Overview: The applicant is requesting approval of a conditional use permit (CUP) for a change of use to establish a health or fitness center within the Business District Revitalization Overlay District (BDO). The property is located at 137 S. Bristol Street. The building was originally built for the American Legion and subsequently occupied as an office space by ITS Compliance and Continental Mapping. The applicant is proposing to remodel a portion of the first floor interior office space of the building to accommodate a proposed health and fitness center. The proposed use will occupy approximately 7,500 square feet featuring a fitness and training room with locker rooms. There are no exterior renovations being proposed, however, the windows on the southwest corner of the building will have a decorative film applied to the interior to block visibility of the locker rooms.
Staff Comments: The underlying zoning district for the subject property is Central Commercial, which would require a Special Use Permit for a health or fitness center to locate within an existing building or lease space. Because the property is located within the BDO, the ordinance requires approval of a CUP for change of use. The overall goal for the downtown is to redevelop areas in the downtown to create a vibrant pedestrian oriented urban commercial area with an emphasis on preserving the character of the buildings along Main Street and complementing these businesses with commercial and residential uses on nearby properties. A health or fitness center use is appropriate for downtown and supports the goals of the BDO by enhancing the business mix downtown and promoting a mixed use district to enliven the historic downtown. The applicant is proposing to occupy approximately 7,500 square feet of a roughly 10,533 square foot existing building. Although no on-site parking is required for nonresidential uses in the Central Commercial zoning district, the site does have 50 existing parking stalls. Based on the capacity of the establishment, about 28 parking stalls would be required for this use if located in a different commercial zoning district. A public parking lot and street parking is provided to the north. Conditional Use Review per Section 17.44.050: Conditional uses must be reviewed based on the general standards outlined in the Zoning Code: a. How is the proposed conditional use (the use in general) in harmony with the purposes, goals, objectives, policies and standards of the City of Sun Prairie comprehensive plan, this title, and any other plan, program, or ordinance adopted, or under consideration pursuant to official notice by the City? The proposed conditional is consistent with the City s Comprehensive Plan. Commercial uses are encouraged and permitted downtown. The subject property is located within the Business District Revitalization Overlay District and is consistent with the long-term goals of the City s Business District Revitalization Plan. The Revitalization Plan is a component of the City s Comprehensive Plan. b. How is the proposed conditional use (in its specific location) in harmony with the purposes, goals, objectives, policies and standards of the City of Sun Prairie comprehensive plan, this title, and any other plan, program, or ordinance adopted, or under consideration pursuant to official notice by the City? The conditional use permit allows the reuse of a vacant building downtown. The use of a health and fitness center downtown promotes downtown revitalization and establishing the District with mixed uses and entertainment. c. Does the proposed conditional use, in its proposed location and as depicted on the required site plan, result in a substantial or undue adverse impact on adjacent property, the character of the neighborhood, environmental factors, traffic factors, parking, public improvements, public property or rights-of-way, or other matters effecting the public health, safety or general welfare, either as they now exist or as they may in the future be developed as a result of the implementation of the provisions and policies of this title, the comprehensive plan, or any other plan, program, map, or ordinance adopted or under consideration pursuant to official notice by the City of other governmental agency having jurisdiction to guide growth and development?
The use is not expected to have an adverse impact on the surrounding neighborhood. The applicant is only doing interior remodeling. The existing building exterior and site improvements will not change. d. Does the proposed conditional use maintain the desired consistency of land uses, land use intensities, and land use impacts as related to the environs of the subject property? Indoor commercial entertainment is desirable downtown. e. Is the proposed conditional use located in an area that will be adequately served by, and will not impose an undue burden on, any of the improvements, facilities, utilities or services provided by public agencies serving the subject property? The use can operate with the existing utilities to the site. f. Do the potential public benefits of the proposed conditional use outweigh any and all potential adverse impacts of the proposed conditional use (as identified in subsections a through e above), after taking into consideration any proposal by the petitioner and any requirements recommended by the petitioner to ameliorate such impacts? The benefits appear to outweigh any potential impacts. The proposed CUP for a health and fitness center will benefit the community by providing amenities and services to its downtown residents and employees. Staff Recommendation: Staff recommends conditional approval of the request for a Conditional Use Permit to change the use from office to indoor commercial entertainment to allow a health and fitness center within the Business District Overlay (BDO) located at 137 S.
