YGP vote: 2-0. 1. The applicant shall enter into a developers agreement with the town within two (2) years of rezone approval by Dane County. Said agreement must include a provision that provides for the installation of a footpath along Golf Drive. A copy of the agreement must be provided to Dane County Zoning within the two (2) year Delayed Effective Date and prior to approval of the final plat. 2. There shall be two public road accesses to the development by dedication of a through street in the location shown on the preliminary plat. 3. The project shall replace a 66-inch corrugated metal pipe and weir structure at the proposed Augusta Court s stream crossing. This replacement structure will likely be a larger single cell box culvert. Also, the Yahara River golf path crossing near Linden Court was a 66-inch culvert pipe with concrete abutments. The two other similar golf path crossings shall be replaced with clear span bridges with the renovation of the golf course. The replacement of these structures will aid in enlarging these man-made constrictions of the natural flows and help the flood waters equalize during flood events.

Said publication is to include specific legal description. 2. Compliance with the Dane County Comprehensive Plan is to be established. See Pam Andros, Senior Planner letter dated June 7, 2012. 3. Before a subdivision plat may be recorded and filed for the same property, the condominium plat shall first be removed from the provisions of this chapter by recording a removal instrument. Currently, a recorded condominium, recorded as Document# 4395912, Dane County Registry. Platting of this land would violate S.703.128 (1m)(b), Wisconsin Statutes. 4. The public parkland appropriation requirement is to be satisfied (private park land does not satisfy this requirement). 5. All public land dedications are to be clearly designated dedicated to the public. 6. Due to concerns with land suitability and hydric soils, a note shall be affixed to the final plat that states the following: No residential development on Outlots 1, 2 and 3. 7. A note shall be affixed to the final plat that states: Lots 24 thru 36 fall within the shoreland zoning district of Dane County and prior to any land disturbance, shoreland erosion control permit(s) will be required from the Dane County Land & Water Resources Department. 8. A notation is to be included that states: Lands covered by this plat are within an area subject to height limitations owing to the operation of aircraft and equipment from a nearby airport. Owners of lands within the area covered by this plat are required by law to restrict the height of trees, other vegetation and man-made structures to less than the height limitations set forth in that certain map dated April 24, 2008, entitled Height Limitation Zoning Map, Dane County Regional Truax Field, Madison, Wisconsin, said map being on file in the Dane County Clerk's office. 9. A notation is to be included that states: Lands covered by this plat are located within an area subject to heightened noise levels emanating from the operation of aircraft and equipment from a nearby airport. 10. Lot 31 shall show the front setback in relation to the 100 of lot width either on the plat or as a separate exhibit. 11. Outlot 6 does not meet the lot area requirements with respect to the shoreland-zoning district. Lots located in shoreland area shall meet all area and width standards required in section 10.05(4), R-1 residence district. Unsewered lots within the shoreland district shall not be less than 100 feet in width at the building setback line and have an area of not less than 20,000 square feet. Land Division variance from Ch. 75.19 (6)(c) and a variance from Ch. 10.05(4) through the Dane County Board of Adjustment will be required or redesign the outlot to meet the dimensional standards. 12. Rezone petition #10449 to rezone 0.02 acres of wetlands to non-wetland district shall be approved. 13. Building envelopes shall be shown on the final plat for Lots 1, 2 and 3 due to the reduced setbacks from the wetland district and the public highway right-of-way. 14. Option 3 would be to transfer the development rights of the property to a more suitable location in the Town. The committee decided to conduct a site visit to the Larson Property. No Reason: Proposed roadway crossing wetland area Applicant Windsor, Town of Location: Outlot 6, Revere Trails subdivision Previous submittal of Petition # 10315 that was denied by the County Board September 1, 2011. DESCRIPTION: The petitioner request approval to place a public street through an area identified as being part of a wetland. The proposed roadway will permit access from the Terrace Park Subdivision, to the North, to Highway 19. OBSERVATIONS: There is a pending violation occurring due to the developer constructing a culvert for Revere Pass without the necessary approvals. The DNR and Army Corps of Engineering are currently dealing with this violation. TOWN PLAN: The Town Plan shows this area as part of the planned street system for the area. STAFF: In order to remove areas from wetlands, the ZLR Committee must find that the removal does not adversely impact items noted in DCCO 11.10(2). See attached. Huston Agent: R.G. Huston Company, Inc. Size, zoning, use of existing parcel: The parcel is approximately 45 acres in size, 15 acres of which is zoned C-2 and the remaining 30 acres is zoned A1-EX. The current CUP (#2136) for mineral extraction area covers the full 45 acres. The requested rezone and CUP apply to the 30 acres currently zoned A-1EX. Rezone/CUP desired: The CUP is for a operation of a portable concrete batch plant within the current mineral extraction operation. The batch plant use is not allowed as a conditional use in the C-2 district or in the A-1EX district. This is the reason for rezoning from A-1EX to A-2. The A-1EX zoning district allows a CUP for a batch plant limited to use for public roads and for a period of time limited to specific project duration. A-2 allows as a conditional use mineral extraction operations, asphalt plants, ready mix concrete plants [Section 10.126(3)(a)]. Because of the rezone to A-2, this petition should be for the batch plant and a mineral extraction operation so that the applicant can continue the mineral extraction operation currently allowed via CUP 2136. 2

DANE COUNTY PLANNING STAFF COMMENTS Overview: This petition is for continuation of an existing mineral extraction operation with the addition of operation of a portable concrete batch plant. This request is for an area covering 30 acres for a period of 5 years. Surrounding Area Characteristics: The surrounding area is agricultural, with scattered residential land uses. It is located on NW quadrant of the intersection of Hwy 12 & CTH N. Town Plan: The subject property is located in the Limited Commercial land use district of the Town of Cottage Grove Comprehensive Plan. This proposal is consistent with the town plan. Compliance with County Ordinances: Mineral extraction operations must meet requirements found in Chapters 10, 14 and 74 of the Dane County Code of Ordinances. The applicant has submitted an erosion control plan/storm water management plan as required by Chapter 14 of the Dane County Code of Ordinances (DCCO) a reclamation plan as required by Chapter 74. The applicant has an approved erosion control and reclamation plan and permits associated with the current operation (CUP #2136). Chapter 10 provides six standards for granting a CUP in Section 10.255(2)(h) of the zoning ordinance are as follows: 1) That the establishment, maintenance, or operation of the conditional use will not be detrimental to or endanger the public health, safety, comfort or welfare. 2) That the uses, values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no foreseeable manner substantially impaired or diminished by establishment, maintenance or operation of the conditional use. 3) That the establishment of the conditional use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. 4) That adequate utilities, access roads, drainage and other necessary site improvements have been or are being made. 5) That adequate measures have been or will be being taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets; and 6) That the conditional use shall conform to all applicable regulations of the district in which it is located. RECOMMENDED CONDITIONS Appropriate conditions for this petition are those associated with CUP#2136 (for mineral extraction, permit effective on 5/11/2010), with additional conditions added by the town via the Town Action Report. All drive aisles shall be either graveled or paved according to revised operations plans, and shall be maintained in a dust free manner in accordance with local, state, and federal regulations. 9. Hours of operations, except for crushing, screening, and washing shall be from 6 a.m. to 6 p.m., Monday through Friday, and from 8 a.m. to 3 p.m. on Saturday. Crushing, screening and washing shall not occur before 7 a.m. on Monday through Friday and 8 a.m. on Saturday. No operations of any kind shall take place on Sundays or legal holidays. No Reason: Violation of the conditions of a Conditional Use Permit Petition: Revocation of CUP #1353 and CUP #1450 Town/sect: Cross Plains Section 27 Applicant KJK Enterprises LLP Location: 3753 County Highway P DESCRIPTION: Zoning Staff is requesting that Conditional Use Permit #1353 and #1450 be revoked for the property owners failure to follow the conditions of approval of said Conditional Use Permits. The conditional use permits allow for a tavern, residences, and agricultural uses to be present on the property. Recently, an existing building, at the corner of CTH P and Mineral Point Road, was converted into a duplex which is contrary to current approvals for the property. CUP #1450: Condition #1 required the corner building to be used only for one apartment on the second floor. After a complaint was lodge by the Town, an inspection conducted on January 6, 2012 found an apartment on the first floor as well. CUP #1353/ Rezone 6670: Part of the approval were condition on no further expansion of the facilities were to occur unless proper sanitary approvals were obtained from Department of Health. In speaking with Environmental Health, no approvals were obtained for the change nor were there responses when inquires came from the Department of Health. OBSERVATIONS: One of the owners, Kitt Kelsheur, submitted an application to revise the conditional use permit on the property in February 2012 to allow for a duplex on the property. Unfortunately, there was no representation at the May 8 th ZLR public hearing nor has Mr. Kelsheur attended meetings for the Conditional Use Permit at the Town. At this point in time the violation remains and the Conditional Use Permit is postponed. The Health Department has concerns with the sanitary system that is serving the existing building in question. They have no plans regarding the system and feel that the system is sub-standard. STAFF: Zoning Staff is requesting that CUP #1353 and #1450 be revoked based on the following reasons: 1) The owner is violating conditions of approval of said permits and no cooperating with the corrective actions. 2) The concerns regarding the adequacy of the sanitary system serving the building may endanger the health of the public due to the premise being open to the general public (tavern parking lot). STAFF UPDATE: An inspection was conducted on August 7, 2012 and found that the residence and plumbing fixtures have been removed from the first floor of the building. The owner has been working with the Department of Health to resolve the sanitary issue. The old building will be hooked up to the septic system for the new tavern facility.
