Notice of Proposed Development City of Johnston, Iowa June 21, 2013 PZ Case No.13-05; Outlot X, Northwood Estates Plat 3 Comprehensive Plan Amendment and Rezoning Request: The property owner of the above-listed property has amended their requested official zoning map amendment to rezone 9.253 acres from R-3, Medium Density Residential, to PUD allowing R-3 uses including single family detached townhomes. The proposed change requires an amendment to the Johnston 2030 Comprehensive Plan for the affected property from Public/Quasi-Public land use to Medium Density Residential land use. Applicant: N&A Realty, Inc. Represented by Dallas Patterson 515-238-0388 dallasptt@aol.com Background: In 2006 when the Northwood Estates subdivision was platted, an approximate 10 acre parcel was set aside along NW 70 th Avenue for R-3 townhome development. A site plan was presented for such a development in 2008; however the plan didn t move forward due to the economic conditions at the time. In 2009, the southern 9.25 acres of the site were purchased by Cornerstone Community Church for a future site for their congregation. In late 2012, the church sold the parcel and purchased property elsewhere in Johnston. At this time N&A Realty desires to develop the property for single family detached townhomes uses and have provided the attached concept plan showing 39 lots. The property is currently zoned R-3, medium density residential which permits townhomes but requires that they be attached. Since detached townhomes are proposed, the applicant is requesting a rezoning to a PUD Planned Unit Development. A copy of the PUD Master Plan and Ordinance regulations are attached. ORDINANCE NO. 881 AN ORDINANCE AMENDING THE JOHNSTON REVISED ORDINANCES OF 2007 BY AMENDING THE OFFICIAL ZONING MAP TO REZONE APPROXIMATELY 9.253 ACRES AND ADJOINING RIGHT-OF-WAY FROM R-3 MEDIUM DENSITY RESIDENTIAL TO PUD ALLOWING SINGLE FAMILY DETACHED TOWNHOMES. THE SUBJECT PROPERTY IS LOCATED NORTH OF NW 70TH AVENUE AND APPROXIMATELY 175 FEET EAST OF PECKHAM STREET. WHEREAS, the Planning and Zoning Commission reviewed this item at their regular meeting on June 10, 2013 and recommends approval of PZ Case No. 13-05. NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JOHNSTON, IOWA THAT: SECTION 1. PURPOSE. The purpose of this ordinance is to change the Official Zoning Map of the City of Johnston, Iowa, under the provisions of Chapters 165 to 172 (Zoning Ordinance), and Section 166.02 (Zoning District Boundaries and Official Zoning Map) of the Johnston Municipal Code. SECTION 2. OFFICIAL ZONING MAP AMENDED FROM R-3 TO PUD, PLANNED UNIT DEVELOPMENT. The following legally described property is hereby rezoned from R-3 to PUD: Outlot X, Northwood Estates Plat 3, Official Plat, Johnston, Polk County, Iowa and all adjoining right of way to the centerline of NW 70 th Avenue. SECTION 3. MASTER PLAN PROVISIONS. In accordance with Section 168.11(3) adopted herewith is the PUD Master Plan for the above-described area being rezoned to Planned Unit Development consisting of the following development policies: A. General Provisions: 1. PUD Master Plan: The plan for Villas at Northwood as prepared by Civil Design Advantage and dated May 29, 2013 is hereby adopted as the PUD Master Plan. The Master Plan and those additional guidelines as identified herein shall constitute the zoning requirements of the property. 2. In the administration of these guidelines, any item not addressed specifically will be governed by the Johnston Municipal Code, including Chapters 165-172, Zoning Ordinance. B. Land Use Provisions: The property shall utilize the bulk requirements of the R-3 zoning district, except the following provisions shall apply: 1. Single Family detached dwelling units are allowed. 2. 10 foot minimum separation between principal buildings for detached townhomes. 3. 35 foot minimum setback from PUD boundaries.

C. Buffers: 1. Pursuant to chapter 166.34 a landscape buffer shall be maintained between the parcel and the western and northern property boundaries adjacent to single family residential properties and a landscape buffer shall be maintained between the parcel and the eastern property boundary which is zoned commercially. D. Parkland Dedication: 1. To satisfy the requirements of Chapter 180.43, Public Parkland Dedication, a public trail (either 8 foot wide P.C.C. or 9 foot wide A.C.C.) shall be constructed from the northwest corner of the subject property southerly to the southwest corner of the subject property as depicted on the PUD Master Plan. The alignment of the trail shall be determined with the site plan approval, and the trail shall be constructed with the other public improvements within the subject property. E. Utilities: 1. An 8 inch water main shall be extended from the current terminus on the northern property boundary through the site to loop to either the main along Peckham Drive or NW 70 th Avenue as determined at the time of the site plan review. 2. At the time of platting, all applicable water and sewer district connection fees shall be paid. F. Traffic Access and Circulation: 1. At the time of platting, a petition and waiver shall be provided allowing for the assessment of reconstruction costs for NW 70 th Avenue to be spread amongst the proposed development. 2. The access drive to NW 70 th Avenue as depicted on the PUD Master Plan will be restricted to a right in/right out access with the reconstruction of NW 70 th Avenue. 3. All private streets shall be constructed to the same construction standards as public streets. SECTION 4. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 5. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 6. WHEN EFFECTIVE. This ordinance shall be in full effect from and after its final passage, approval, and publication as provided by law.
