DEVELOPMENT PERMIT APPLICATION REQUIREMENTS FOR OPERATING A BED AND BREAKFAST 1. Application for a new Development Permit and a fee of $500.00 for a one year approval (to be renewed by November 1 of each year or in accordance with any previously issued permits). 2. Application for renewal Development Permit and a fee of $200.00 for a threeyear approval (to be renewed by November 1 of the third year). 3. Certificate of Title. 4. A surveyed site plan indicating: 1) Parking a. showing where on the property parking is to be located (1 stall per rented room plus a minimum of 2 stalls per dwelling unit). Parking stalls to measure (8'x20'). Guest parking shall not be tandem. Tandem parking is permitted for resident vehicles. b. Parking to be hard surfaced i.e.: Turfstones, flagstones, paving stones, asphalt, etc. 2) Landscaping a. Shall provide a minimum of 50% of front yard to be landscaped. 5. Letter and floor plans identifying how many and which rooms are to be rented out. Also indicate room and window sizes, window location, smoke detector and fire extinguisher locations. 6. As part of the application process a site inspection is conducted at which time, a form from the Alberta Health Services will be provided. You are then to contact the health inspector at 403 678 5656. ALBERTA BUILDING CODE AND FIRE CODE REQUIREMENTS 1. Sleeping facilities for a maximum of eight persons plus the dwelling owner and family. No cooking facilities to be available in sleeping rooms or suites. (9.10.9.14) Alberta Building Code. Note: once there is more than 10 sleeping, including owner and family, a fire alarm system is required. (9.10.17.2) Alberta Building Code. 2. Unless a bedroom has a door that leads directly to the building exterior, or the basement is sprinklered, each bedroom must have at least one window that can be opened from the inside without the use of tools or technical knowledge. This window must provide an unobstructed opening with a minimum area of 0.35 m² (3.77 ft² or 543 square inches), and no dimension less than 380 mm (15 inches). Where a window opens into a window well, a clearance of at least 550 mm is to be provided in front of the window. Where the sash swings towards the window well, the operation of the sash is not to reduce the clearance in a manner that would restrict escape in an emergency. (9.7.1.3.) Alberta Building Code. 3. Smoke Alarms installed by permanent connections to an electrical circuit without disconnect switch between each sleeping area and the remainder of the
dwelling. When more than one smoke alarm is necessary all smoke alarms are to be wired so that activation of one alarm will cause alarms to sound. (9.10.18.1. 9.10.18.5) Alberta Building Code. 4. One 5 lb (2 A 10 BC) portable fire extinguisher, located on each floor level. (2.11.2.1) Alberta Fire Code. 5. An emergency escape plan is recommended for the occupants of the dwelling unit and is to be prepared by the owner and it is to be an ongoing procedure that all guests are informed of the plan. 6. During the inspection a general overview of the dwelling should be made with regard to possible safety conditions. Examples might be structural, stairs guards, heating system, etc. (1.2.6.1) Alberta Building Code 1997. TOWN OF CANMORE LAND USE BYLAW 22 2010 BED AND BREAKFAST BED AND BREAKFAST ACCOMMODATION a) bed and breakfast accommodation means an ancillary commercial use operated by the resident of a single detached dwelling, providing accommodation for periods of 14 days or less with one meal provided on a daily basis to guests. b) A business registry license must be obtained for all Bed and Breakfast operations in accordance with the Canmore Business Registry Bylaw. c) the maximum amount of accommodation shall be 2 guestrooms or 6 pillows (guests); whichever is less, per principal dwelling. d) bed and Breakfast operations shall be limited to a maximum of 5% of the total number of occupied single family residences within the applicable Town of Canmore census districts as identified in the most recent municipal census. In addition, the following separation distances apply for new Bed and Breakfast operations: (i) not less than 4 lots separating the proposed B & B from any other B & B on the same side of the street as the proposed B & B, and; (ii) the nearest existing B & B operation across a street or lane from the proposed B & B is not less than 3 lots from the proposed B & B as measured from a perpendicular line from the midpoint of the front and rear of the lot for which the B & B is proposed. e) bed and breakfast accommodations require a development permit. A permit may be revoked at any time if, in the opinion of a Development Officer, the operator has violated any provision of this Bylaw or the conditions of a permit. f) bed and breakfast accommodations shall not interfere with the rights of other residents to quiet enjoyment of a residential neighborhood. g) bed and breakfast accommodations shall be an incidental and subordinate use to the principal residential use and shall be contained within the principal building.
h) initial permits are valid for a maximum of 1 year. Subsequent permits for an approved site may be issued for a period of up to three (3) years to an operator with a valid development permit at the time application is made (i.e. prior to the expiry of an existing development permit). i) bed and breakfast accommodations that have an approved development permit and are existing on the date of approval of this bylaw shall be deemed to be a discretionary use within that district and further development permits may be issued on a continuing basis with the same conditions as those attached to the previous permit. Such renewal of permits shall require the granting of a variance or variances for the new permit if the conditions of the previous permit do not meet the requirements of this Bylaw. However, if that use is discontinued for a period of 6 consecutive months or more, or the permit has been revoked, any future bed and breakfast accommodation shall conform with the regulations of this bylaw. j) the Development Officer acting reasonably may inspect the Bed and Breakfast accommodation to ensure compliance with this bylaw and the development permit. k) the operator of the Bed & Breakfast shall: not advertise the bed and breakfast accommodation unless in possession of a valid development permit at the time the advertisement is placed submit and sign a statutory declaration stating that he/she is the principal resident of the principal dwelling ensure that guest bedrooms contain no cooking or food preparation facilities ensure that access to guest bedrooms is gained through the principal dwelling unit and not solely through a separate private entrance provide hard surfaced, on site parking and driveway areas for guests as required by this bylaw. Parking shall not be tandem and may be surfaced with materials such as "turfstone", or flagstone, but not gravel, except where access to the parking is from a gravel laneway only. provide natural landscaping over a minimum of 50% of the front yard area provide a sign which conforms to the signage guidelines as outlined in Section 10, Signage Regulations, that is visible day and night and is located in the front yard of the site for the purpose of providing identification for guests not display any form of advertising related to the bed and breakfast accommodations except as provided for in this bylaw ensure that the building conforms to the Alberta Building Code
