The third edition introduced the Option Module (With Employer s Architectural Design) to allow developers to retain control over the architectural design. While such a Partial Design and Build Model has proved to be popular with developers, contract administrators and other stakeholders ought to be cognisant of the legal and contractual issues that could arise. Hence, in this seminar, the speaker will share the legal and practical ramifications of such a Partial Design and Build model as well as the pitfalls to be avoided. Particular focus will be given to aspects commonly encountered in practice, namely design scope and liability, variations, named / nominated sub-contractor and extension of time claims.
Lee Keng Seng is a Director (Quantity Surveying) at Surbana Jurong Consultant Pte Ltd and a member of Singapore Institute of Surveyors and Valuers. He holds a Bachelor of Science (Building), NUS, Graduate Diploma in Business Administration, SIM and also a Master degree in Construction Economics and Management from University College London, United Kingdom. As a practitioner, Keng Seng has over 25 years experience, in various roles and capacities for developers, consultants and contractor, in the areas of cost and contracts management for development and construction projects of different types, size and complexities. He leads and supervises QS teams in the provision of multi-disciplinary design and QS consultancy services. In addition, he has also undertaken and been responsible for various roles in feasibility studies, design management, procurement management, project management and facilities management for projects of different nature and scale. Keng Seng has also worked on overseas projects where he had stints in India and Vietnam and is currently involved in projects in Myanmar and Indonesia. Raymond Chan is a Partner of Chan Neo LLP, and has practised in the area of Building and Construction Law for over 30 years. He was the Past President of the Singapore Institute of Arbitrators and is a Fellow of the Singapore Institute of Arbitrators and the Chartered Institute of Arbitrators. He is a member of the Panel of Arbitrators of the Singapore International Arbitration Centre, the Kuala Lumpur Regional Arbitration Centre and the Arbitration Panel of the National Electricity Market of Singapore. He has been appointed as an Arbitrator in numerous local and international Arbitrations. He is also an Accredited Adjudicator with the Singapore Mediation Centre He is the Honorary Legal Advisor to the Singapore Real Estate Developers Association ( REDAS ), the Singapore Institute of Architects ( SIA ) and the Singapore Institute of Surveyors and Valuers ( SISV ). He acts regularly for property developers, contractors and design consultants and has represented them as Counsel in the High Court as well as in domestic and international arbitrations. He is a frequent speaker in construction and arbitration related topics in both local and international conferences and is the author of many articles on these subjects. He drafted the SIA Arbitration Rules, the SIA Mediation Rules and the Arbitration Rules of the National Energy Market of Singapore. He was involved in the drafting of the Singapore Institute of Architects Conditions of Main, the SIA Conditions of Sub, the REDAS Design & Build Conditions of and the REDAS Design & Build Conditions of Sub-. He co-authored the textbooks Construction Law in Singapore and Malaysia (2 nd Standard Form of Building An annotation both published by Butterworths. Edition) and The Singapore Raymond is listed in the 2004-2016 Editions of the International WHO S WHO of Construction Lawyers as a Leading Construction Lawyer in Singapore.
Christopher Chuah heads the Infrastructure, Construction & Engineering Practice and is a Partner in the China and Myanmar Practices. His main areas of practice encompass both front-end drafting/advice and construction disputes (including FIDIC standards), both litigation and arbitration. He is a leading light in the field of building and construction law and has authored various books on this subject. He is one of the General Editors of the Singapore Construction Adjudication Review. Christopher is a legal adviser to the Singapore ors Association Limited ("SCAL"), as well as a member of the Committee for International Construction and Building s. He is a Fellow of the Singapore Institute of Arbitrators and Chartered Institute of Arbitrators, as well as the Chartered Institute of Building. He has also been appointed to the Singapore International Arbitration Centre's Main Panel of Arbitrators and is also on the Panel of Arbitrators of the Kuala Lumpur Regional Centre for Arbitration (KLRCA). Christopher is an accredited adjudicator under the Building & Construction Industry Security of Payment Act (Cap 30B), who is part of the first group of such appointments. He is a member of the Construction Adjudicator Accreditation Committee which was formed by the Singapore Mediation Centre to assist with the training and accreditation of adjudicators. Christopher co-authored the Administration Guide to the REDAS Design and Build Conditions of published by LexisNexis in 2012. He also led the authorship effort behind the Annotated Guide to the Building and Construction Industry Security of Payment Act 2004 and Annotated Guide to the Building Maintenance and Strata Management Act 2004 published by Sweet & Maxwell, and drafted the standard form domestic subcontract and supply of goods published by SCAL. He is the co-author of the or's Working Manual on Public Sector Standard Conditions of for Construction Works, published by SCAL, as well as the Public Sector Standard Conditions of for Design and Build A Commentary and Standard Form of Sub-s An Annotation published by LexisNexis. He also drafted the Conditions of Appointment for Consultants in Design and Build Projects published by SCAL. Christopher is an Adjunct Associate Professor in construction law at the Law Faculty of the National University of Singapore.
