MINUTES Planning Commission The Planning Commission of the Parish of Ascension held a Public Meeting on Wednesday, at 6:00 p.m. in the Courthouse East Meeting Room, Gonzales, Louisiana in regular session convened: I. Meeting Called to Order by Chairman. Chairman Alan Krouse called the meeting to order. II. Swearing In of New Commission Member Commission Action: Mr. made a motion, on behalf of the Planning and Zoning Commission, to include on this agenda the swearing in of a new Commissioner. Mrs. Sherri Sliman seconded the motion and was carried by unanimous vote. At this time Ms. Toni Falterman, Legal Counsel, swore in Mr. Howard Dalton as a new member to the Planning and Zoning Commission. III. Gregoire Property Lots C-1 and C-2 The subject property is located on the north side of Hwy 937 approximately 1,200 east of Pourrier Road, is zoned Rural and is located in Council District 6. The application is on behalf of Helen Gregoire by W.J. Cointment Surveyors. The owner of this 1.5 acre property proposes to convey 1.0 acre (Lot C-2) to her son, Benny Gregoire, while retaining the front 0.50 acre (Lot C-1) fronting on Hwy 937 for herself. The owner s existing residence is on the front 0.50 acre. The owner s son currently resides in a mobile home located on the back 1.0 acre. Both lots will have access from Hwy 937 via an existing 20 servitude of passage on the east boundary of the property. Cointment Surveyors appeared to present this family partition. Mr. Nance questioned Mr. Cointment as to when the barn was going to be removed. Mr. Cointment stated the applicant is in the process but the weather has delayed the removal of the barn and fence. Mr. questioned whether the comment from the Department of Health, and maintained, had been added to the reference note for the drainage ditch. Mr. Cointment stated that he put the same note as he always had. Mr. Ben Laurie, Staff Engineer, said our standard note doesn t have and maintained included, therefore isn t required. Mrs. Sherri Sliman expressed she does not agree with the staff s recommendation to approve this family partition. She said she knows changes are in the process of being made but, at this time, the letter of the ordinance would not allow this with there being only one drive servicing both lots and according to the ordinance, only one driveway can service one residence. Mr. Laurie clarified that the ordinance states that one 20 private servitude of access can only service one lot and it is only servicing Lot C-2. Mr. Ricky Compton further explained that Lot C-1 has frontage on a public road and, in his interpretation, does not need a servitude to serve it, it has access on the public road. Mrs. Sliman s expressed it is her interpretation of this that this servitude of passage is servicing two residences and states the Commission has, in the past, held applicants to this and if changes are to be made, she thinks it first needs to be changed in the ordinance. She said it should not be used before the change is made as she feels the Commission is giving preferential treatment to some. Mrs. Sliman stated this issue will be added to the next Sub-Committee meeting s agenda.

He said there is a note on there that requires the homeowner to install a ditch if needed. If at that time it serves more than just that homeowner, then a drainage servitude could be dedicated. The owner is seeking a variance to reduce the rear building line for Lots 31-44 from 20 to 10. The preliminary plat was submitted on behalf of Woodgate Properties, LLC by GWS Engineering, Inc. Public Hearing for Granting Final Approval to the Following Subdivision: A) Ascension Commerce Center 1 st Filing The subject property is located at the end of the existing segment of Industrial Drive on the north side of Hwy 30. The submitted plat documents the public dedication of an extension to Industrial Drive. The submitted plat was prepared for LJ Grezaffi by Alvin Fairburn & Associates. (Council District 3) The public dedication encompasses approximately 1,400 LF of 60 right of way. Situated in the right of way is a concrete roadway with curb and gutter constructed to Parish Standards. The existing portion of Industrial Drive was previously accepted into the Parish maintenance system. 1) Correct 50 building line callout. Comment addressed. 2) Show building line both sides of road. Existing encumbrances and setbacks are shown as created in previous plats. 3) What is 140 building line from/for? 140 line was included on the plat for the two lots shown with the setback. She said there is very little attendance at the Subdivision Sub-committee and Zoning Subcommittee meetings and therefore, will try something new. They will begin meeting the last Friday of each month, with the Zoning Sub-committee meeting at 8:00 a.m. and the Subdivision Sub-committee following at 9:00 a.m. B) Strategic Planning Committee Mr. Ricky Compton expressed that the Strategic Planning Committee hasn t had a lot of new ideas brought to the Planning Commission. He said there are about a half dozen items from the Planning Commission that he will bring to Strategic Planning and from there, Strategic Planning will send to the Council. Mr. Compton feels there is no need to have Strategic Planning Committee on our agenda in the future. XII. Old Business A) Larry F. Jumonville Property Lots 3-A-1, 3-A-2 and 3-A-3 FAMILY PARTITION Situated on the south side of Rogers C Rd and fronting on Jumonville Drive for Larry F. Jumonville by Earles & Associates, LLC. Designation of industrial areas; feasibility; assistance by state agencies Subject to the written approval of fifty-one percent in interest of the landowners of the proposed industrial area, parish governing authorities may establish industrial areas composed of territory wholly within the parish boundaries and without the boundaries of any municipality. Such areas may be designated only after the feasibility therefore has been established by land use studies conducted by parish planning commissions, parish development boards or other similar recognized authorities. Cooperation and assistance in the preparation and evaluation of such studies may be rendered by state agencies equipped to conduct such studies when requested to do so by any parish governing authority provided that where municipal boundaries are co-extensive with parish boundaries, the municipal governing authorities may establish industrial areas within the municipal boundaries. Page 18, 2009 C) Donaldsonville Technology and Industrial Park, First Filing FINAL SUBDIVISION PLAT Located at Chef John Folse Boulevard southeast of LA Highway 70 for The Industrial Development Board of City of Donaldsonville by GWS Engineering, Inc. (Council District 2) The preliminary plan for the industrial subdivision was approved on September 13, 2006. The preliminary approval was extended for one year by the Planning Commission on April 8, 2009. This development is located in the Industrial Zoning district and will have a total of 28 lots having an average size of 240 x 365. Final approval of this First Filing is now being requested. This filing consists of a 648 ± section of Chef John Folse Boulevard and four tracts. All lots in this subdivision are tying into the Donaldsonville sanitary sewer system. The street has been built to the required commercial street construction standards. Lot 2 will be a street in a future filing. 1) Indicate the frontage on Chef John Folse Boulevard for Tract A. Dimensions added. 2) Show the location, description, elevation and datum of the permanent benchmark. Benchmarks added. 3) Are there any building setback lines across the fronts of any of the lots? Mr. Brandon Acosta with GWS Engineering, Inc. appeared to present this final subdivision plat. Mr. Acosta explained that their firm has prepared the final plat to this subdivision. He stated he is not authorized to answer any questions on the road or the construction design of the road. He said there is a representative from GSA here tonight if there are any questions in regards to that. Mr. Ben Laurie stated a maintenance bond is in place which will protect the Parish from any road failure prior to the parish accepting it into the road maintenance system. Also, a hold harmless agreement has been reviewed and approved by legal for the Parish regarding the sewer treatment plant that is in the right-of-way.
