MINUTES OF THE ZONING BOARD OF ADJUSTMENT MEETING FEBRUARY 28, 2017. 1. Call to order: Meeting called to order at 6:04 PM by Terry Fox. 2. Invocation: Terry Fox provided the invocation. 3. Roll Call; Board members present: Terry Fox, Roy Lee Nichols, Kevin Kenny (arrived at 6:09 PM) and Reese Knight. 4. Discussion, consideration, action, if any re: Approve minutes from November 22, 2016. Following a brief discussion by the Board, Reese Knight motioned to approve minutes as written. Roy Lee Nichols seconded this motion. Voting in favor: Fox, Nichols, and Knight. There were no opposing votes and motion carried. 5. PUBLIC HEARING: Conduct a public hearing and consider a variance requested to property located at 1401 Linnet, Official Public Records of McLennan County, Texas, Block 3 Lot 3 Lux Addition. The variance sought is for accessory set back. The Public Hearing was opened at 6:05 PM. Barry Lightfoot, Interim Planning Director, provided the Board with a brief overview of the variance requested. Applicant Douglas Smith, 1401 Linnet, Robinson, Texas 76706, spoke in favor of the variance and respectfully requested approval. After no additional comments, the Public Hearing was closed at 6:09 PM. Following a brief discussion by the Board, Reese Knight motioned to approve the variance request as presented. Terry Fox seconded this motion. Voting in favor: Fox, Nichols, Kenny and Knight. There were no opposing votes and motion carried. 6. PUBLIC HEARING: Conduct a public hearing and consider a variance requested to property located at 5198 Loop 340, Official Public Records of McLennan County, Texas, OCAMPO C 2.88 Acres. The variance sought is for the masonry requirements. The Public Hearing was opened at 6:13 PM. Barry Lightfoot, Interim Planning Director, provided the Board with a brief overview of the variance requested. Mr. Lightfoot stated the applicant was not in attendance for the meeting. After no additional comments, the Public Hearing was closed at 6:15 PM. Following a brief discussion by the Board, this item failed due to lack of motion. 7. Board member comments on agenda items set out above and requests for items to be placed on future agendas. Case Summary: The applicant has submitted a request for a variance to the front yard setback to allow the encroachment of the existing residence that was constructed in 2002. Current Zoning: R-1 Project Analysis: The location of the property is south of W. Moonlight Drive and east of Hillside Drive. The existing residence is oriented to Hillside Drive and encroaches as much as 2.9 feet into the minimum 25-foot front yard building setback. The survey provided by the applicant shows a 35-foot building line; however, the zoning ordinance only requires a minimum 25- foot front yard building setback.
