Will County GIS Product Distribution Policy January, 2008 Background: The goal of this policy is to provide GIS products to users in a reasonable manner and to ensure that products released are of sufficient quality. This policy restricts access to GIS products of a sensitive nature. This policy applies to all County departments under the County Executive s Office that utilize GIS to produce such products. All other elected offices may choose to apply this policy to their own departments. The distribution of the GIS products will require the permission of the department or agency head from which the products are originated. As an alternative, a department or agency may distribute its own GIS products according to this policy. The current departmental responsibility of distributing certain GIS products will not be affected by the execution of this new policy. The GIS Director may limit distribution of GIS products or require an additional waiver of responsibility for said products, if those products are of questionable or unknown accuracy or origin. Access to those GIS products may also be restricted per conditions of the purchase or gathering of the data on which the products are based. The GIS Director may restrict access to GIS products at the request of the County Executive, County Board, Sheriff, 911, or the Emergency Management Agency for reasons of security and privacy. Data currently restricted includes information on nuclear energy facilities, petroleum refineries, chemical plants, airports, pipelines and their derived products. It is the policy of Will County to place digital watermarks on all raster type files that the county holds rights to. All GIS products will be charged per the Price Schedule in this policy. Section I: GIS Products GIS Products include, but not limited to, any data, map, application and associated service in digital or paper format that are produced by utilizing GIS or its related technology. 1. Maps Atlas Maps are predefined maps that are requested on a regular basis. The initial sets of these maps include, but not limited to, countywide maps of Municipal Limits, Highways (streets), County Board Districts, Congressional Districts, Illinois House and Senate Districts; township maps of Zoning Districts; and district-wide maps for County Board. These maps in paper format will be plotted in one of four sizes: 8 ½ by 11, 11 by 17, 42 by 42, and 42 by 48. These maps in digital format will be PDF files and can be acquired through CD, DVD, or other electronic means (e.g. email, FTP download). Custom Maps are maps that require additional staff time to make according to customer s requirements. These maps may be simple printouts of layers in the GIS, or may be representations of analysis performed by GIS staff. This category also includes

2. Data any requests for section maps of parcels, topography (contours), or imagery (orthophotography). The requests for custom maps will require the GIS Director or his designee to provide the customer a quote. This estimate will include labor cost for staff time in addition to the regular map cost. These maps in paper format will be plotted in one of four sizes: 8 ½ by 11, 11 by 17, 42 by 42, and 42 by 48. These maps in digital format will be PDF files and can be acquired through CD, DVD, or other electronic means (e.g. email, FTP download). Planimetric Data are common GIS layers. The initial set of planimetric data available includes, but not limited to, street centerlines, parcels, zoning districts, municipal boundaries, benchmarks (vertical and horizontal control), various district boundaries, and county board districts. All GIS layers that are not security or privacy sensitive will be made available. The planimetric data will be distributed in ESRI shape file or personal geo-database format. Attribute Data is a database table that is separate from but related to a GIS layer. The initial database available will be the real estate database. Other database may be made available with the approval of the LUPZD (Land Use, Planning, Zoning & Development) committee of the County Board. The database will be delivered in Microsoft Access or ASCII delimited format. Topographic Data is the contour layer. This layer will be distributed in ESRI shape file or personal geo-database or CAD format. Aerial Imagery Data is six-inch ortho-photography. The ortho-photography will be delivered in TIFF or MrSID format. 3. Applications Internet GIS Web Application provides the general public free and basic access to Will County GIS data via a web browser. This application will have limited tools (pan, zoom, identify, find, etc.). In the future, it may be part of the digital community outreach. The GIS layers currently available via this application will be street centerlines, parcels, townships, municipalities, and zoning districts. Except for security and privacy reasons, other layers will be made available in the future. This list of layers may be amended by the LUPZD Committee of the County Board. Intranet GIS Web Application provides county departments and approved agencies comprehensive access to Will County GIS data via a web browser. This application will have tailored tools for departmental uses. It includes almost all the layers in the central GIS data server. Section II: GIS Data Agreements and GIS Product Sale Policy Will County GIS Products, which are described in Section I of this policy, can be obtained through one of the following means.

1. Maps Maps in either digital or paper format can only be obtained by purchasing them except for the ones made available on Will County GIS Department web site for downloading and printing. The prices for the maps are included in the price schedule in Section III of this policy. 2. Data GIS data can be obtained through one of the following means: Data Sharing Agreement: A Data Sharing Agreement (DSA) promotes a cooperative exchange of GIS data between the County and other agencies. DSA is restricted to Municipalities and Fire Districts within Will County and any other government agencies that have regularly updated data deemed useful by the County Board for exchange. If the agency that qualifies for DSA has a jurisdiction boundary within Will County, it will only be provided data for its jurisdiction boundary and a planning radius of the surrounding areas. The agency and the County are entitled to the updates of the exchanged GIS layers as outlined in the agreement. If the agency fails or is not able to provide meaningful data exchange, it will be moved to DLA with the approval of the LUPZD committee of the County Board. Data Licensing Agreement: A Data Licensing Agreement (DLA) is restricted to any government, quasigovernment, non-profit agencies, and public education or research institutions that do not have qualify for a DSA. Agencies under DLA include, but not limited to, Townships, Township Highway Commissions, School Districts, Park Districts, Library Districts and Drainage Districts. If the agency that qualifies for DLA has a jurisdiction boundary within Will County, it will only be provided data for its jurisdiction boundary and a planning radius of the surrounding areas. The agency is entitled to updates of those GIS layers as outlined in each agreement. If an agency has data for exchange over time, it can be moved to DSA with the approval of the LUPZD committee of the County Board. Data Purchase: Any individual or company that does not qualify for DSA or DLA, must purchase the data. The prices will be set to a reasonable level to help offset the cost associated with producing and updating the data. A yearly fee structure will be implemented for DSA & DLA and the fee schedule is included in Section III of this policy. The price schedule for data purchase is also included in Section III of this policy.

3. Applications The Internet GIS Web Application is free to everyone who has Internet connection and browser software, such as IE, as a public service from Will County GIS. The Intranet GIS Web Application may be made available to certain agencies that qualify under DSA or DLA. This availability will be very limited and is subject to the recommendation of the GIS Director, the approval of LUPZD Committee of the County Board and the network capacity of the county. No private company will be offered this product. A yearly fee will be charged for this service and the fee schedule is included in Section III of this policy. Section III. Fee Schedules 1. If two or more data products are acquired in one request, they will be arranged in descending order based on their costs from the above price schedule. No discount will be applied to the first product. A 20% discount will be applied to the second product, a 40% discount will be applied to the third product, and a 60% discount will be applied to the remaining products. For agencies that are willing to pay an annual maintenance fee to get a yearly update of the data product after paying the initial price of acquiring the product, the year fee is 10% of the initial price before any discount.

The price of a request with area size falling within a certain range will be pro-rated according to the range of the prices corresponding to the range of the area sizes in the above schedule. One township equals 36 sections and the size of the county equals the size of 24 townships approximately. The minimum unit of data request is a quarter of a section. The price does not include the cost of staff time and media. A final price quote will be provided when the request is made. 3. Disclaimer, Non-Disclosure Agreement, and Exceptions 1. Disclaimer of Warranties and Accuracy of Data Although the data developed by Will County for its maps, websites, and Geographic Information System has been produced and processed from sources believed to be reliable, no warranty, expressed or implied, is made regarding accuracy, adequacy, completeness, legality, reliability or usefulness of any information. This disclaimer applies to both isolated and aggregate uses of the information. The County and elected officials provide this information on an "as is" basis. All warranties of any kind express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, freedom from contamination by computer viruses or hackers and non-infringement of proprietary rights are disclaimed. Changes may be periodically made to the information herein; these changes may or may not be incorporated in any new version of the publication. If you have obtained information from any of the County web pages from a source other than the County pages, be aware that electronic data can be altered subsequent to original distribution. Data can also quickly become out of date. It is recommended that careful attention be paid to the contents of any data, and that the

originator of the data or information be contacted with any questions regarding appropriate use. By accepting the GIS products from Will County, the recipients expressly agree to accept the above disclaimer. 2. Non-Disclosure Agreement The usage of the Will County GIS products is restricted to the agency that actually acquired the products and its authorized contractors. The authorized contractors can only use the products in the designated projects for the agency for which the GIS products are requested. The contractors can not use the products in other projects. No third party distribution of Will County GIS products in any form is allowed without written permission from the GIS Director after consultation with the County Executive s Office and the LUPZD Committee of the County Board. By accepting the GIS products from Will County, the recipients expressly agree to accept this non-disclosure agreement. It is the responsibility of the agency that acquires Will County GIS products under one of the means in this policy to make sure its employees and contractors to follow this nondisclosure agreement. It is the intent of the County to pursue third party distribution violators. 3. Exceptions Any exception to the determination of the qualification of an agency under DSA or DLA will be subject to the recommendation of the GIS Director and the approval of the LUPZD committee of the County Board or the approval of the full County Board if any member of the LUPZD committee deems necessary. Any request for the discount or the waiver of the fees must have the recommendation of the GIS Director and the approval of the LUPZD committee of the County Board or the approval of the full County Board if any member of the committee deems necessary. Any existing agreement between a Will County department and an outside agency on the data this department develops is excluded from the relevant rules of this policy. The GIS Director has the discretion to determine the type and the amount of data to be exchanged and the frequency and format of the delivery when negotiating individual DSA or DLA agreement with the subject agency. The Director or its designee will inform the LUPZD committee of the County Board of any major deviations from the standard DSA or DLA when applying for approval. Any exception to any rules of this policy is subject to the approval of the LUPZD committee of the County Board or the approval of the full County Board if any member of the committee deems necessary. The LUPZD committee of the County Board or the full County Board reserves the right to make changes to this policy at any time without notice.
