ALLEY DEPUTY DIRECTOR Property Acquisition 001/17 Executive Summary Applicant: City of New Orleans Department of Property Management Consideration: A request to consider the acquisition (via donation) of a portion of Lot BT, Square 488-A, First Municipal District, bounded by Earhart Boulevard, and South Roman, South Galvez, and Erato Streets. The municipal address is 1201 South Roman Street. Summary of Proposal: Master Plan: Lot BT measures 302.80 feet in width at its Earhart Boulevard frontage, 302.74 in width at its Erato Street frontage, 627.61 feet at its South Roman Street frontage, and a depth of 633.61 at its South Galvez Street side property line. The Department Property Management seeks to acquire a portion of Lot BT through a donation from the Orleans Parish School Board. This portion of property is nearest Erato Street, and measure 302.74 feet along Erato Street and a depth of 17.38 feet, and comprises portion of land that is currently dedicated as a servitude in the favor of the City of New Orleans. This portion of the subject property contains a part of the street and area where a sidewalk would normally be located. The portion of Lot BT proposed to be acquired by the City is part of a full reconstruction planned for the Erato Street right-of-way between South Claiborne Avenue and South Prieur Street. The scope of this improvement includes the repair of sewerage, water, and drainage lines, a complete rebuild of the street, and the repair of the sidewalks and curbs. The project is currently listed in the 2018-2022 Capital Improvement Plan as a Recovery Roads project under the Department of Public Works. The proposal meets the criteria of the City Planning Commission Administrative Rules, Policies, and Procedures for a property acquisition, and thus, the staff recommends approval of the request. The recommended changes are compatible with the Master Plan.

Recommendation: The staff recommends APPROVAL of the proposed property acquisition. Reasons for Recommendation: 1. The property is needed for public purposes. 2. The proposed use is compliant with the adopted 2018 2022 Capital Improvement Plan. 3. City Planning Commission Meeting Tuesday, October 24, 2017 To: City Planning Commission Date: October 26, 2017 STAFF REPORT Prepared By: Larry W. Massey, Jr. Council District: B Property Acquisition: 001/17 Consideration: Applicant: Purpose: A request to consider the acquisition (via donation) of a portion of Lot BT, Square 488-A, First Municipal District, bounded by Earhart Boulevard, and South Roman, South Galvez, and Erato Streets. The municipal address is 1201 South Roman Street. City of New Orleans Department of Property Management In accordance with Section 6-302 subsection 3 of the City Charter, [n]o immovable property shall be acquired by the City without the approval of the City Planning Commission as to its use[.] Therefore, The City Planning Commission shall consider the acquisition of the immovable property by the City of New Orleans to complete this portion of the Erato Street right-of-way. Analysis: The criteria for the evaluation are as follows: 1. Appropriateness of current zoning and compliance with the Master Plan: The portion of the property the City is requesting to acquire would be incorporated into the Erato Street right-of-way, and thus not subject to the standards of the Comprehensive Zoning Ordinance. The remainder of Lot BT is currently being redeveloped into a secondary educational facility, which is listed as a conditional use in the HU-RM1 Historic Urban Multi-Family Residential District. There is no conditional use approval for the site, but the permitting for the redeveloped school was approved under the former CZO under the following provision: Article 13, Section 13.10.1(4) of the former CZO Expansion of Certain Uses. Renovation or reuse for a public school purpose of an existing school facilitiy that has not been approved previously through the conditional use procedure shall be allowed outright, notwithstanding any nonconforming status or period of vacancy, provided that the type of school is not changed to a higher grade grouping school. Any expansion permitted under PA 001/17 3

subsection 3, or change in use to a higher grade grouping, shall require a conditional use permit under Section 16.6. Additionally, the property owner secured a number of variances and design review approval for the proposed school building. In the Plan for the 21st Century, commonly known as the Master Plan, the subject property is designated Residential Medium Density Pre-War on the Future Land Use Map for Planning District 4. The goal, range of uses and development character for this designation are copied below: RESIDENTIAL MEDIUM DENSITY PRE-WAR Goal: Preserve the character and scale of pre-war (WWII) residential areas that currently have a variety of housing types and sizes and allow for compatible infill development. Range of Uses: Single- and two-family residences, townhomes and small multifamily structures. Businesses and traditional corner stores may be allowed where current or former commercial use is verified. Supporting public recreational and community facilities allowed (e.g., schools and places of worship) Development Character: New development will conform to the general character and scale of surrounding neighborhoods. These areas are primarily located along major roadways, often with bus or streetcar service existing or planned-that can support higher densities. Allow the adaptive reuse of historic non-residential structures with densities higher than the surrounding neighborhood through the planned development process. Allow higher residential densities when a project is providing significant public benefits such as long-term affordable housing. Incorporate risk reduction and adaptation strategies in the built environment. The proposed use of the property that the City requests to acquire is not in conflict with the goals and policies of the Master Plan. This portion of property is planned to be used as Erato Street right-of-way, and will not be developed with a structure containing a use. 2. General Property Description: Lot BT measures 302.80 feet in width at its Earhart Boulevard frontage, 302.74 in width at its Erato Street frontage, 627.61 feet at its South Roman Street frontage, and a depth of 633.61 at its South Galvez Street side property line. The site contains an area of 190,192 square feet (4.4 acres), and is the site of Booker T. Washington High School. Nearly all of the original school has been demolished, with the exception of the entryway and auditorium, which are being integrated into the new school building currently under construction. The City acquired similar portions of right-of-way in the 3300 block of Erato Street in 1940, but did not do so for the 3200 block. This acquisition would secure for the City this part of Erato Street in order to complete the right-of-way with consistent widths on this block. Figure 2. Advice of the City Planning Commission s Planning Advisory Committee: The Planning Advisory Committee considered this matter on September 6, 2017. The committee passed a motion of no objection subject to further review by City Planning Commission and Real Estate and Records. PA 001/17 5

4. Potential future use of property: The proposed land acquisition will be utilized as a portion of the Erato Street rightof-way. This portion is planned to be fully reconstructed in 2019, as detailed in the Capital Improvement Plan section of this report. The part of Erato Street proposed in this acquisition will contain a sidewalk and portion of the roadway. 5. Historical Significance of the Land Area: The subject property is not located within a local or national historical district and there are no locally-designated landmarks within the site. The original Booker T. Washington school building was listed on the National Register of Historic Places in 2002 due to its significant contributions to the surrounding community. The school building sustained substantial damage from Hurricane Katrina and remained unused in the years following. The OPSB is now moving forward with a redevelopment plan that includes the demolition of the entire original school with the exception of the auditorium and entryway on South Roman Street. Figure 3. Washington High School In 2011, the site was de-listed from the National Register because the National Parks Service determined that the significance of the site has been eliminated due to the redevelopment plans: The milestone school in the development of secondary public school education for African-Americans in New Orleans is no longer extant and the auditorium, which at the time was the only large venue for African American events in the neighborhood, no longer has the connection, both architectural and functional, that it once had with the school With the loss of the school (and other PA 001/17 6

contributing buildings on the site), this connection is lost as is the integrity of materials, design, setting, feeling, and association. 6. Compliance with the Capital Improvement Plan: The portion of Lot BT proposed to be acquired by the City is part of a full reconstruction planned for the Erato Street right-of-way between South Claiborne Avenue and South Prieur Street. The scope of this improvement includes the repair of sewerage, water, and drainage lines, a complete rebuild of the street, and the repair of the sidewalks and curbs. The project is currently listed in the 2018-2022 Capital Improvement Plan as a Recovery Roads project under the Department of Public Works. This project is a part of the larger BW Cooper, Gert Town, Dixon Group C (RR016) of the City of New Orleans Capital Program. The full reconstruction is expected to be funded entirely by FEMA funds, and will begin in late 2019 and be completed by the end of 2020 7. Any other applicable CPC policies or special studies of the area: Article 3, Section 3.1.2 of the City s Subdivision Regulations require that the creation of more than 5 lots, and/or any subdivision proposing creation or closure of a street must be reviewed and approved as a major subdivision. If this portion of Lot BT is acquired by the City to complete the Erato Street right-of-way, this portion of a lot will then turn into a portion of street, triggering the requirement for a major subdivision. The staff recommends the following proviso: The property owners shall apply for a subdivision to separate the acquired portion of property from Lot BT and into the Erato Street right-of-way. Conclusion and Recommendation: The property has been determined to be necessary to complete the right-of-way along the 3200 block of Erato Street. Based on the above criteria, the staff recommends APPROVAL of Property Acquisition 001/17, subject to the following proviso: 1. The property owners shall apply for a subdivision to separate the acquired portion of property from Lot BT and into the Erato Street right-of-way. Reasons for Recommendation: 1. The property is needed for public purposes. 2. The proposed use is compliant with the adopted 2018 2022 Capital Improvement Plan. PA 001/17 7

3. The proposal meets the criteria of the City Planning Commission Administrative Rules, Policies, and Procedures for a property acquisition. CITY PLANNING COMMISSION MEETING (October 24, 2017) The staff summarized the request, stating the staff s recommendation of approval. No one spoke in support or opposition to the request. Commissioner Brown made a motion for APPROVAL as recommended by the staff, which was seconded by Commissioner Stewart and adopted. Motion BE IT MOVED BY THE CITY PLANNING COMMISSION THAT PROPERTY ACQUISITION 001/17 IS HEREBY RECOMMENDED FOR APPROVAL SUBJECT TO ONE (1) PROVISO. BE IT FURTHER MOVED THAT THE EXECUTIVE DIRECTOR IS HEREBY AUTHORIZED TO NOTIFY THE CITY COUNCIL OF SAID ACTION.
