The Corporation Of The Township of Stone Mills Notice To Permanently Close And Convey A Municipal Highway In accordance with Section 34 of the Municipal Act R.S.O. 2001 as amended, notice is hereby provided that the Council of the Corporation of the Township of Stone Mills has received a request from an abutting land owner to close and convey a municipal road allowance identified as follows: 1. Part of an un-opened municipal road allowance lying between Lots 18 and 19 in the 3 rd Concession of the Geographic Township of Camden East; and 2. Part of an unopened municipal road allowance between Concession 2 and Concession 3 in Lots 17 and 18 of the Geographic Township of Camden East The lands affected are indicated in the Key Map included with this notice. NCC is proud of this nature reserve and its contribution to the conservation of the endangered Eastern Loggerhead Shrike. The NCC property is currently a release site for captive-raised Eastern Loggerhead Shrike. Dozens of birds have been released at that site to help restore local and provincial populations. NCC properties were chosen because shrikes have used this area on a consistent basis for more than 20 years. NCC is committed to helping sustain and enhance this population of shrikes and their habitat, and is considering further expansion of the nature reserve to help with shrike recovery. NCC is making an offer to purchase 40 acres of the Powell property on Lot 19, Concession 3, immediately east of NCC lands (see attached sketch). These lands have alvar and grassland habitat suitable for shrike habitat restoration. There is an unopened road allowance between NCC property to the west, and the Powell lands. At this time, NCC would like to request that Township staff and Council consider a closure of the road allowance between the NCC and Powell lands, for potential conveyance to NCC. If this closure and conveyance was approved, NCC would submit a request for severance (boundary adjustment) to facilitate the purchase from the Powell family. If the closure and conveyance is not likely to be acceptable to the Township, NCC will work with the Powell family to include access to Nugent Road in our Agreement of Purchase and Sale. NCC would also appreciate your comments on the potential closure and conveyance to NCC of the unopened road allowance along the southern boundary of its existing nature reserve. This additional conveyance would enable NCC to restore and manage additional habitat for Loggerhead Shrike and other significant species. To the best of my knowledge, the proposed closures would not affect legal access to any surrounding properties. I have no problem with the north south road allowance between NCC and the proposed Powell forty acres which is described in the illustration. In fact I never realized that road allowance even existed. It is the east west road allowance at the southerly part of NCC, Powell, Yeomans, Canadian Solar, Yeomans again, McNichols. As well as the six landowners on the opposite side of the same allowance. This road was originally an extension of Martin Drive on the west to County Road 17 on the east. As this is still public property, to have it closed would effect or quite possibly eliminate any future uses. I don't think this is necessary. The Canadian Solar property is not visible on the large color map. It is next to us and we are Lot 20 Con. 3. I think it would be considered Lot 21 Con 3. The south part of Lot 21 Con 3 100 Acres. I am pleased to hear you do not have a problem with closing the north south road allowance. I understand that you have concerns about the east west road allowance, however. That area is not as important to us, and would only be interested in closing that to manage it for bird habitat, and only if people do not object. The Corporation Of The Township of Stone Mills Staff Report Report Date May 11, 2016 Entitled Nature Conservancy of Canada Road Closing Request Recipient Council Submitted By Roger Hogan, Deputy Clerk STAFF RECOMMENDATION BE IT RESOLVED THAT the request submitted by the Nature Conservancy of Canada for the closing of specific portions of municipal road allowance be approved subject to the following: 1. That the applicant provide signed acknowledgement that all costs incurred by the Township shall be the responsibility of the applicant; 2. That the lands to be closed and conveyed shall be identified on a reference plan prepared by an Ontario Land Surveyor; 3. That a portion of the road allowance between Concession 2 and Concession 3 and lying adjacent to County Road 27 shall be conveyed to the County of Lennox and Addington for road widening purposes; 4. That all road allowances to be closed will be authorized by Bylaw to be considered by Council following the completion of the reference plan. OVERVIEW The purpose of this report is to make Council aware of steps taken by Staff to provide for the closing and conveyance of certain municipal road allowances. BACKGROUND 1. Following Council s approval in principle to this request, a notice was developed providing notice to persons of the proposed closing and conveyance of certain municipal road allowances as requested by the Nature Conservancy of Canada. 2. This notice was circulated to all property owners bordered by Nugent Road in the North, County Road 17 in the South and County Road 27 in the West 3. This notice was also circulated to the appropriate department heads, County of Lennox and Addington, KFLA Public Health and Quinte CA, Ontario Hydro, Bell Canada. 4. Comments arising from this circulation are attached to this report. 5. Additionally, a representative of Hydro One was into the office and obtained information to conduct a site inspection of the proposal. No comments have been received from Hydro One at the time of this report. Page 14 of 15

6. Two telephone inquiries were received from residents respecting the proposal and these were addressed to their satisfaction.
