Tenants Additional Rent obligations in the first Lease Year shall not exceed the following: $2.50 PSF for Operating Expenses, exclusive of any snow and ice removal in excess of $0.75 PSF; $5.00 PSF for Property Taxes; and $0.30 PSF for Landlord s Insurance. In addition, Tenant s Additional Rent attributable to Operating Expenses shall never exceed 105% over the previous year, excluding snow/ice removal, utilities and trash removal. Landlord s maintenance obligations shall include the following: (i) structural repairs; (ii) roof repairs and replacement; (ii) maintain the outside walls of the Premises, excluding Tenant s signage, window glass, plate glass and doors; (iii) keeping in good order, condition and repair the down spouts and gutters of the Premises; and (iv) maintain all utility lines to point of entry to the Premises and underground plumbing. Tenant shall at all times maintain the non-structural elements, but excluding the exterior, at its sole cost and expense, in good condition and repair. Tenant shall keep the HVAC system in good condition and repair and shall service the HVAC system on a quarterly basis.
