Please complete this Lease Application. 2. Please prepare two (2) checks as follows: 1) To cover the cost of a background investigation, a check in the amount of $35.00 for each tenant signing the lease (e.g., $70.00 if two persons sign the lease). The check should be payable to Orchid Reserve Condominium Association, Inc., and 2) To cover administrative cost, $50.00 payable to the management company. 3. Please attach a copy of the executed lease agreement to the completed forms. 5. All prospective tenants are required to undergo a National Background check as part of the application. The Association will not approve the lease application if the background check reveals that any prospective tenant has been charged with a felony. ORCHID RESERVE CONDOMINIUM ASSOCIATION, INC. LEASING RULES AND REGULATIONS ******************************************************** The Association has a right of first refusal. Upon receiving an offer to lease, owner must give the Association notice of such offer and the Association has ten (10) days to accept or reject such offer. Lease Term - the term of the lease must be for at least two (2) months. Frequency - The owner/lessor shall enter into no more than two leases of the unit in any calendar year. The starting date of the lease shall determine the calendar year of the lease. No lease will be approved if the owner is not current in payment of all assessments. In the event that the Homeowner (Landlord) defaults with the Association assessments, the COA shall have the right to collect all rental payments due to the Homeowner (Landlord) and apply the same against unpaid assessments and other fees due. Eviction for noncompliance to the above Rules & Regulations will be applied to Tenant, pursuant to Florida Statutes. Two (2) bedroom units shall be occupied by no more than four (4) occupants. Three (3) bedroom units shall be occupied by no more than six (6) occupants. Each unit shall be used as a residence only. No business or profession of any type whatsoever shall be conducted by the tenant(s) if there are business visitors (customers), employees or independent contractors associated with the business or profession. No sub-leasing is allowed. Room rentals are not allowed. All unmarried, non-family members sharing a residence must apply. Guests occupying a unit for 30 days or more must complete and submit an application with fee for approval. The owner must notify the Association within 10 days of any change in the occupants of the leased unit by providing the names of all the occupants effective with the change. The owner/lessor must acknowledge in writing that in the event tenant causes any damage to the common areas of the Association, the owner/lessor shall be liable for all costs to repair damage. If the Association's Declaration, By Laws, or Rules and Regulations are violated, the Board may impose a fine of one hundred dollars ($100.00) for the initial violation and fifty dollars ($50.00) for each additional day the violation continues to a maximum of one thousand dollars ($1,000.00). LEASING RULES AND REGULATIONS (cont) The Rules and Regulations of the community must be read and acknowledged by signature of both the owner and tenant. The tenant must complete the attached forms giving the Association permission to run a background check, and those forms must accompany the application. The Association will not approve the lease if the background check reveals that the applicant has ever been charged with a felony, even if the applicant has not been convicted of the alleged crime. No commercial vehicles of any kind, pickup trucks, other trucks, boats, trailers, RV's, motor homes or motorcycles owned by unit owners, tenants, or guests are permitted to be parked on the property overnight unless parked in the garage. Vehicles may be parked in front of the unit's garage or in the spaces located in the islands or in front of the clubhouse. The area at the end of the driveway just outside the downstairs unit's front door is for turnaround, not for parking. No more than two (2) pets for each unit are allowed. Pet droppings must be picked up and removed from the common areas by the owner of the pet. Any purported lease of a unit in violation of the Association's Documents including the Declaration, By Laws and Rules and Regulations shall be able to be declared void by the Board and the Board is empowered to evict the purported tenant in the name of and at the expense of the unit owner. Failure to comply with any of the regulations stated herein shall result in a fine of one hundred dollars ($100.00) for the initial violation and fifty dollars ($50.00) for each additional day the violation continues to a maximum of one thousand dollars ($1,000). Please be aware that once the lease is approved by ORCOA it will need to be approved by the Ibis POA.
