(Developer) and U.S. Bank, N.A. (Dissemination Agent) in connection with the City of Lincoln Community Facilities District (CFD) No. 2006 1 (Lakeside) lmprovement Area No. 2 Special Tax Bonds, Series 2006. Continuing disclosure requirements stipulate the Developer provide information and notice of certain enumerated events. As such, the following is the response by the Developer to those items referenced in Section 4 and 5 of the Agreement. Developer Continuing Disclosure Agreement, Continued December 14,201 1 b) The Developer had not conveyed any of its Property, the result of which conveyance would cause the transferee to becomea Major Developer, as of the date of this report. c) Updated version of able 2 of the Official Statement is attached to this report (Exhibit A): (d) Updated version o! Table 3 of the Official Statement is attached (Exhibit B). (e) There have been no significant amendments to land use entitlements for Property of the Developer (if such amendments wduld prevent or significantly delay the implementation of Developer's Development Plan as described in the Official Statement or in any previous Semiannual Report.) (f) There has been no assumption of any obligations under this Disclosure Agreement by another person pursuant to this agreement. (g) Except for sales and new home closings previously and currently reported under Section 4(a), the Developer has not sold any lots in the District as of the end of the semiannual period reported. "Section 5" (a) The Developer and any of its Affiliates have not failed to pay by the date due general property taxes or assessments with respect to its property located within the lmprovement Area. (b) There has been no denial or termination of credit, any denial or termination of, or default under, any line of credit or loan or any other loss of a source of funds that could have a material adverse effect on the Developer's most recently disclosed Financing Plan or Development Plan or on the ability of the Developer, or any Affiliate, to pay any special taxes when due with respect to its property located within the lmprovement Area. (c) There has been no occurrence of an Event of Bankruptcy with respect to the Developer, or any Affiliate, that could have a material adverse effect on the Developer's most recently disclosed Financing Plan or Development Plan or on the ability of the Developer, or any Affiliate, to pay any special taxes when due with respect to its 'property located within the lmprovement Area. (d) There have been no previously undisclosed governmentallyimposed preconditions to commencement or continuation of development on the Developer's property located with the lmprovement Area (if such preconditions would prevent or significantly delay the Developer's Development Plan as described in the Official Statement or in any previous Semiannual Report.) (e) There have been nb previously undisclosed legislative, administrative or judicial challenges to development on the Developer's property (if such challenges would prevent or significantly delay the Developer's Development Plan as described in the Official Statement or in any previous Semiannual Report.)
