Terms Rental Fee shall be $ plus a security deposit $. The Security deposit of $ shall accompany this agreement by check, money order or cash. This is a precautionary measure for any damages, cancellations, or cleaning fees. Anyone in breach of this contract may have event terminated before said times. The deposit will be returned, by mail, within (45) forty five days after the event. Payment must be cash, check or money order. A fee of fifty ($50) dollars will be deducted from the security deposit for any returned checks, plus any fees. Rental Fee Schedule: 90 days before the event ½ of the fee is due. 30 days before the event remainder must be paid. Balance due thirty (30) days before the event with a list of names of caters, DJ s, decorators etc. Cancellations: Any event cancelled Ninety (90) days before the event a fee of one hundred ($100) dollars will be deducted from the deposit and the remaining deposit will be returned by mail. Notice of less than ninety (90) days of the event will result in the loss of the deposit and any rental fees paid. Rental Agreement This rental agreement signed this 20 Between the Walden Fire District hereinafter referred to as the Lessor and, hereinafter referred to as the Lessee hereby agrees to rent the premises of the Walden Fire District Social Hall, under the following terms and conditions. 1. The purpose and intended use of the premises by the Lessee will be a. The Lessee agrees not to use the premises for any other purpose of that stated or in any other manner. 2. The Lessee understands that the premises will be used for legal purposes only and for the intended use stated in paragraph one. 3. The Lessee agrees to rent the premise which consists of the Social Hall and parking lot (for vehicle parking only), on 20. No parking is permitted in the fire lanes, chief parking, commissioner parking or firefighter parking as designed by the appropriate signage. Violators will be towed away at the violators expense. 4. The lessee understands the premises will only be rented for the day of the event. The designated hours of the hall shall be a.m. to 12:00 a.m. There will be no entry permitted before _ a.m. on the day of the event. The Lessee shall ensure that all vendors, caters, guests, etc. are vacated from the premises by 12:00 a.m., the day of the event. 5. The lessee agrees to the rental rate as outlined on the annexed rate, which rental rate is determined by the use of the premises and type of organization renting hall. 6. The total number of bridal party, guests, employees, caterers, etc. allowed for specified event herein is 300 seated or standing. Lessee shall not have in excess of specified number of attendees. 7. NO TAPE, TACKS, OR ANY OTHER FASTNERS shall be affixed to the ceiling, walls, fans, windows, window sills, or wall decorations. All decorations and trash shall be placed in the receptacle outside before exiting the hall. 8. Any event that will be serving alcohol shall apply to the New York State Liquor Authority for the appropriate permit and a copy of the application shall be attached to this contract. If the application is approved a copy of the permit shall be submit for inclusion with this contact prior to the day of the event. If the application is rejected no alcohol shall be served at the event. At the discretion of the Walden Fire District an addition insurance rider may be required for any event serving alcohol. The cost of such insurance rider shall be the responsibility of the Lessee. ABSOLUTELY NO CASH BARS OR THE SELLING OF ANY KIND OF ALCOHOL AT ANY EVENT.
9. Lessee and caterer are responsible for supplying their own cooking equipment and utensils for the event. The Social Hall will be cleaned the day of the event. All spills and/or major stains must be cleaned up and the floor spot mopped and dust mopped for cleaning. The kitchen must be checked for any leftover items and checked for cleanliness. It is the responsibility for the lessee to check these items. It will be the responsibility of the Lessee to fulfill any duties before exiting the hall that day before 12:00 a.m. 10. No equipment or fixtures may be removed or taken down from the facility without the express written permission of the executive member of the Lessor. 11. To the fullest extent permitted by law, the Lessee agrees to defend and indemnify, the Walden Fire District for any bodily injury or damages occurring on or to the premises as a result of the Lessee's use of the premises on the designated rental date. If the Lessee is a nonprofit or a profit organization the Lessee also agrees to add the Walden Fire District as an additional insured on a primary, noncontributory basis, with coverage in the amount of $1,000,000.00. 12. The Lessee reserves the right and sole discretion to refuse of any rental of the premises to any individual or organization whose actions or events would be contrary to the policies and procedures of the Walden Fire District or that would be in violation of any local, state or federal laws, ordinances or statues. 13. This agreement may not be changed, altered, or modified orally. All changes, alterations and/or modifications shall be done in writing and signed by both parties signifying a mutual agreement to the rental contract. 14. Lessee shall provide Lessor with the names and addresses of all vendors, subcontractors, employees, and/or agents of Lessee who will be entering the premises prior to event. 15. The Lessee may engage a musical band or Disc Jockey to perform at premises. However may not create a disturbance or sounds on the Walden Fire District property which carries on beyond the boundary lines of the property on which they are created to cause inconvenience or to disturb the public s peace, comfort, or tranquility. NO SMOKE MACHINES SHALL BE PERMITTED. ALL MUSIC MUST END BY 11:00 p.m. NO EXCEPTIONS!!!!!! 16. The Lessor may at any time during the event stop and terminate the event for any safety violation or any situation that may be considered unsafe while said event is taking place. All guests and the lessee will then exit the premises without any refund of deposit or hall rental fee. 17. Lessee may be provided entry into the premises no earlier then 5:00 a.m. on the day that the scheduled event takes place for set-up or dropping off items. No exceptions. 18. In the event that a party consists of minors there will be no exceptions to having alcohol at these events. ex. Sweet 16 parties or events that specialize in minor birthday parties. No alcohol will be placed in the social hall or parking lot. If the consumption of alcohol by minors takes place, your party can and will be shut down before said exiting time and no deposit will be refunded. 19. Social hall cannot be rented for the allowance of any kind of gambling purpose. 20. Smoking is not allowed in the social hall or kitchen area. Outside receptacles are placed by the entrance.
21. A security deposit in the amount specified must accompany this contract and be signed by the Lessee for the said date to be held for rental of hall. Cash, local check and money order only. This deposit will be returned in full pending no damage to social hall, decorations and hall has been cleaned to directors liking. The deposit will be mailed to the address in which it originated from within 45 days of event. 22. No rain or snow dates will be given unless Lessee agrees to pay for the next date also. 23. If the Lessee does not perform or fulfill the obligations or responsibilities stated in the provisions of this rental contract, the Lessee will be in breach of contract and will forfeit the deposit and paid rental fees. The attached clean up sheet will be acknowledged by the client at the time of the signing. It will be the responsibility of the Lessee to fulfill these duties prior to exiting the premises. 24. All guests must remain in the hall for the event, children are not allowed to rollerblade, skateboard, or play in the parking area attended or not. Vehicles are moving throughout the lot, and for everyone s safety must remain in the hall, except for the smoking area. 25. In consideration of the leasing of the premises of the Walden Fire District to the undersigned. To the fullest extent permitted by law, the undersigned hereby releases, acquits, and forever discharges the Walden Fire District, its officers, employees, directors, members, (collectively the Walden Fire District) from any and all suits, action compensation, consequential damages, punitive damages or any other thing whatsoever on account of or in any way growing out of, any and all property damage, personal injuries, illness, or death or any matter resulting or a result from any occurrence or accident that may have happen as result or arise out of leasing or use of the described premises by the lessee. I/We have read the foregoing agreement and fully understand and accept each item as presented.
