CITY CLERK Clause embodied in Report No. 4 of the, as adopted by the Council of the City of Toronto at its meeting held on May 21, 22 and 23, 2002. 11 Final Report Zoning By-law Amendment Application TF ZBL 2001 0019 Han-Len Holdings Inc., 4150 Finch Avenue East Employment Districts Zoning By-law (Milliken) (Ward 41 - Scarborough Rouge River) (City Council on May 21, 22 and 23, 2002, adopted this Clause, without amendment.) The, after considering the deputations and based on the finding of fact, conclusions and recommendations contained in the report, dated April 5, 2002, from the Director of Community Planning, East District, recommends that the report of the Director of Community Planning, East District, be adopted. The reports having held a statutory public meeting on May 7, 2002, and that notice was given in accordance with the Planning Act. The submits the following report (April 5, 2002) from the Director of Community Planning, East District: Purpose: This report reviews and recommends approval of an application to amend the Zoning By-law to permit a car rental and leasing operation with ancillary minor vehile repair, vehicle washing and open storage of vehicles at 4150 Finch Avenue East. Financial Implications and Impact Statement: FINCH AVENUE There are no financial implications resulting from the adoption of this report. Recommendations: PETWORTH CRES BAYLAWN DRIVE MIDLAND AVENUE It is recommended that City Council: 4150 Finch Avenue (1) amend the Employment Districts Zoning By-law 24982 for the Milliken Employment District substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 4; and
2 (2) authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required. Background: Proposal Hertz Rent-a-Car has acquired the Economy Rent-a-Car operation and is seeking to continue to use the site for vehicle rental and leasing purposes. This application is for a site specific rezoning which permits vehicle rental and leasing and ancillary minor vehicle servicing, maintenance and washing. The proposal also seeks the outside storage of vehicles which would be limited to the rear of the site. Ancillary minor vehicle servicing, maintenance operations and vehicle washing is to be contained within the rearmost buildings. Only the administrative rental office and client parking will be situated at the south end of the site, along the Finch Avenue frontage. The existing buildings on the site are to be renovated to service the Hertz needs. Site and Surrounding Area The flat, 5057 square metre (1.25 acre) site, contains two existing buildings that will be retained and renovated as part of this application. To the east of the site is an existing office building and to the west of the site is an existing multiple unit industrial building. To the rear of the site is an old industrial building. To the south of the site and situated on the south side of Finch Avenue, is an existing portion of the residential community of Agincourt North. Official Plan The site is designated General Employment in the Milliken Employment District Secondary Plan to which this application would conform. Zoning By-law 24982 The property is zoned M Industrial under the Employment Districts Zoning By-law 24982 (Milliken). The uses permitted are to be conducted wholly within an enclosed building and are limited to: - Day Nurseries; - Educational and Training Facility Uses; - Industrial Uses; - Offices, excluding Medical and Dental Offices; - Places of Worship; and - Recreational Uses. The abutting properties to the east and west are zoned CC - Community Commercial and E - Mixed Employment.
3 Site Plan Control The property is subject to Site Plan Control Approval. At the time of writing, the applicant has submitted the necessary plans for site plan control review, which should be completed shortly. Reasons for Application The present zoning does not permit the use of the property for a vehicle rental and leasing operation, nor does it permit ancillary minor maintenance of the vehicles, vehicle washing or open storage of vehicles. Community Consultation No additional community consultation was undertaken. Agency Circulation The application was circulated to all appropriate agencies and City Departments. Responses received have been used to assist in evaluating the application and to formulate appropriate by-law standards. Comments: No changes where requested by agencies as a result of the circulation. Comments received for the site plan circulation were minor in nature and addressed design matters with the easterly driveway and closure of the westerly driveway. Recognizing the City s wish to maintain an attractive and functional streetscape, the applicant has agreed that the proposed zoning by-law in association with the site plan control impose performance and design requirements that would implement the following: (a) (b) (c) (d) retain all outdoor storage of vehicles away from the street frontage and screened from Finch Avenue; permit only the administrative office and temporary client parking to occur at the front of the site; permit ancillary minor vehicle maintenance and wash to occur within enclosed buildings behind the administrative building; provide additional landscaping along the Finch Avenue frontage of the property. Conclusions: The application formalizes an activity that has existed in this area for many years without issue or complaint. The use requested is appropriate for the site and is in keeping with the types of
4 uses that would be anticipated to locate on arterial roads and in locations such as 4150 Finch Avenue East. The following persons appeared before the Community Council in connection with the foregoing matter: - Mr. Joseph Virgilio, Solicitor for 1432827 Ontario Inc., the abutting owner to the west, indicating his client s objection to the proposed use, particularly with respect to the automobile repair and car wash aspect of the operation, suggesting that the use is not compatible with the area and requesting that if this proposal is approved, that his client have the opportunity to participate in any site plan process to ensure adequate buffering between the properties; and - Mr. Richard Drosnes, the applicant, on behalf of Hertz Rent-a-Car Canada, in support of the staff recommendations; and indicating with respect to the concerns expressed regarding automobile repair and car wash uses, that it is the intention of his client to simply carry out routine minor maintenance and washing of returned vehicles, between rentals, as is the norm with all car rental agencies. CITY OF TORONTO BY-LAW No. ~-2002 Attachment 4 To amend Scarborough Employment Districts Zoning By-Law No. 24982, as amended, with respect to the Milliken Employment District. WHEREAS authority is given to Council by Section 34 of the Planning Act, R.S.O. 1990, c.p. 13, as amended, to pass this By-law; and whereas Council of the City of Toronto has provided adequate information to the public and has held at least one public meeting in accordance with the Planning Act; Therefore, the Council of the City of Toronto enacts as follows:
5 1. SCHEDULE "C", EXCEPTIONS LIST, is amended by adding the following Exception No. 447 to lands outlined on Schedule "1": 447. On those lands identified as Exception No. 447 on Schedule "2" the following shall apply: Additional Permitted Uses Ancillary Uses Vehicle rental and leasing - Open storage of vehicles in conjunction with a vehicle rental and leasing operation. - Minor vehicle repair and washing in conjunction with a vehicle rental and leasing operation. Parking A maximum of 3 parking spaces shall be permitted in the front yard. 2.
