Public Hearing January 0, 208 PUBLISH: December 2, 207 Brennan Kane said the purpose of the Public Hearing is for a Special Use Permit is to allow a Brewery/Tap Room to be located at 804 Churchill Street in the former Family Center building. Justin Berrens asked for testimony in favor of the subject and limit comments to 3 minutes or less. Mike Stroik, 2540 Powdered Road, Hartford, WI provided a current copy of the plan they are proposing for the Brewery/Tap Room. He said they have spent the better part of a year looking for the perfect site in the City of Waupaca for placement of their Brewery. He added that he and his partner would be brewing beer for sale through the Tap Room with very limited food sales. Mr. Stroik described the layout of the building with their proposed plans. The current owners are requesting annexation in order to obtain City sewer and water service to the property needed for facility development. Staff Analysis. The property is contiguous to the City of Waupaca. 2. The Waupaca Chain O Lakes Sewer Service Area was amended in 205 in anticipation of the development of this land. City sewer and water utilities are available along County Road A. No deferred assessments exist with regards to this property. 3. The property is tax exempt therefore the City will not be paying the Town of Lind the typical annual tax multiplied by 5 years. 4. Staff has filed required annexations forms with the State and is awaiting approval. There are no anticipated issues with approval from the State. 5. The Plan Commission is directed to set a permanent zoning classification and regulations for zoning within one year of passage of the Ordinance. 6. As part of the overall development of the project, Waupaca County will be required to extend municipal utilities (sewer & Water) at their expense. City ordinance require a lot to be fully improved at the time of development. Representatives of Waupaca County have expressed concern over the cost and long-term development plans surrounding their parcel. Therefore, the City of Waupaca has preliminary accepted a proposal to only extend utilities to the construction limits of the S. Main Street Waupaca, WI 5498
City of WAUPACA Community & Economic Development Department project. However, if future development occurs south of the current property limits, Waupaca County shall be required to extend the utilities to their property limits at their expense. RECOMMENDATION Staff recommends approval of the Annexation subject to the following conditions:. Prior to issuance of any city permits (i.e. site plan approval, building, foundation, grading, underground work) Waupaca County shall prepare and execute a Memorandum of Understanding (MOU) identify Waupaca County s financial requirements and responsibilities to extend City municipal sewer and water to their southern property limits (at their expense) in the event development occurs south of their property in the future. In accordance with Chapter 7.27 of the City of Waupaca Municipal Code and upon recommendation of the Plan Commission, the territory annexed to the City of Waupaca by this Ordinance, is temporarily designated to be part of the following district of the City of Waupaca for zoning purposes and subject to all provisions of the zoning code of the City of Waupaca relating to such district classifications and to zoning in the City: Section 7.20 of the City of Waupaca Municipal Code - "Agricultural District The Plan Commission is directed to prepare an amendment to the zoning ordinance setting forth permanent zoning classifications and regulations for the zoning of the annexed area and to submit its recommendations to the Common Council within one () year of the passage of this Ordinance. SECTION 4. Ward Designation. The territory described in Section of this Ordinance is hereby made a part of the Second Aldermanic District (Ward 3) of the City of Waupaca, subject to the ordinances, rules and regulations of the City governing wards. SECTION 5. Schools. The territory described in Section is annexed for school purposes and is hereby made part of the Waupaca School District and subject to all laws governing the same. SECTION 6. Severability. If any provision of this Ordinance is invalid or unconstitutional, or if the application of this Ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid or unconstitutional provision or application. SECTION 7. Effective Date. This Ordinance shall take effect upon passage and publication as provided by law.
