1. GENERAL INFORMATION ABOUT GRILL KIOSK PLACES The Event services of the Leisure time center of the city of Joensuu leases grill kiosk sales places for which the entrepreneurs are chosen on basis of their offers. The entrepreneurs operating the grill kiosks are hoped to take into account in their services the quality and versatility of the product range. In addition the entrepreneurs are expected to be able to take care of the general cleanliness and sanitation of the environment of their own sales places. If necessary the Event services of Joensuu has the right to decide about opening hours deviating from the terms and conditions for grill kiosk places, as well as about other changes and additions to the terms and conditions. 2. CONDITIONS FOR GRILL KIOSK PLACES The entrepreneur has to undertake the obligation to compensate the possible damages caused to the city or to a third party caused by his/her actions. The entrepreneur obliges to follow these general conditions and act in accordance with good manners and the laws of Finland. The grill kiosk place cannot be used during trade fair days of the city of Joensuu or during other days separately notified by the Event services. The lessee of the grill kiosk place does not have a right to transfer the sales place contract or to hand over the place or its part to a third party. The Event services of Joensuu do not answer for vandalism, petty theft, theft or other possible damages connected with the sales place of the lessee of the grill kiosk place. The lessee of the grill kiosk place is obliged to ensure that his/her facilities (for example wires and other structures) do not hamper the general maintenance or sanitation services or cause danger to the people moving in the area. The lessee of the grill kiosk place is responsible for the damages caused by the appliances, wires and structures at his/her disposal. The grill kiosk place is not leased to a person who him/herself, his/her spouse, other family member living in the same household or whose business partner participating in the market trade has unpaid payments to the city of Joensuu or tax authorities, unless he/she has an approved and valid payment plan. In case the lessee of the grill kiosk place has been repeatedly notified about the actions violating this condition or about neglecting the payments, the Event services have a right to refuse to lease the grill kiosk place. 3. PERMISSIONS REQUIRED FOR MARKET TRADE The market trade and selling of food products are stipulated and limited by various laws, regulations and conditions. The person engaged in market trade has to follow these laws, 3
conditions and regulations, as well as good manners. If required the lessee of the grill kiosk place and the salesperson have to present to the market square personnel or other possible authorities the permissions and documents required by present valid laws, such as certificates of origin of the food products. If required a certificate of origin or other reliable clarification about the origin of the other sales articles have to be presented. The lessee of the grill kiosk place has to inform the Department of environmental health of North Karelia about the sales or other handling of food products in a movable food product facility in accordance with the food safety regulations. The name, domicile and other possible information required by authorities are to be presented clearly by a sign in the grill kiosk place. The required information can also be presented in a form of an advertisement. The price and package markings are to be presented in a way required by the authorities. 4. EVENTS IN THE CITY CENTER When the city of Joensuu organises events, or rents out the city center areas or its part to a private event organiser, the lease contracts of the grill kiosk places are not valid in the rented area and the sales activities are not allowed in these cases. 5. SALES AREA The sales activities of the lessee of the grill kiosk place have to fit in the given sales area and the boundaries are not allowed to be exceeded. 6. SANITATION OF THE GRILL KIOSK PLACE The entrepreneur of the grill kiosk is obliged to clean the environment of his/her grill place immediately after having finished the sales activities to the state approved by the authorities. The cleaning obligation covers those nearby areas, in which it can clearly be shown that there are clients trash and garbage induced by the sales activities of the grill kiosk. The lessee of the grill kiosk place is responsible for the cleanliness of his/her own sales place and its immediate surroundings during the sales hours and the lessee takes care of the cleaning after the sales hours. The entrepreneur obliges to follow the instructions of the market square personnel and authorities concerning the maintenance of the environment cleanliness. 4
7. WASTE MANAGEMENT AND WASHING POINT The entrepreneur must ensure that the waste induced by his/her activities is removed from the grill kiosk place and its immediate surroundings after the sales hours. The waste materials are to be sorted to the corresponding waste collection points (mixed waste material, cardboard, biowaste) and they must not be left outside the waste containers or in other inappropriate areas. The waste collection points of the market square are meant only for the waste induced from the market trade and events organised in the market square area, and it is prohibited to bring waste to the market square waste collection points from elsewhere. The grill kiosks places can use the waste collection points. It is prohibited to pour grill grease/oil and waste water to the rain water drainage of the market square. The entrepreneur must him/herself transport the grease material and pallets away from the market square area. In case the sanitation and waste regulations are violated the Event services can terminate the lease contract of the grill kiosk place. The Event services have the right to collect the costs caused by the irresponsible maintenance and cleaning of the place from the lessee of the sales place. 8. TERMINATION AND CANCELLATION OF THE GRILL KIOSK SALES PERMISSION The Event services have the right to terminate the grill kiosk contract following one (1) month s notice time. In case of breach of contract or in serious appeal cases the grill kiosk contract can be terminated immediately. In case the operation of the grill kiosk place causes disruptions to the traffic, general order or a third party, the city has the right to terminate the grill kiosk place contract immediately. The lease right for a grill kiosk can be cancelled completely or for a fixed period of time in case: - the lessee of the grill kiosk place or his/her employee does not follow the conditions of this document - the lessee of the grill kiosk place or his/her employee does not follow the instructions of the Event services or the market square personnel - the lessee of the grill kiosk place or his/her employee acts in violation of the food and health safety law - the lessee of the grill kiosk place or his/her employee behaves inappropriately in the market square - the lessee of the grill kiosk place or his/her employee operates his/her sales place while intoxicated. 5
In case the lessee of the grill kiosk place has not carried out the payments within agreed deadlines and in accordance with the instructions of the Event services, he/she will lose the lease right. 9. SETTLEMENT OF POSSIBLE DISPUTES The possible disagreements and disputes are always tried to be agreed by negotiations between the parties. In case, despite the good intensions, the mutual understanding is not reached by negotiations the possible disputes are to be settled by the District Court of North Karelia. 6
