Sila pastikan bahawa kertas peperiksaan ini mengandungi SEPULUH muka surat yang tercetak sebelum anda memulakan peperiksaan ini. Students are allowed to answer all questions either in English OR in Bahasa Malaysia only. Pelajar dibenarkan menjawab semua soalan dalam Bahasa Inggeris ATAU Bahasa Malaysia sahaja. With the help of a flow chart, advise him on the process of land amalgamation before the land can be developed. En. Optimis memiliki 2 keping tanah yang bersebelahan; Lot 45 seluas 2 ekar dan Lot 47 seluas 10 ekar di Bandar Tiadanama. Jelaskan kepada beliau maksud penyatuan tanah. Dengan bantuan cartalir, nasihatkan beliau proses penyatuan tanah yang perlu beliau lalui sebelum tanah tersbeut boleh dibangunkan. Define Tenancy and Lease. Definisikan Sewaan dan Pajakan (5 marks/markah) (c) Discuss two (2) main differences between tenancy/lease and licensee. Bincangkan dua (2) perbezaan utama antara sewaan/pajakan dengan pemegang lesen. 2. (a) Under the Torrens system, Registration is everything. With the support of cases decided by the court, discuss the importance of registration to a land owner. Di bawah Sistem Torren, Pendaftaran adalah segala-galanya. Dengan sokongan kes-kes yang diputuskan oleh mahkamah, bincangkan kepentingan pendaftaran kepada pemilik tanah. (a) What are the course of actions available to a dominant owner if the servient owner does not comply with the requirement of the easements and describe the three (3) ways easements is terminated? Apakah tindakan yang boleh diambil oleh pemilik dominan jika pemilik servien ingkar mematuhi kehendak isemen dan nyatakan tiga (3) cara sesuatu isemen itu tamat? (5 marks/markah) Easements and right of way are two rights enjoyed over land of others. State the difference between easements and land administrator s right of way. Isemen dan hak lalulalang adalah dua hak yang berkaitan manfaat ke atas tanah milik orang lain. Berikan perbezaan di antara isemen dan hak lalu-lalang pentadbir tanah. (15 marks/markah) (c) State the rights of land owners on his land as stated in Sec 92(2) and Sec 44 National Land Code 1965. Nyatakan hak pemilik tanah keatas tanahnya seperti yang terkandung dalam Sek 92(2) dan Sek 44 Kanun Tanah Negara. (5 marks/markah)...4/-

Apakah syarat tersirat untuk pajakan seperti yang dinyatakan didalam Sek. 231, Kanun Tanah Negara 1965? (5 marks/markah) What are the differences between express conditions and implied conditions and state the implied conditions for building land and agricultural land as stated in the Ninth Schedule, National Land Code 1965. Apakah perbezaan antara syarat nyata dengan syarat tersirat dan nyatakan syarat-syarat tersirat untuk tanah bangunan dan tanah pertanian seperti yang disenaraikan didalam Jadual Kesembilan, Kanun Tanah Negara 1965. (c) List all types of land title as provided in the National Land Code 1965 and state the differences between Final Title and Qualified Title. Senaraikan semua jenis hakmilik tanah; seperti yang diperuntukkan dalam Kanun Tanah Negara 1965 dan nyatakan perbezaan diantara Hak Milik Tetap dan Hak Milik Sementara. 5/-
