NAR and US Copyright Office decisions, click through agreement in Paragon Many of you have received emails from NAR discussing the ongoing copyright issue with the US Copyright office. The law firm that represents IRMLS has and does file a quarterly copyright application on behalf of the IRMLS MLS system/database. As you re aware, the U.S. Copyright Office is changing its stance with regard to copyright registrations for automated databases like MLS s. To provide even basic copyright protection for the MLS database in the future, IRMLS will need to take the steps recommended by NAR and legal counsel. The first step that will be implemented is a one time click through agreement when logging into Paragon to protect the IRMLS copyright filing. This step will make an acknowledgement on behalf of IRMLS that anyone using the system s listing input or maintenance function agrees that the choices they make in the database are a work made for hire on the MLS s behalf. IRMLS will place the notice for each user when they login to the system to click YES and Agree. The statement is written by the attorney and the language is such to meet the requirements to maintain the copyright for the data as negotiated by NAR with the US Copyright office. Once each user clicks agree, it will no longer appear and IRMLS will track the information as requested by legal counsel to maintain the copyright protection. Below is a copy of the statement prepared by the IRMLS attorneys that will be displayed for user to acknowledge. Selection, coordination, and arrangement as work for hire This click-through changes your legal rights. Consult a lawyer if you have questions. When you put listing and related information into the Indiana Regional Multiple Listing Service LLC (IRMLS) System you choose, classify, categorize, order, and group material or data. In copyright-law terms, you are selecting, coordinating, and arranging this information, and these acts are components of a compilation copyright. Pursuant to IRMLS s policies, IRMLS owns the compilation copyright in the IRMLS databases. Consequently, as a condition of accessing the IRMLS System, you must agree that your provision of selection, coordination, and arrangement to the IRMLS System is a work made for hire under the Copyright Act of 1976. Your agreement that selection, coordination, and arrangement is a work for hire does not change ownership of the original text (like public remarks), photographs, or videos that you create for your listings. By proceeding I AGREE and assert that the selection, coordination, and arrangement I contribute to IRMLS s database compilation is a work made for hire on behalf of IRMLS and that IRMLS is author of those works for purposes of copyright. If, I DO NOT AGREE that the selection, coordination, and arrangement I contribute to be a work made for hire, I understand I will not be permitted further access to the IRMLS System.
