EXPLANATION The applicant, Estes Investment, LLC ( Estes ), has filed a request for Zoning Map Amendment so that it can slightly expand the real estate that contains the Bill Estes Ford dealership ( Estes Dealership ) which is located south of and adjacent to I-74 and north of and adjacent to East Northfield Drive in Brownsburg. The Estes Dealership has been an important corporate citizen in Brownsburg and its business continues to grow. In order to accommodate its growing business, Estes is seeking to expand its vehicle display area on the western portion of the dealership site. The Zoning Map Amendment is only for the property that is outlined in yellow on the aerial photograph that is included behind Tab 2 (the Rezone Real Estate ). The Rezone Real Estate consists of approximately 1.38 acres and is located within a portion of Lot 5 in the Brownsburg Business Park. The Rezone Real Estate is currently zoned C1 Commercial. Estes is requesting a Zoning Map Amendment to rezone only the Rezone Real Estate to C2 Commercial so that Estes can utilize the Rezone Real Estate as part of the existing Estes Dealership site by expanding the vehicle display area to the west onto the Rezone Real Estate. The current C1- Commercial zoning would not allow for the proposed expansion of the vehicle display area. Therefore, the C2- Commercial zoning for the Rezone Real Estate is necessary to permit the expansion. Please refer to Tab 6 for information on how the rezone request addresses the considerations for a zoning map amendment request. In conjunction with Zoning Map Amendment request, Estes has also filed a Replat application to replat the Rezone Real Estate into the existing Estes Dealership site. The Estes Dealership site is located on Lot 7 in the Brownsburg Business Park and is approximately 6.5 acres in size. Approval of the Zoning Map Amendment and Replat application would result in the Estes Dealership site consisting of 7.88 acres with a zoning designation of C2-Commercial which is shown on the aerial exhibit behind Tab 3. In addition to expanding the vehicle display area to the west, Estes appeared before the Plan Commission on May 27th in regard to a Development Plan application for other site and building improvements. The Plan Commission unanimously approved Estes Development Plan application and that request related to the following: 1. Expanding the vehicle display area on the western portion of the site which is shown on the area highlighted in gray on site plan exhibit behind Tab 4, subject to the Town Council approving the Zoning Map Amendment for the Rezone Real Estate; 2. Adding an addition on the eastern side of the building that contains the car dealership service area to provide additional space for service bays which is shown on the area highlighted in yellow on the site plan exhibit behind Tab 4; 3. Reconfiguring the vehicle display area and parking areas, which is shown on the site plan exhibit behind Tab 4, to provide for improved site circulation and increased service parking capacity; Behind Tab 5 are the building elevations approved by the Plan Commission that depict the service area expansion on the eastern elevation of the building, as well as the addition of new service bay garage doors on the north and south elevation of the building expansion. The building materials and design for the expansion will be consistent with the building materials and design of the existing building. The proposed expansion to the site and building will allow Estes to accommodate its growing business and will improve and enhance the appearance of the overall site. Considerations for Zoning Map Amendment 1. The proposed zoning map amendment request is consistent with the goals, objectives and policies of the Comprehensive Plan Compliance Statement: Estes Investments, LLC ( Owner ) is the owner of the real estate that contains the Bill Estes car dealership. The Bill Estes car dealership has operated in the Town of Brownsburg since approximately 1999 and attracts customers from the Town of Brownsburg, as well as customers from the general region. The Comprehensive Plan was recently updated in 2012. The parcels that are the subject of the Owner s development plan, re-plat and rezone request are located within Research & Development/Motorsports designation of the Comprehensive Plan and near Regional Commercial area designations. The Owner is proposing to rezone a portion of Lot 5 in Brownsburg Business Park, Section 13 which is currently zoned C1 to C2 to allow for the expansion of a vehicle display area on the western portion of the existing dealership site. The Owner is also proposing a building expansion to the existing building to accommodate its growing business and is proposing other site improvements, pursuant to its development plan application. The development plan that the Owner has filed will enhance the appearance of both parcels that are the subject of the zoning requests, which in turn will achieve the goals and objectives of the Comprehensive Plan by improving the appearance and function of the existing Bill Estes dealership and site. The building addition and other site improvements will enhance the appearance and function of the building and the site, thereby achieving other important goals and objectives of the Comprehensive Plan. 2. The proposed zoning map amendment request is compatible with current conditions and overall character of existing development in the immediate vicinity: The zoning map amendment request seeks to rezone a portion of Lot 5 from C1 to C2 so that the zoning classification for the portion of Lot 5 that will contain the expanded vehicle display area is consistent and compatible with the underlying zoning of C2 for the car dealership parcel; and, as a result, the request is compatible with the current conditions and the overall character of existing development in the immediate vicinity. 3. Whether the proposed zoning map amendment is the most desirable use for which the land in the subject is adapted: The zoning map amendment request seeks to rezone a portion of Lot 5 from C1 to C2 so that the zoning classification for the portion of Lot 5 that will contain the expanded vehicle display area is consistent with the underlying zoning of C2 for the car dealership parcel. The request is most desirable use for which the land is adapted because it will allow the car dealership site to adequately address its growing business.
4. Will the proposed zone map amendment have an adverse effect on the value of properties throughout the jurisdiction: Approval of the zone map amendment request will not have an adverse effect on the value of the properties throughout the jurisdiction because the zoning classification that the applicant is seeking is consistent and compatible with the zoning classifications that surround the subject site. 5. Whether the proposed zone map amendment reflects responsible standards for development and growth: Approval of the zone map amendment request will reflect responsible standards for development and growth because it will allow Estes to utilize the existing site and will also allow Estes to expand its site and building to accommodate its growing business.
