Recommendation Discussion Memorial Hermann Hospital System has requested a variance to allow construction of a 90 medical office building. Per the City Ordinance, the property has a maximum height of 45 which may increase one additional foot for every one foot off the building line, up to 75. The proposed building location is abutted by a pipeline easement, which hinders the developer from pushing the building off of the building line to gain height. The developer has requested to be able to construct a building with a maximum building height of 90 in order to meet the footprint for the desired facility. Staff remains neutral on this request. The property currently has other multi-level buildings in operation, and is primarily within a commercial zoned area. This is the second of two public hearings. MINUTES OF REGULAR MEETING April 21, 2015 PLANNING & ZONING COMMISSION 1. CALL TO ORDER The meeting was called to order by Chairman Ash at 7:00 p.m. 2. CALL OF ROLL Commissioners present, Chairman Ash, Mr. Dean Gristy, Mr. Wally Westbrook and Mr. Ritch Wheeler Also present were Jackie Thompson, Greg Smith and Officer John Ferrand. 3. CITIZENS FORUM Responses to inquiries are limited by state law to a recitation of existing policy or a statement of specific factual information given in response to the inquiry. Any deliberation or decision by Planning and Zoning Commission shall be limited to a proposal to place that subject on the agenda of a future meeting. Chairman Ash stated for the record that there were no citizens wishing to speak. 4. Presentation of a preliminary report regarding the proposed zoning amendment from Interim Zoning IZ to Office/Commercial District OC. The proposed zoning amendment is for 3.2175 acres in Montgomery County School Land Survey, Abstract A-350, Tract 34, Shenandoah, Texas. Mrs. Thompson advised the Commission this request is for property City Council annexed on March 25 th. Adding the property owner wishes to zone the property Office/Commercial District. Mrs. Thompson stated the property is located on the south side of Tamina Road, abutting the proposed senior living center property and the currently under construction Holiday Inn and Staybridge tract. Chairman Ash asked if property on either side was within the city limits. Mrs. Thompson advised the property immediately to the east and west were not a part of this City. 5. Public hearing regarding the proposed zoning amendment from Interim Zoning IZ to Office/Commercial District OC. The proposed zoning amendment is for 3.2175 acres in Montgomery County School Land Survey, Abstract A-350, Tract 34, Shenandoah, Texas. Chairman Ash opened the public hearing at 7:04 p.m. Commissioner Gristy asked if the proposed zone, OC, is comparable to the other zoned properties in the area. Mr. Smith advised yes. Commissioner Wheeler stated that what the property is granted, as far as a special use permit, is different from the requested zoning. Mrs. Thompson advised they are zoned Office/Commercial with a special use permit for Tourist Accommodations. Commissioner Westbrook asked if the property across the street was also zoned the same. Mrs. Thompson stated yes, the Cambria Suites was granted a special use permit for Tourist Accommodations as well. Commissioner Westbrook asked what the zoning was for the property abutting the northern property line of this proposed rezoning property was. Mrs. Thompson advised that property was the proposed senior care facility and is zoned Office/Commercial. Chairman Ash asked as the City continues to build out down Tamina Road, has any thought been given to the expansion of the road. Mr. Smith advised it would be part of the upcoming bond issue for the County. Chairman Ash closed the public hearing at 7:08 p.m. 6. Presentation of a preliminary report regarding the proposed zoning amendment for a Special Use Permit to allow for Tourist Accommodations: Lodging General and Restricted. The proposed special use permit is for 3.2175 acres in Montgomery County School Land Survey, Abstract A-350, Tract 34, Shenandoah, Texas. Mrs. Thompson stated this request is for the same tract of land previously discussed. Advising the property owner has requested a special use permit for tourist accommodations. Mrs. Thompson advised the proposed hotel would be a four story Four Points by Sheraton with approximately 104 rooms. Adding the City requested a preliminary site plan showing the orientation of the building and ensure they would be able to accommodate the vegetation buffers and building setbacks. Chairman Ash asked what the uses of the surrounding properties. Mrs. Thompson advised the property to the east and west were vacant. 7. Public Hearing regarding the proposed zoning amendment for a Special Use Permit to allow for Tourist Accommodations: Lodging General and Restricted. The proposed special use permit is for 3.2175 acres in Montgomery County School Land Survey, Abstract A-350, Tract 34, Shenandoah, Texas. Chairman Ash opened the public hearing at 7:09 p.m. Commissioner Wheeler asked if there was a representative present from the project. Wafi Ali, 9030 Tamina Road advised the architect was one his way to the meeting. Commissioner Westbrook asked for the project to be described again. Mrs. Thompson advised the proposed project is for a Four Points by Sheraton. The hotel will have 104 rooms, with an approximately four stories. Chairman Ash asked if there was a panhandle of land along the west property line. Mrs. Thompson advised due to the property to the northern section of that portion of the property being a residential home, the vegetation buffer required was 35. Chairman Ash stated they would not be able to do anything with the section of property. Mrs. Thompson stated at this time yes. Mr. Smith added the proposed site plan does not show detention for the site, which prior to Planning & Zoning Meeting Minutes 04/21/2015 Page2
recommending approval would need to be made sure there is adequate space to provide detention. Mr. Smith also advised from a Staff standpoint this is the tightest fit for this type of use. Mr. Smith also advised Staff would be requesting approval from the Four Points by Sheraton, of the proposed site plan due to the parking being situated at the front of the property rather than around the hotel. Commissioner Gristly asked if the property is in a lease situation or already been purchased. Mr. Ali stated it is currently under contract. Commissioner Wheeler stated he has a safety concern with the parking being distant from the hotel and along Tamina Road. Stated that is runs the risk of potential problems. Commissioner Gristy asked what tract was abandoned. Mrs. Thompson stated both to the east and west are vacant at this time. Chairman Ash closed the public hearing at 7:16 p.m. 8. City Administration updates. Mr. Smith advised the Commission the City Park is moving forward and hopefully a portion of the park will be opening in May. Mr. Smith advised the play equipment if being installed, and the sidewalks and driveways are in the process of being completed. Adding construction of the splash pad is almost finalized. Mr. Smith advised the Commission Entry Signs are almost completed, the punch list has been sent to the contractor to be fixed. Mr. Smith advised the Commission the sidewalk along Wellman Road is complete. Mr. Smith advised the Commission the waterline along Wellman Road should be completed soon. Adding Lily will be adding their fence upon its completion. Mr. Smith advised the Commissioner the internet survey results are posted on the website. 9. Mr. Smith advised that has not been determined yet, but would be three to four lanes. Mr. Smith added the section between David Memorial and IH45 could be expanded as a City project. Commissioner Wheeler stated that the bond issue did not include the extension of Vision Park under IH 45. Mr. Smith stated that it was not included in this Planning & Zoning Meeting Minutes 04/21/2015 Page3
bond, but could move forward at a later date with another entity. Mr. Smith advised the extension of David Memorial to connect to 242 will happen if the bond issue passes.
