DAS-2013-0034 FOR CONSIDERATION OF COMMITTEE OF THE WHOLE OF AUGUST 26, 2013 SUBJECT: UNSOLD 2011 TAX SALE LAND VESTED IN THE NAME OF THE CORPORATION OF THE TOWN OF GEORGINA. RECOMMENDATION: 1. 140 Page 2 of Report DAS-2013-0034 PURPOSE: The purpose of this report is to request that Council authorize the Treasurer to dispose of eight (8) unsold tax sale properties offered by Public Tender on November 24, 2011, pursuant to the Municipal Act and the Municipal Tax Sales Rules made under the Act. REPORT: On March 5, 2012, Report No. DAS-2012-0013 "Unsold Tax Sale Land Previously Offered By Public Tender in November 2011" was presented to Council detailing various options and recommendations available to Council regarding eight (8) unsold properties. Council authorized staff to conduct Phase 1 environmental assessments on each of the properties and subject to acceptable findings, proceed to vest the properties in the name of the Town. Council also requested staff review each property individually to confirm how title of each of the subject properties was created, confirm the zoning of each property, the availability of a building permit and identify properties abutting a property owned by another government or like agency. Staff advise that Phase 1 environmental assessments have been completed on all eight (8) properties. The results of the environmental assessments are as follows for each of the properties. No environmental issues with respect to Federal, Provincial or private agencies and their respective jurisdictions were found. There are no structures or site developments at the subject sites. No buried debris or rubble, or indications of historical developments was evident at the sites. There were no noted adverse environmental impacts associated with the sites or the adjacent properties respectively. An abandoned drilled well was located on one property. Staff confirm the drilled well has subsequently been decommissioned by the Town for health and safety reasons. As the Phase 1 environmental assessment results indicated no environmental issues, no further Phase II Environmental Assessments, nor Phase II or Ill Intrusive Site Investigations, were warranted for the subject properties with respect to environmental issues. As a result, staff proceeded to vest each property in the name of the Town of Georgina and these properties may be subsequently sold or disposed of by the Town.
.. 141 Page 3 of Report DAS-2013-0034 As advised in Report No. DAS-2012-0013, Administrative Services staff requested each Town Department/Division provide comment if there were any potential current or future municipal uses. No comments were received advising of any potential municipal uses for any of the eight (8) properties vested. Appendix "A" attached has been prepared indicating individual property information, sale/transfer recommendations and information requested by Council as a result of Report DAS-2012-0013. Aerial maps indicating abutting ownerships have also been included for each property. ANALYSIS: These properties may now be offered to abutting property owners and/or sold without the restrictions of minimum bids as that required with the tax sale process returning some properties to a taxable status to generate tax revenue. FINANCIAL IMPLICATIONS: I I I I I I Costs involved in the sale/transfer of the properties will include advertising and involve primarily staff time to contact abutting property owners for interest in the properties and tender production/processes. Legal services will be managed by the Town Solicitor's office for the preparation and execution of transfer/sale documents. CONCLUSION: This report provides information to Council regarding various recommendations associated with disposing of unsold properties from the sale of land by public tender held by the Treasurer on November 24, 2011 for the purposes of recovering outstanding property tax arrears and related costs.
