CHAIR ON URBAN POOR AND THE LAW ENVIRONMENTAL LAW CLINIC NATIONAL LAW SCHOOL OF INDIA UNIVERSITY ONE DAY WORKSHOP ON REAL ESTATE REGULATORY AUTHORITY AND BENAMI LAW 16 th June, 2017 NLSIU Concept Note Real estate sector in India has rapidly grown due to increased demand for cities and urban infrastructure. By this, the business opportunities and migration to urban areas has led to demand for Industrial, commercial and housing space. The real estate and construction sectors are playing a crucial role in the overall development of India s core infrastructure. Along with this the benami transactions are also increasing in the real estate sector. The real estate sector also has small regional players with relatively low levels of expertise and financial resources. Historically, the sector has not benefited from institutional capital; instead, it has traditionally tapped high net-worth individuals and other informal sources of financing, which has led to low levels of transparency. In order to regulate the real estate sector and the transactions, Government of India enacted various legislation like Consumer Protection Act, Competition Act, Contract Law and finally a special legislation was proposed in 2013 i.e. Real Estate (Regulation and Development) Act with an aim to set the legal policy governing the Real estate sector. The Act aims to curb illegal and unethical practices of developers and builders, ensuring customer protection. The Act also seeks to establish a Regulatory Authority to supervise and adjudicate dispute in this sector. Further Government amended the Benami Act 1988 with The Benami Transactions (Prohibition) Amendment Act, 2016. To understand, debate and deliberate the issue and challenges in the real estate sector, NLSIU is organizing an one day workshop on RERA and Benami Law on 16 th June, 2017. About NLSIU The National Law School of India University known to be an Institution of Excellence in Legal Education and Research came into existence through a Notification under the National Law School of India University Act (Karnataka Act 22 of 1986). It signified the culmination of efforts by the Judiciary, the Bar Council of India, the Karnataka Bar Council, the Bangalore University and the Government of Karnataka to reform legal education and to establish a Centre or legal education and research in India.
MHUPA Chair on Urban Poor and The Law The Chair on Urban Poor and the Law is established in the Law School with the vision of engaging the concerned to address the problems of the subaltern in the urban milieu and explore solutions through law, under a Memorandum of Understanding (MoU) between the Ministry of Housing and Urban Poverty Alleviation (MHUPA) and National Law School of India University (NLSIU), Bangalore on 30th March, 2012. Prof. (Dr.) M K Ramesh, Professor of Law was the Chair Professor of MHUPA Chair on Urban Poor and the Law from 2012 to 2016. Environmental Law Clinic (ELC) Environmental Law Clinic initiative is the first of its kind in India. Environmental Law Clinic intends to be a torch bearer of the Law School s mission to translate legal knowledge and skills into an instrument that addresses the various environmental concerns of the country by providing the forum, facility and tools required for dialogue, deliberations, counselling and negotiations, to arrive at well informed decisions, to secure environmental justice, rooted in equity (human and natural). A network of Legal Professionals (from the Bar, Bench and Academia), constitute the core group of the Clinic. Who Can Attend?
