RULES AND REGULATIONS OF STRUTHERS RANCH HOMEOWNERS ASSOCIATION, INC. Revised June 29, 2017 1. Homeowners Association. Each owner of a lot in the subdivision shall read the Declaration of Covenants, Conditions and Restrictions of Struthers Ranch ( Declaration ), the Articles of Incorporation, the Bylaws, the Architectural Control Committee (ACC) Procedures and Guidelines, and these Rules (the "Association Documents ) of the Struthers Ranch Homeowners Association, Inc. (the "Association"). Each owner shall strictly comply with the Association Documents. The Association's Board of Directors ("Board") shall have the power to enforce the Association Documents and to amend these Rules from time to time. All citations below are references to the Declaration, unless otherwise stated. 2. Architectural Control. (Article VI, 6.1 and 6.2) A. Each owner shall strictly comply with the requirements for architectural approval set forth in the Association Documents. The ACC shall have the sole authority to perform the obligations and exercise the rights of the ACC pursuant to the Association Documents, in particular Article VI of the Declaration. The Board shall have final discretion in interpreting, enforcing and determining compliance with the architectural control provisions of the Association Documents and upholding the authority of the ACC which may be the Board itself. The ACC shall operate according to the ACC Procedures and Guidelines established by the Board. B. Without the prior written approval of the ACC Owners may not: (i) (ii) (iii) (iv) repaint any structure on the lot. Owners must submit an ACC package with the proposed paint colors and patterns and receive ACC approval. Owners are encouraged to select from the color schemes posted on the Struthers Ranch website. Landscape maintenance such as removal of dead or dying trees or bushes or addition of refreshing ground cover may be performed without ACC approval. The minimum standards for landscaping including one deciduous tree of 1.5-inch caliber or one evergreen tree of four feet minimum must be maintained. Xeriscaping consistent with the Board s xeriscaping policy is encouraged. (ix) install aerial antenna, poles, wires or similar objects upon the exterior of any building

Residential Use. No Lot shall be used for any business, manufacturing or commercial purpose whatsoever; provided, however, if the appropriate zoning so allows an Owner may use a portion of the Home's interior for any home occupation uses permitted by the El Paso County's Occupation Ordinance. (Article VII, 7.3) 4. Animals. (Article VII, 7.4 & 7.22) A. No animals of any kind may be kept or maintained on any Lot, except for a reasonable number of bona fide pets, as defined in the following paragraphs. B. No more than three dogs and cats in any combination shall be permitted on any lot at any time. Notwithstanding this maximum limit, Homeowners are responsible for the behavior of any dogs or cats kept on their lot. This includes, but is not limited to, ensuring that their animal(s) do not present a nuisance to neighbors due to behavior such as digging, roaming loose, or barking. C. Homeowners may keep additional pets that typically remain indoors such as Guinea pigs, hamsters, turtles, fish, lizards, etc. so long as they do not present a nuisance or inconvenience to other homeowners. D. Animals or pets shall not be bred or kept for commercial purposes, shall not be allowed to make objectionable noises, smells or otherwise constitute a nuisance or inconvenience to other homeowners or shall not be kept in violation of any law or insurance regulation. E. Pets shall only be allowed outside the buildings when on a leash or in a carrier container (this does not apply to pets in fenced back yards). Pets shall be under complete physical control at all times when not in the confines of a fenced yard. Pets may not be tied or chained to any tree, building, stake or structure. Consistent with Section 7.22 (c) dogs and cats may not roam outdoors. F. In the event a pet defecates on the Common Area walks, common area open space, driveways or landscaped areas; pet owners must immediately pick up pet waste and dispose of in a proper manner. Pet waste cannot be left on another homeowner's or common area lot; to include the open space. Pet owners are prohibited from allowing a buildup of pet feces to accumulate on their Lots. G. No feeding of wild birds or animals is allowed. H. No livestock or poultry are permitted on any Lot. 5. Signs. No signs shall be placed upon any Lot, the Common Areas or any common landscaping except an Owner may place one (1) free standing "For Sale/For Rent" sign on his/her lot, but not exceeding customary size (3' x 3') or one political sign per political office or ballot issue that is contested in a pending election. (Article VII, 7.6(a)) 6. Fencing. Installation of fencing must be approved by the ACC. Approved fencing (except Association fencing) must be maintained by that Owner at his/her sole expense in an attractive, clean, safe and acceptable condition, (defined as no broken, missing, or misaligned boards, no rust marks from fasteners, no water stains from sprinklers, no broken gates, etc.). If stained, fences shall be stained with a clear, cedar or redwood tinted semi-transparent stain, and stain shall be reapplied as

necessary to prevent a weather-worn appearance. Fences will not be painted. (Article VII, 7.6(b)) 7. Lots to Be Maintained. No storage of items including but not limited to trash, liter, boxes, containers, bottles, cans, implements, machinery, lumber or other building materials shall be allowed on the exterior of any building. (Article VII, 7.7 & 7.14) 8. No Antennae or Devices. No Owner shall install more than one satellite dish not more than 34 inches in diameter. (Article VII, 7.10) 9. No Hazardous Activity. (Article VII, 7.11) A. No owner or occupant shall discharge any firearms in the subdivision. B. No owner or occupant shall do any open cooking which may cause a fire danger or noise or inconvenience to other owners, but ordinary, safe, natural gas or LP barbecues are allowed. C. No owner or occupant shall store or keep any flammable liquids, solvents, or toxic materials on their Lots that are not in the appropriate containers. D. No open fires, outdoor wood-burning fireplaces or fire pits, or charcoal grills shall be permitted. 10. No Annoying Light, Sounds, or Odors. (Article VII, 7.12) A. No owner shall allow noise by radios, televisions, parties or otherwise to annoy other owners. B. No odor shall be emitted on any Lot which is noxious or offensive to others. C. Any exterior lighting installed on any Lot shall either be indirect or of such controlled focus and intensity so as not to disturb the residents of the neighboring Homes. Each owner shall keep their own lights in operable condition. 11. Operation, Parking, Storage, and Repair of Vehicles. (Article VII, 7.13 & 7.16) A. All residents and guests shall drive with extreme care to avoid injury to children, other residents and other vehicles and property. B. All vehicles must meet local noise and safety requirements. Vehicles or motorcycles without mufflers in good condition are prohibited. C. No recreational vehicles, boats, campers, trailers, junk or inoperative vehicles, as determined in the sole discretion of the Board, shall be parked in any driveway, on any lot, on any private street or elsewhere within the subdivision. Twenty-four (24) hours of loading and unloading per week are allowed. (7.13(a) & (b)) D. No vehicles shall be parked on the street within or adjoining the property for more than 72 hours per week. (7.13(b)) E. No mechanical work on vehicles will be performed outside the garage. The foregoing restriction shall not be deemed to prevent washing and polishing of any motor vehicle. (7.16) F. Owner shall not allow heavily loaded trucks, moving vans or other vehicles on the streets or driveways to cause damage to those areas. G. No parking shall be allowed in any fire lanes or other restricted areas of the private streets. Vehicles violating this subsection shall be subject to immediate towing without notice. H. Garage doors shall not be allowed to stand open except when used for ingress or egress. Garage doors shall be closed overnight.

12. Storage. No owner or occupant shall allow any bicycles, swimming pools, hot tubs, trampolines, basketball hoops, toys or other items to be left on the landscaping, porches or otherwise on the lot where it may be visible from the street overnight. (Article VII, 7.14) A. Portable basketball hoops may be maintained on the homeowner s driveway from Memorial Day through Labor Day. 13. Clotheslines. No owner shall dry clothes on clothes lines or otherwise hang any blankets or clothing on the exterior of their Lot except on approved retractable clotheslines. Any retractable clothes line may not be left in the extended position for periods longer than eight hours. (Article VII, 7.14) 14. Garbage and Refuse Disposal. No owner or occupant shall allow garbage cans, trash, or other refuse to be placed outside the home or garage, except from 6:00 pm the day prior to trash collection until 6:00 pm on the day of trash collection. All trash and refuse must be placed in a proper receptacle. Owners/occupants are responsible for collecting any refuse blown out of their trash receptacles. (Article VII, 7.15) 15. Common Area. Each owner, the owner's family, guests, contractors, tenants, and invitees may use the Common Area, including the sidewalks, for the purposes intended, subject to the Rules and the directions of the Board of Directors. (Article II, 2.3) A. No owner, guest, family member or tenant shall damage the landscaped areas nor any of the private streets, sidewalks or other Common Area of the Association. (Article II, 2.6) B. All owners and occupants shall notify the Association regarding inoperative light fixtures, drainage problems or other matters regarding the Common Areas. 16. Insurance. The Association's insurance policy does not cover the structure, the contents of a Home, the personal property therein nor any liability to guests or other occupants therein. Each owner or occupant should obtain their own insurance for such matters and liabilities. (Article VIII, 8.4) 17. Guests, Family Members, and Tenants. Each Owner shall be liable for any violations or damage done by that owner's guests, tenants, contractors, invitees, or family members, and each owner shall be subject to fine for any violation of the Association Documents by those persons. Each owner shall make such persons fully aware of the Association Documents and their requirements and shall incorporate the same into any leases and agreements. (Article II, 2.6, Article V, 5.2, Article VII, 7.2, and Article XI, 11.1) 18. Fines and Penalties. The Board may impose such fines as it determines after following the provisions of the Covenant and Rule Enforcement Policy and Procedure. (Article XI, 11.2) 19. Assessments. Any assessment which is not received by the due date shall be subject to a $10.00 per month administration fee. The Association shall have all rights and remedies set forth in the Association Documents and in law and statute. Additionally, the Association may terminate any services, such as trash collection or use of Common Area, to any delinquent Owner and/or Lot, may make deductions from that Owner's and/or Lot's reserve funds. (Article IV, 4.10)
