Under the terms of your mortgage you must obtain our written consent before entering into any letting arrangement. You must notify your Buildings Insurance Company that the property is to be let, and must maintain adequate buildings insurance cover at all times, as per the terms of your mortgage. Once we have received the completed form confirming that you will be bound by our letting conditions, we will process your application for consent. Please note, we are unable to accept faxes. All changes of correspondence address must be in writing to us, signed by all parties to the mortgage. It is your responsibility to ensure that we have the correct correspondence address for you to prevent any mail related to your mortgage going to an incorrect address. If you enter into a letting arrangement without our consent or, once our consent has been obtained, you fail to comply with our letting conditions at any time, you will be in breach of the terms of your mortgage and we may take any enforcement action which is provided for under those terms. Schedule of Letting Conditions: 1. The Property must be let as a whole and no alterations are to be made to allow it be let as separate selfcontained units. 2. Each and every tenancy agreement relating to the Property must: a) create an Assured Shorthold Tenancy in England and Wales, or if that is not possible because the annual rental income exceeds 100,000.00, you must instruct a Solicitor to review the tenancy agreement to ensure that our interest in the Property is protected, and our other requirements as set out in this consent are complied with; b) create a Short Assured Tenancy, and a Ground 2 Notice must be served on the tenant before the start of the tenancy, in Scotland; c) be (if the Property is in Northern Ireland) for a term certain stated in the tenancy agreement of not less than 6 months or more than 12 months or if the tenancy agreement creates a periodic tenancy the tenancy agreement provides for termination by the landlord on not less than 28 days notice but does not oblige the landlord to give more than 1 month's notice to terminate; not contain a clause extending or conferring an option to extend the term certain referred to above other than on terms which provide for termination of the tenancy agreement by the landlord on not less than 28 days notice but does not oblige the landlord to give more than 1 month's notice to terminate; and not create, extend or continue a tenancy which is:- i. a Restricted Tenancy either protected or statutory within the terms of the Rent (Northern Ireland) Order 1978; or ii. a Regulated Tenancy either protected or statutory within the terms of the Rent (Northern Ireland) Order 1978; or iii. a Protected Shorthold Tenancy within the terms of the Housing (Northern Ireland) Order 1983. d) be for between 6 and 12 months without any right to extend or option to renew; e) prohibit any sub-letting 3. If the Property is leasehold, you will obtain the consent of the landlord and any superior landlord, as necessary. 4. You and any agent you appoint will deal with any tenancy deposit in accordance with an authorised scheme, and will comply with all legislation which applies to the letting. Where the Property is in Scotland, this includes (but is not limited to) compliance with the requirements of the Antisocial Behaviour etc. (Scotland) Act 2004. 5. Where the Property is in England or Wales, it must not be a requirement for you to obtain a licence from a Local Housing Authority (for instance under a selective licensing scheme). You should take advice from your solicitor if you are unsure whether this applies to the Property. 6. The property must not be let as a House in Multiple Occupation. This means that: a) in England and Wales it must not be let to 3 or more tenants forming 2 or more households who share a kitchen, toilet or bathroom; b) in Scotland, it must not be let to 3 or more tenants who share a kitchen, toilet or bathroom (unless the tenants are members of only one or two families). c) in Northern Ireland, it must not be let to 2 or more tenants who occupy the Property as their only or principal place of residence (unless the tenants are members of only one or two families or there are no more than two tenants occupying the Property in addition to the owner and the owner's family). If you are unsure whether this condition applies to the Property, please contact your solicitor, letting agent or Local Housing Authority.
7. You will seek possession of the Property if we reasonably require you to. 8. If your mortgage forms part of the Help to Buy: mortgage guarantee scheme and you have applied for our consent to let by reason of the fact that you are in the armed forces and are undertaking a service posting in that capacity, the property may only be let for the period during which you are undertaking that service posting. 9. The payment of the Administration fee is detailed in the attached letter.
