Purpose Consideration of the City s support of the Texas Department of Housing and Community Affairs (TDHCA) 9% low-income housing tax credit financing pursuant to subsection 50.5(a)(7) (A) and (B) of the Qualified Allocation Plan for the City Walk at Akard; Authorize a $750,000 Community Development Block Grant loan from the Residential Development Acquisition Loan Program; and Express the intent to use up to $1,000,000 in future General Obligation Homeless bond funds for the purpose of acquiring a long-term leasehold interest in 50 units 2

Background City Walk at Akard Rehab (Council District 14) The Project fits priority No. 2 under the current policy adopted on January 11, 2006 which is rehabilitation of an existing property This project must still compete for state funding following City Council approval The 9% 2006 tax credits will be awarded in July, 2006 6 to 7 projects will be funded in this Region Based on preliminary scoring, this project is ranked 16 th The project will contain a 20% retail component consisting of one floor of retail and two floors of office space The City Walk at Akard is the only Texas Department of Housing and Community Affairs Project 9% applicant to apply for the City of Dallas multifamily pre-application waiver and Council Resolution for support of project approval 3

Market Analysis (Cont d) HISTORYOF TAX CREDIT PROJECTS 118 Projects with 21,184 Units completed, under construction, or commencing construction pending closing since 1988 101 Projects with 18,088 Units are completed 12 tax credit projects consisting of 2,368 units are currently under construction in the City of Dallas 5 Projects with 728 Units are waiting to close on their construction loans Includes projects with bonds issued by DHFC, TDHCA and DHA 8

Market Analysis Competing Projects Currently 12 tax credit projects consisting of 2,368 units are currently under construction in the City of Dallas There are no projects within one mile of this project that have received tax credits within the last three years The property is located in Downtown Dallas with the nearest tax credit projects approved within the last three years being Frazier Fellowship, Wahoo Frazier, Mill City Park (all replacement housing developed by the Housing Authority) and the Rosemont at Meadow Lane (also replacement housing of the Emmanuel Village Apts.) These projects are located approximately four miles away from the City Walk at Akard Frazier Fellowship, Wahoo Frazier and Mill City Park are not in lease-up yet. Rosemont at Meadow Lane is currently 89% occupied Intown Housing reported occupancy of 94.5% in 4th Quarter 2005 9

City Walk at Akard Description 511 North Akard, Council District 14 209 unit existing multifamily project 132 studio apartments, 75 one-bedrooms and 2 two-bedrooms 21 units for households at or below 30% area median family income (AMFI) 179 units for households at or below 60% area median family income (AMFI) 9 Market rate units 50 units of tenants transitioning out of homelessness (McKinney/Vento Definition) Rents set at tax credit rents based on income levels Size and # of Floor Plans by type with kitchen arrangements: Small Efficiencies 5 types (110 units) (less than 400 SF ) 2 burner stove, microwave oven/one half refrigerator and a sink Large Efficiencies 3 types (22 units) (more than 400 SF) Full Kitchen One Bedroom/One Bath 10 types (75 units) - Full Kitchen Two Bedroom/One Bath 1 type (1 unit) Full Kitchen Two Bedroom/Two Bath 1 type (1 unit) Full Kitchen All units have 1 bath 10

City Walk at Akard Developer Fee Amount of Developer Fee The entire 15 floor project indicates a total project cost of $23,586,167 with a developer fee of $2,000,000 Project cost also includes $1,700,000 for abatement The funding sources indicate that $837,767 of the developer fee will be deferred and will be evidenced by a 10-year note to be paid out of cash flow The remaining $1,162,233 will be divided as follows: McCaslin Development - $10,000 McCaslin, an experienced and well respected developer is doing this project as part of their community service reinvestment. They are taking the fee because TDHCA requires that a fee be taken The remaining $1,152,233 will be paid to CDCDC to reinvested in their community service activity, some or all of which may be reinvested in 511 Akard 13

Shortfall on the Sources and Uses There is a shortfall of approximately $3.5 Million of which 50% should consist of $750,000 Residential Development Acquisition Loan Program (RDALP) $1,000,000 City Funding from General Obligation Bond money allocated for housing for the homeless 14

Residential Development Acquisition Loan Program (RDALP) On June 26, 2002, City Council approved the Program Statement for the RDALP On August 10, 2005, the City Council approved the FY 2005-06 Consolidated Plan which included $1,000,000 of RDALP funding. The RDALP provides funds for the acquisition costs of improved and unimproved properties to achieve affordability for low moderate income homebuyers and renters. CDCDC has requested City funding of $750,000 from the CDBG Residential Development Acquisition Loan Program The term of the repayment of the $750,000 acquisition loan with CDCDC will be at 0% interest for a minimum of 15 years with 1/180 th of the loan forgiven each month the project is maintained in compliance with the RDALP and federal policy, contingent on the applicant securing the 9% low income housing tax credits allocation from TDHCA by September 30, 2006 15

General Obligation Bond for Homeless CDCDC has also requested $1,000,000 from the General Obligation Bond for Homeless for the partial acquisition of 511 N. Akard The City desires to support the development of this housing project for the homeless, subject to the issuance and sale of general obligation bonds for the homeless, legal requirements regarding the use of bond proceeds, and subsequent Council authorization This financing is contingent on the applicant receiving a 9% tax credit allocation from the TDHCA by September 30, 2006 16

CDCDC and McCaslin Development as Co-Developers CDCDC and McCaslin Development CDCDC has developed or is developing the following projects for low to moderate income families: Ashby Commons 21 Unit town-home style project for families located at Deer Street/ Rusk Street Eastside Commons 143 Unit project for families located at North Hall Street at Central Gaston Street 10 Unit project for families located at 5444 Gaston Ave. Reiger Avenue 16 Unit project for families located at 4514 Reiger Ave 17

CDCDC and McCaslin Development as Co-Developers McCaslin Development has developed the following properties in the Dallas area: The Wimberly Apartment Homes 372 Unit luxury apartment for families located at Midway Road and Horizon North Parkway The Brazos Apartment Homes 286 Unit luxury apartment for families located at Midway Road and Horizon North Parkway The Quarters at City Place (nka AMLI at City Place) - 244 Unit luxury apartment for families located next to City Place Center at US75 and Lemmon Avenue Additionally, McCaslin has developed 1,334 units over the past 12 years outside of Dallas. 18

City Walk at Akard Property Management Management Issues with regard to single residence occupants Turnover is higher than average more than 25% There is a need for more intensive social service outreach for special needs and job training Maintaining the requisite amount of homeless individuals could be challenging 50 units out of 209 will be set aside for homeless tenants Is the market deep enough to lease 150 low income efficiencies and one bedrooms Applicant has applied for 100 homeless vouchers from the Dallas Housing Authority of which only a maximum of 50 will be utilized at this project at one time Applicant has also been awarded $982,458 over a 2 year period to lease ninety-one permanent supportive housing units that could be used either at this project or other projects owned by the CDCDC designated to accommodate qualifying tenants Security can be enhanced by having only one entrance at all times, requiring guests to sign in and various other rules for tenants must be adhered to as a condition to avoid violating their lease Noise and daily maintenance rules and procedures need to be developed and enforced to mitigate maintenance expenses and increased operating costs for the project which is already burdened with enhanced social service demands Advice should be sought from successful owners and managers of large SROs in Austin and Houston 19

City Walk at Akard Property Management To address these issues, Central Dallas CDC and Central Dallas Ministries will both move their headquarters to City Walk @ Akard They believe this hands-on involvement is necessary to insure the success of the project Security Guard, Doorman and Desk Clerk operating 24 hours per day, seven days per week year round to insure that the rules are obeyed The City will have the right to approve the property management/maintenance company A representative of the chosen property management company will also be a resident onsite Both Central Dallas CDC and Central Dallas Ministries will provide case management to the formerly homeless residents of City Walk at Akard Screening of tenants to identify ineligible tenants due to criminal records and ongoing drug use Health screening and services, legal services and job training will be provided to tenants based on needs or referrals will be made to mental health agencies, vocational rehabilitation and treatment facilities for drug and alcohol abuse. The City will also have a thirty day review period for approval of any proposed retail tenants 20
