staff reserve the right to close the pool at their discretion due to inclement weather, chemical imbalances in the water, or for any other unsafe condition. 6.22 During adult swim, no one under eighteen (18) will be allowed in the pool. Children are to be supervised during this time and not allowed to play in the locker rooms or Clubhouse building. Children age five (5) and under and their parents are allowed to continue to use the kiddie pool. 6.23 All persons using the pool must be dry before entering the Clubhouse. 6.24 The pool may not be reserved for private parties. 6.25 All persons using the pool do so at their own risk. The Association, and/or any agent thereof, assume no responsibility for any accident or injury in connection with such use, or for any loss or damage to personal property. Persons using the pool agree not to hold the Association, and/or any agent thereof liable for any accident of whatever nature occurring within the pool area. 7 Policies and Rules of Conduct Specific to the Basketball, Tennis and Volleyball Courts 8

7.1 No one is allowed on any of the courts unless he/she has checked in at the Clubhouse. All Members and/or Families using one or more of the courts must leave their ID with the Clubhouse staff and receive a key for the gate. 7.2 Individuals accessing the courts shall lock the gate from the inside while utilizing the courts. 7.3 No more than twenty-four (24) people are allowed on the courts at any one time. 7.4 Individual s use of a court is limited to sixty (60) minutes if there are other individuals waiting to use the court. If there is no one waiting to use the court, play can be extended past sixty (60) minutes. 8 Polices and Rules of Conduct Specific to Parks, Tot Lots, Lakes and Adjacent Lake areas 8.1 Parks & Tot Lots 8.1.1 Hours Available for Use: Dawn to Dusk 8.1.2 Animals may not roam without a leash or chain. Members will be responsible for dogs or other animals damaging or destroying the Common Area and will be held liable for the full value of the property damaged or destroyed in addition to any penalties imposed for this violation. Members are also responsible for picking up and properly disposing of animal waste. 8.1.3 Bicycles are permitted on roads, bike paths, and sidewalks only. Bicycle racks must be used when provided. 8.1.4 No alcohol is permitted in Parks or Tot Lots. 8.1.5 Tot Lot equipment is reserved for the use of children. 8.1.6 No person shall misuse any Park or Tot Lot equipment in such a manner that it causes damage. Members are responsible for the actions of their Family members and Guests and will be held liable for the full value of the property damaged or destroyed in addition to penalties imposed for this violation. 8.1.7 No person or group of persons shall assault or commit bodily injury upon another or engage in or abet or aid in any fight, quarrel or other disturbance. 8.2 Lakes and Adjacent Areas 8.2.1 It is the policy of the Association to catch and release, while still alive, all fish caught in Association owned lakes or ponds. 8.2.2 No person shall swim in any Association lake or pond. 8.2.3 No person shall use any kind of watercraft, boat, raft etc. on any Association lake or pond. 8.2.4 No person shall walk or go upon any lake or pond while frozen. 8.2.5 No person shall litter, leave garbage, or cause any toxic substance to enter into, upon or adjacent to any Association Lake or Pond. 8.2.6 No person may cause or divert any substance including water, sewage etc. so that it enters into or leaves from any Association Lake or Pond. 8.2.7 No person shall use an Association Lake, Pond or adjacent area in such a manner that it causes a disturbance or infringes upon the Property or any adjacent private lot. 9 Enforcement of Administrative Rules and Regulations 9

9.1 The Property Manager or designated representative will use the attached forms as an Incident Report and Violation Notice and shall keep records of all Incident and Violation Reports for a period of three (3) years. 9.2 Enforcement of any Administration Rule or Regulation requires the issuance of a Violation Notice and Incident Report. 9.3 The Board authorizes the Association Property Manager to take the following enforcement actions regarding any violation of the Administrative Rules or Regulations: 9.3.1 Written Warning 9.3.2 Up to and including a five (5) day suspension of the use of any and all Association Property & Equipment. 9.3.3 Refer the violation to the Board of Directors for additional review and / or action. 9.4 The Board authorizes the Clubhouse Manager to take the following enforcement actions regarding any violation of the Administrative Rules or Regulations: 9.4.1 Written Warning 9.4.2 Up to and including a three (3) day suspension of the use of any and all Association Property & Equipment. 9.4.3 Refer the violation to the Board of Directors for additional review and / or action. 9.5 The Board authorizes the Clubhouse Assistant Manager or Assigned Employee in Charge to take the following enforcement actions regarding any violation of the Administrative Rules or Regulations: 9.5.1 Written Warning 9.5.2 Up to and including a one (1) day suspension of the use of any and all Association Property & Equipment. 9.5.3 Refer the violation to the Board of Directors for additional review and / or action. 9.6 The Board will take whatever enforcement action it deems necessary for any violations that are referred by the Property Manager, Clubhouse Manager, Clubhouse Assistant Manager or Assigned Employee in Charge or violations that are of such as serious nature that the Board feels compelled to review and take action. 9.7 The Board will review all enforcement action taken by any authorized person and retains the right to affirm or overturn any action. 9.8 Members and Family of Members who have received a Violation Notice from the Property Manger, Clubhouse Manager, Clubhouse Assistant Manager or Assigned Employee in Charge may petition in writing the Board to review the enforcement action taken against them. Such petition must be in writing, on the enclosed Request For A Hearing form, stating clearly the reasons why such an enforcement action should not be taken, and be delivered to the Board within twenty-one (21) days of the Violation Notice date. If a timely Request For A Hearing form is delivered to the Board, the Board shall meet in person with the parties involved and hold a hearing. After the hearing, the Board shall rule on any enforcement actions that it deems necessary and appropriate. If a hearing is requested, but the individual requesting the hearing fails to appear, then that individual may be found guilty by default for his or her failure to appear. Notice of the Board s determination shall be provided to the Member on the enclosed Notice of Determination Regarding Violation form. 9.9 It is the policy of the Board that if enforcement action is taken that involves any Family or Guest that the Member who is responsible for their actions be notified as soon as possible. 9.10 Upon the receipt of an Incident Report by the Board, the owner(s) alleged to have violated the Declaration, By-Laws, or these Rules and Regulations will be sent a Violation Notice. 10
