FORM 100 - PURCHASE ORDER & FEDERAL DISCLOSURE STATEMENT. Purchase contract for new or used Manufactured homes. FORM 100A PURCHASE ORDER & FEDERAL DISCLOSURE STMT/ADDENDUM One page, letter size, 3-part NCR form. Additional space for itemizing accessories and costs. FORM 101 - PURCHASE AGREEMENT RESALE (Offer & Acceptance) Two-page, legal size, 3-part NCR form. Buyers complete this form as an offer to buy a used Mobile/Manufactured Home. Salesperson fills in commission information and presents offer to seller for acceptance of offer. When signed by Seller and Buyer, it is acceptable as a valid contract subject to the contingencies contained therein. FORM 103 MANUFACTURED HOME PURCHASE ORDER. Purchase contract for new or used Manufactured homes. FORM 104 - ADDENDUM HOME ON LAND. This addendum is used when the M/H will be located on private land rather than in a mobile home community. It provides for such things as utilities and simple land development. FORM 105/106 - COUNTER OFFER #105 is a. #106 is a. Seller completes this counter offer with terms that are acceptable after receiving an offer that is not acceptable. FORM 107 - PURCHASE AGREEMENT PULL OUT. Used for the purchase of a manufactured home to be pulled out by a dealer. FORM 108 - INSTALLATION DISCLOSURE One-page, letter size, 2-part NCR form. Explains installation requirements on new manufactured homes, effective October 2008. HCD required on new homes only. FORM 109 - DISPUTE RESOLUTION. Describes the process used when neither the dealer nor manufacturer accepts responsibility for a problem on homes produced after February 8, 2008. This form explains Health & Safety Code sections 18060.5(d) and 18151 and satisfies Section 3288.5 - Retailer Notification at Sale. HCD required on new homes. 3
FORM 110 - RECEIPT FOR DEPOSIT Used for both new and used Mobile/Manufactured homes. A Blue Part consisting of 2 pages, is attached to the back containing exact reprinted laws regarding sales, escrow & warranty laws, which is to be given to the buyer at time purchase agreement is signed. FORM 120 - TRANSFER DISCLOSURE STATEMENT Two-page, legal size, 3-part NCR form Seller completes the first part with any information about the Mobile Home that would affect its value and desirability to a prospective buyer. The listing agent and the selling agent complete sections with the results of their visual inspection. FORM 121 ADDENDUM TO PURCHASE AGREEMENT - WARRANTY DISCLOSURE. This form is designed for AS-IS sales of used manufactured homes that have been listed by a dealer. Cannot be used for sale of a Mobile/Manufactured Home owned by a dealer. FORM 123 NET LISTING DISCLOSURE Given to a seller at least 48-hours prior to close of escrow for a net listed home. Advises exact amount of buyer s offer and specific amount of any commission. FORM 124 ADDENDUM AGENCY DISCLOSURE Used by agents to advise buyers and sellers that they are buyer s agent, seller s agent or dual agents and explains agents obligations for each circumstance. FORM 125 NATURAL HAZARD DISCLOSURE Seller completes this form advising the buyer regarding the following possible natural hazards: special flood hazard, an area of potential flooding, very high fire hazard severity zone, wild-land area that may contain substantial forest fire risks and hazards, earthquake hazard zone and seismic zone. FORM 127 ADDENDUM TO PURCHASE AGREEMENT DISPUTE RESOLUTION This addendum provides for mediation of any dispute. It also provides for optional binding arbitration if initialed by buyer and seller. This form is for a dispute between a buyer and seller. It does NOT explain Health & Safety Code sections 18060.5(d) and 18151 or satisfy Section 3288.5 Retailer Notification at Sale. FORM 128 ADDENDUM TO PURCHASE AGREEMENT (General) This form is used for changes to the original contract by mutual agreement of buyer and seller. HCD does not allow this form on new homes; a new purchase contract must be completed. FORM 129 ADDENDUM TO LISTING AGREEMENT (General) One-page, letter size, 2-part NCR form Used for changes or cancellation of a listing agreement. FORM 130 ADDENDUM SALE OF BUYER S PROPERTY This form provides a contingency to a purchase contract that requires the sale of the buyer s present home. Seller to continue to show property and if another offer is received, the buyer will be notified that the contingency must be removed within 72 hours or the contract will be cancelled. FORM 132 ADDENDUM NOTICE TO REMOVE AND WAIVE CONTINGENCY. This form is used to notify buyer that they must remove and waive contingency within 72 hours as described in Form 130 or their contract to buy is cancelled. FORM 134 DECLARATION OF DELIVERY SALE AND WARRANTY EXPIRATION This form is required for sale of a manufactured home on a permanent foundation when the purchaser is responsible for the installation. Clarifies expiration of manufacturer s warranty in this situation. FORM 139 LISTING AGREEMENT (Suggested Listing 180 Days) Exclusive authorization and right to sell listing agreement with a suggested listing of 180 days. Compensation options for percentage, flat fee or net listing with net listing addendum requirements. FORM 140 MHMLS STANDARD LISTING FORM Listing Agreement arranged per the MHMLS requirements, including compensation options for percentage, flat fee or net listing with net listing addendum requirements. FORM 141 EXCLUSIVE AUTHORIZATION AND RIGHT TO SELL Listing agreement that provides for compensation as either a percentage, flat fee or net listing and net listing addendum requirements. 5
