Special note for post- qualification The tender documents are of two separate bids i.e. technical and price bids. You are requested to submit the technical bid with the following credentials for post-qualification 1. EMD: To pay EMD as described in the tender notice/annexure I. 2. Tender Fee: The tender fee shall be accompanied in the form of DD as described in the tender notice 3. Tender copy duly signed and sealed on each and every page shall be submitted. Instructions to the bidders 1. The tender should be submitted in Single sealed Envelope marked MAIN COVER given with tender. Tender number name of work should be written in the given space. The main envelope will contain two separate sealed covers as under: Technical bid cover This cover shall contain all relevant attested qualifying documents as under. (i) Demand Drafts for E.M.D. (ii) Demand Draft of Tender Fee. (iii) Tender duly signed and sealed on each page. Price bid cover The cover shall contain offered rates in Schedule-B duly signed by the contractor. 1.1 The bidder must clearly quote percentage above or below the tender rates in figure as well as in words. The bidder must work out the total price of their tender offer accordingly and the total amount should be clearly written in words figure. In case of any discrepancy, whatever written in words shall prevail. All the columns in schedule should be filled in with INK. 1.2 No deviation in terms conditions, Schedule-B and special conditions will be entertained. Any ignorance for this shall not relieve the contractor from their contractual liability arising as per tender documents. 1.3 The bidders are required to quote only firm percentage prices. No variation will be accepted on price/ raw materials/ finished products or on any cause. 1.4 The bidders should note that the completion of above mentioned works in all respect in accordance with the time limit given is very important and should be strictly adhered to. The work is to be completed in time limit from the date of issue of letter for commencement of the work or issue of LOI or work order. 1.5 The bids should be valid for a minimum period of 120 days from the date of opening of technical bids. During this period tenderer shall not be allowed to withdraw their tender and if withdrawn, the Earnest Money Deposit submitted with the tender will be forfeited 1.6 The works covered under these specification shall be carried-out and governed by Tender and Contract for Works booklet and General Conditions of Contract, which can be available for reference at the office of the undersigned during office hours of all the working days. 1.7The successful bidder shall have to enter in to an agreement for contract as per G.S.E.C.L rules on a stamp paper of Rs.100/- and necessary stamp duty charge shall be borne by the contractor. Before signing agreement, contractor has to pay security deposit as per GSECLs rule within fifteen days on receipt of L.O.I or work order from GSECL, failing which order will be cancelled and EMD will be forfeited. 1.8 The tenderer return the tender with specification and schedule of quantity rate and other schedule duly signed. Tender not bearing signature of the contractor on all the documents accompanying tender is liable to be rejected. 1.9 The submission of tender by a contractor implies that he has read these instructions the conditions of contract etc. and has himself aware of the scope and specifications of the work to be done and of conditions and local conditions and other factors bearings on the execution of the works. GSECL will not therefore after acceptance of contractor's rate pay any extra charge for any other reason; in case the contractor is found later on to have misjudged the site condition. 1.10 GSECL authorized officers who accept tender, shall have the right of rejecting all or any of the tenders and will not be found to accept the lowest offer nor to assign any reason whatsoever for the rejection of any tender or all tenders.

2. Security Deposit As per the prevailing rules of the GSECL, tenderer have to pay Security Deposit (S.D.) equivalent to10 % of the contract value in the name of GSECL. The same shall be paid in cash, FDR or in the form of Bank Guarantee on any of the banks describe in Annexure-I. Total S.D. equivalent 10% of contract value shall be paid to GSECL before placement of work order., The security deposit amounting to 10% of the contract value shall be released only after finalization of final bill. 3.Time Limit For Work: The work should be completed in Stipulated Time Limit of 02 (Two) months from the date of issue of letter to commence the work. The contractor has to lift the all type of scrap materials within time limit as per order, otherwise rent will be charged @ 5% per annum of the cost of uplifted materials subject to maximum Rs. 200/- per day by the GSECL. 4. Prices: The contractor shall quote their percentage prices in Rupees in figure and words as per schedule-b attached with the tender specifications. The quoted offer shall be firm without any price escalation during entire duration of contract with the taxes (5% Vat) etc. 5. Terms of payment by the contractor: Full payment of the offer + applicable taxes (5% Vat) shall be made within 15 days from the date of receipt of order or date of commencement from GSECL. The purchaser will not be permitted to lift the materials until & unless the full payment is made. On receipt of full payment, a delivery order will be issued by the GSECL from Corporate Office. If the payment is not made within stipulated time limit, interest @ 18% per annum will be charged on delayed payment as late payment charges... 6.Recoveries: a) In case of any damage to equipment / machinery or structure / building / Furniture etc, of GSECL or any public property due to negligence of contractor or any other reasons attributed to contractor, the decision of E.I.C. regarding the amount of recovery shall be final. b) If the contractor fails to execute the work as per direction of E.I.C. within the time frame given, the GSECL shall get the work done through any other contractor at the risk and cost of the contractor and the cost of execution of such work along with 15% overhead charges shall be deducted from contractors monthly bill over and above recovery as per rules. 7. Taxes: All royalties, sales tax, toll tax, local tax, development charges, VAT tax, and any other taxes including works contract tax etc.,in respect of this contract and also any statutory variation in future towards above mentioned taxes any other taxes if levied in future by statutory authority applicable to the this contract shall be payable by the contractor and GSECL will not entertain any claim whatsoever in this respect.

8. Arbitration: ALL QUESTIONS, DISPUTES OR DIFFERENCES, WHATSOEVER WHICH MAY AT AN TIME ARISE BETWEEN THE PARTIES TO THIS CONTRACT IN CONNECTION WITH THE CONTRACT OR ANY MATTER ARISING OUT OF OR IN RELATION THERE TO, SHALL BE REFERRED TO THE GUJARAT PUBLIC WORKS CONTRACTS DISPUTES ARBITRATION TRIBUNAL AS PER THE PROVISIONS OF THE GUJARAT PUBLIC WORKS CONTRACTS DISPUTES ARBITRATION TRIBUNAL ACT, 1992. Special Condition Name of Work:r Sale of Various unserviceable items and other scrap material of Corporate Office, GSECL at Vadodara 1 You will have to pay amount equivalent to 10% of order value as S.D. in cash/ FDR/ Bank Guarantee form in the office of the GSECL, Corporate Office,Vadodara before commencement of work. 2 The time limit for contract is two months 3 Rate quoted should be exclusive of sale tax and other taxes as applicable during the contract period and same will be borne by contractor. 4 scrape is to be lifted on as is where is basis. 5 Weight of the steel scrap & wooden scrap is to be done on recognized weigh bridge preferably on computerized weigh bridge in presence of security officers and representative of Civil section. 6 Scrap materials should be lifted after making full payment against materials and Money Receipt is to be produced at the time of lifting of materials. 7 Scrap materials to be lifted on working days only with prior intimation. 8 9. Scrap material lying on terrace of 3 rd floor of GSECL building and Contractor will have to make arrangement for lifting the same. Contractor will have to make arrangement for transportation at his risk and cost. 10 Weigh bridge payment should be done by Contractor. 11 Qty given is estimated and same may increase or decrease. There should not be any question regarding qty and quality by Contractor. 12 If contractor fails to lift the scrap within stipulate period penalty as per company norms will be levied 13 Contract is governed by rules of the GSECL which will be binding to contractor. 14 Order will be placed with highest bidder Signature of contractor With seal date.
