Full Name of Student (Print): SSN (Required): F STUDENT UNDER THE AGE OF 21: Full Name of Guardian (Print): SSN (Required): RESIDENTIAL RENTAL AGREEMENT This Residential Rental Agreement ("AGREEMENT") is between Gamma Alumni of Alpha Kappa Lambda, Inc., undersigned parent or guardian is jointly and severably liable for all expenses within this contract, including collection costs and reasonable attorney fees. The parties agree that this Agreement shall be deemed executed in the State of Illinois and construed in accordance with and gov respective state of residence. The parties further consent to the jurisdiction of the State of Illinois and that proper venue shall lie in the applicable federal or state courts located in the County of Cook, State of Illinois. The parties acknowledge that the foregoing consent to jurisdiction and venue clause will cause neither party to suffer any undue inconvenience and was equally bargained for. AGREEMENT 1. Tenancy. Member hereby hires from the Fraternity and the Fraternity hereby rents to Member a room in the structure located at 401 E Daniel St, Champaign, Illinois conditions set forth in this Agreement. This Agreement permits the occupancy of the Leased Premises by Member. 2. Room and Board Amounts. If paid in full by 08/01/11, there is a $100 discount on single occupancy and discount on double occupancy. a. Single occupancy, $11,750 b. Double occupancy, $10,500 c. The AKL Educational Foundation will provide first time AKL Gamma members in 2011 an ADDITIONAL one-time $1000 scholarship check made out to the member and the University of Illinois to be paid to the University at the beginning of the second semester when tuition and fees are due. Thus the cost of Room & Board for the entire 2011-2012 school year will be $10,750 for single occupancy or $9,500 for double occupancy. (Available to new members completing the first semester who have a GPA ). d. Please refer to page 5 of this contract for payment scheme details. 3. Meal Plan. Rent includes 16 meals per week served in the House Dining Room. Breakfast is available everyday and lunch is available Monday through Friday during specified hours. Dinner is available Monday through Thursday during specified hours. 4. Term. The term of this Agreement shall be for the 2011 2012 academic year, commencing on August 15, 2011 and ending on MAY 15, 2012. The Fraternity agrees to provide lodging and meals to the Member for the duration of this Agreement. a. All Active members are required to maintain a minimum 2.5 GPA each semester of their membership. If a member fails to maintain a 2.5 during a semester, he shall be required to submit a plan to the Corporation Board to increase his GPA during subsequent semesters. If a member fails to submit a plan or his GPA falls below 2.5 for two consecutive semesters, he will not be allowed to live in the house the following semester. Members failing to meet these standards may make an appeal to the Corporation Board. The Corporation Board, at its sole discretion, may issue a written waiver of the minimum GPA requirement. 5. Fees. Member agrees to pay the Fraternity the amounts stated in the att times and in the amounts stated in the Schedule. 6. Finance Charge. Interest at the rate of eighteen percent (18%) per annum shall accrue on any amount past due. Member further agrees to pay $50.00 for each dishonored bank check issued by Member to the Fraternity. 7. Security Deposit. Member, upon signing this Lease, shall pay to FRATERNITY a deposit for $900 to secure SECURITY DEPOSIT SHALL NOT BE DEEMED CONSTRUED AS PAYMENT OF RENT F ANY MONTH OF THE LEASE TERM. Member hereby waives any requirement that FRATERNITY maintains any escrow e security deposit. Upon agreements the security deposit or any remaining unapplied portion shall be returned to Member. In accordance with this Lease, certain basic charges will become immediately due and payable at termination, in connection with bringing the premises into compliance with the terms as provided in this Lease. This deposit shall be held by FRATERNITY to be applied against any damage which occurs to the room that the Member occupies while living Member resides in the room or at the end of his occupancy, or with respect to any damage directly caused by the Member to any property of the Fraternity or FRATERNITY. 8. Other Fees. Member further agrees to pay any fines or additional reasonable charges which may be incurred by him and charged to the Fraternity in his behalf or which may be levied against him in accordance with the rules and regulations of the Active Chapter or the Fraternity. Such may include, but are not limited to, charges for events, tickets, clothing and similar items, fines, damage deposit, damages to person or property and necessary assessments to complete and fulfill Active Chapter payment obligations to the Fraternity as provided in the budget of the Fraternity and the Active Chapter. 9. Membership in Alpha Kappa Lambda. The Leased Premises are primarily intended for use by Active, New and Affiliate members of Alpha Kappa Lambda fraternity. The Fraternity may, at is sole discretion, rent to individuals not affiliated with Alpha Kappa Lambda. Tenancy does not imply affiliation with Alpha Kappa Lambda. 10. Room Assignment. Room assignments will be governed by the Fraternity in consultation with Active members. The Member will accept and retain the room assigned to him. The Fraternity retains the right to move or reassign Member to other such assigned rooms as may be required during times of repair or construction in its sole discretion without compensation. 11. Compliance with Rules, Regulations and Bylaws. Member agrees to observe the rules, regulations, bylaws, and codes of conduct and other governing documents of the National Fraternity, the Chapter, the Corporation Board, the Fraternity and the University of Illinois. 12. Grade Release. The member will voluntarily provide midterm, estimated 12 week and final grades to the Mentor in Residence, Scholarship Chair and the Alumni Academic Review Committee for confidential review and consultation, if required, as GPA is a critical element in the 5 Ideals of AKL and regular, voluntary communication to all stakeholders (man, parents, brothers, select alumni) is critical to the University education mission of the individual and Gamma Chapter of Alpha Kappa Lambda. 13. Compliance with Law/Nuisance. Member shall comply with all laws, statutes, ordinances and requirements of all local, state and federal authorities now in force or which may hereafter be in force, in any way related to such person's use of the Leased Premises. Member shall not create any nuisance or be responsible for any action or inaction which, in the Fraternity's reasonable opinion, is offensive, disturbing, or bothersome to the Fraternity's other members, the neighbors or the general public. Member acknowledges that any breach of the provisions of this Paragraph would be a material default not capable of being cured. 14. Drugs and Firearms. Member shall not possess or be under the influence of illegal drugs in or near the Leased Premises. Neither shall Member possess illegal firearms or weapons in or near the Leased Premises. Member may retain legal firearms or weapons provided they are, at all times, kept in a secured and locked location designated by the Chapter. 15. Assignment and Subletting: Member shall not assign this Agreement or sublet any portion of the Leased Premises. Any purported assignment or subletting shall be voidable at the Fraternity's election and shall constitute a material default of this Agreement. The Fraternity's acceptance of rent from any purported assignee or subtenant shall not be deemed a waiver any of the Fraternity's rights under this Agreement, nor shall the object to any assignee or subtenant be deemed a waiver of t object to such assignee or subtenant or any other assignee or subtenant. If the Fraternity assigns its interest in this Agreement to a subsequent purchaser of the Leased Premises, the Fraternity shall be relieved of all liability Page 2 of 5

under this Agreement. In all events, t value of t 16. Pets. The Fraternity does not allow pets on Leased Premises. Member shall not board or maintain animals in private quarters or common areas. This includes, but is not limited to dogs, cats, and fish tanks over 20 gallons. Member agrees to pay a fine of $25 for every day, or part of a day in which said Member is found to be in violation of the provisions of the Paragraph. Member acknowledges that repeated breach of the provisions of this Paragraph would be a material default not capable of being cured. Member acknowledges liability for any property damages to the Leased Premises caused by an animal in his care. Member further acknowledges liability for any property damages to the Leased Premises caused by a malfunction of equipment related to the maintenance of an animal in his care. 17. Maintenance, Repairs or Alterations. Member acknowledges that the Leased Premises and the common areas are in good order and repair. Member shall maintain the Leased Premises in a clean and sanitary manner, and shall surrender the same, upon expiration or termination of this Agreement, in as good condition as received, normal wear and tear expected. The Fraternity will make any repairs or improvements to the Leased Premises as it deems necessary and appropriate, which may require the surrender or reassignment of assigned rooms to carry Member shall be responsible for all damage to the Leased. Member shall not commit any waste upon the Leased Premises. 18. Damages to Premises. In the event said premises shall be so injured by fire, casualty, acts of God or any other reasons as to be rendered untenantable, FRATERNITY may at its option terminate this lease or repair the premises within 30 days and failing to do so, or upon the destruction of the premises, this agreement shall terminate. FRATERNITY further agrees to furnish Member with an estimated date of repair within 14 days of the date of destruction. During time premises are uninhabitable, Member a. No painting, remodeling, rewiring or building changes allowed. Nothing will be permanently installed in any room or location in or on the property. All picture hooks will be removed. All related repairs will be of the highest quality and inspected by the Fraternity. The cost of subsequent follow-up repairs and/or corrections will be deducted from damage deposits. 19. Release and Indemnification. Member shall be responsible for insuring the personal property of Member and Member's guests located on or about the Fraternity's real property. Member hereby waives and releases to the fullest extent possible any future causes of action or claims against the Fraternity or the Fraternity's agents based upon the damage or destruction of any such personal property no matter what the cause (including the negligence of the released party) and Member waives any rights of subrogation against the Fraternity or the Fraternity's agent on the part of Member and Member's insurers. The Fraternity shall not be liable for any injury or death of Member, or any other person, occurring on or about the Fraternity's real property, or any part thereof, except to the extent such injury or death is the proximate result of the gross negligence or illegal act of the Fraternity, or the Fraternity's agents. Member agrees to indemnify, defend and hold the Fraternity harmless from and against any claims or liability for damages to property or injury or death of persons except for such damages, injuries or deaths for which the Fraternity is expressly liable under the terms of this Paragraph. 20. Entry and Inspection. The Fraternity shall have the right to enter the Leased Premises: (a) in case of emergency; (b) to make repairs, alterations, improvements as the Fraternity deems necessary or desirable; (c) to supply necessary or agreed services; (d) to exhibit the Leased Premises to prospective or actual purchasers, mortgagees, tenants, workmen, or contractors; and (e) if the Fraternity believes that Member has abandoned or surrendered the Leased Premises or has otherwise breached this Agreement. Member further agrees that the Fraternity or its representative may make periodic inspections, with no notice, to assure compliance with provisions of this deemed a Default and cause for eviction. 21. Termination. The Fraternity reserves the right to terminate this Agreement in the event the undersigned Member shall at any time fail to observe the rules, regulations, bylaws, codes of conduct and other governing documents of the National Fraternity, the Chapter, the Corporation Board, and the University of Illinois or any local, state, or federal law or regulation as reviewed by the Executive Board of the Active Chapter and/or the Corporation Board of the Fraternity. The contract may be terminated at the semester break by the Corporation Board, or not offer for renewal for the following school year, for conduct unbecoming of a man or the men of AKL (personal conduct policy); violation of the Honor Code; failure to follow Active Chapter administrative rules created during the semester for the benefit of the then Active Page 3 of 5

membership; participation in Active Chapter activities; and encourage thru word and deed of the 5 ideals and overall operation of Gamma during the time an individual has been offered full participation in and with the current Active chapter membership of AKL. 22. Contract cancellation. Alpha Kappa Lambda has a reciprocal agreement with the University of Illinois Housing Division. New, first time attending undergraduate UIUC students who first arrive on campus for Fall 2011 or Spring 2012 semester and who have a contract with Alpha Kappa Lambda may cancel their housing contract with Alpha Kappa Lambda without penalty to contract with the University of Illinois Housing Residence Halls any time through August 18, 2011 for the Fall semester 2011 and through November 15, 2011 for the Spring semester 2012, provided they meet established criteria for release. Returning undergraduate UIUC students who were on campus before Fall 2010 may cancel their 2011-2012 contract with Alpha Kappa Lambda without penalty through May 15, 2011, and move to the University of Illinois Residence Halls for Fall semester 2011, or November 15, for Spring semester 2012, provide they meet established criteria for release. 23. Default. In the event Member fails to pay rent or any other sums payable under the terms of this Agreement when due, Member shall be in default of this Agreement. In the event of such default, then three days after written notice is given to Member, the Fraternity may terminate all rights of Member and require Member to vacate the Leased Premises, unless Member, within said three day period, pays such delinquent rent or other sums in full. If Member fails to perform any obligation under this Agreement other than an obligation to pay money, Member shall be in default of this Agreement. In the event of such nonmonetary default, the Fraternity may terminate all rights of Member and require Member to vacate the Leased Premises; provided, however, that if such nonmonetary default is one that is capable of being cured by Member, the Fraternity shall have no right to terminate this Agreement or require Member to vacate the Leased Premises on account of such nonmonetary default unless Member's failure to perform continues for more than three days after written notice is given to Member. If default in any payment, charge, fine or assessment shall remain at the end of any semester, the Fraternity may refuse to provide lodging and meals to Member for any subsequent semester. 24. The Fraternity's Remedies. In the event of a default by Member, the Fraternity may, in addition to pursuing any other remedies now or hereafter available to the Fraternity, elect to (a) continue the Agreement in effect and enforce all the Fraternity's rights and remedies hereunder, including the right to recover the rent as it becomes due, or (b) at any time, terminate all of Member's rights hereunder and recover from Member all damages the Fraternity may incur by reason of Member's breach of the Agreement. Following any termination of this Agreement, the Fraternity shall have the right to enter and regain possession of the Leased Premises and exclude Member there from, without resort to legal proceedings, to the fullest extent allowed by law. 25. Attorney's Fees. If the Fraternity retains the services of an attorney to enforce Member's obligations under this Agreement, whether or not legal proceedings are instituted or prosecuted to judgment, Member shall reimburse the Fraternity for any attorney fees or related costs reasonably incurred by the Fraternity. 26. Collection Agency. The Fraternity reserves the right to retain a collection agency to assist in the collection of any unpaid amounts owed under this Agreement. 27. Waiver. No failure of the Fraternity to enforce any obligation of Member shall be deemed a waiver of that obligation nor shall acceptance of full or partial payment of rent be deemed a waiver of the Fraternity's right to receive full performance of Member's obligations as set forth in this Agreement. 28. Notices. Any notice which either party may give, or is required to give, including notices of default, may be given by electronic mail or by mailing the same to Member at the address of the Leased Premises or to the Fraternity at the address where rent payments are to be sent, or at such other places as may be designated by the Fraternity from time to time. 29. Storage. Member agrees not to use the exterior of the buildings on Leased Premises as storage areas without prior written approval of the Fraternity. 30. Entire Agreement. The foregoing constitutes the entire Agreement between the parties and may be modified only by a writing signed by both parties. This Agreement may be executed in counterparts which when assembled shall constitute a single original document. Any party may transmit their signature on this Agreement by facsimile machine and the same shall constitute an original signature for all purposes. Page 4 of 5
