ST TROPEZ-FORT MYERS CONDOMINIUM ASSOCIATION, INC. APPLICATION AND PROCESSING REQUIREMENTS 1.) Upon completion of Association application packet, submit your packet to a member of Castle Management at the onsite manager s office. All checks and required material must be given to begin the approval process. Process will not start until all items are submitted. 2.) Application for Sale must be complete and returned 30 days prior to closing. Leasing application must be complete and returned at least 20 days prior to occupancy. If tenants are renewing a lease their driver s license plus new lease must be mailed to Castle Group for a new background check only, the Association will pay for this. 3.) Submit with your application the required, non-refundable Application fee of $100.00 per applicant payable to ST. Tropez-Ft. Myers Condominium Association, and non-refundable payment of $200 per applicant for the Administration/Supervisory Fee payable to Riviera-Fort Myers Master Association. Married couples using the same last name are considered one applicant. If legally married using different last names, submit a legible copy of your marriage certificate. All occupants over the age of 18 years are required to apply. Application fees are payable by money order or local checks only. 4.) If you are a leasing applicant, please submit a security deposit in the amount of $1,000.00 or one months rent, whichever is lesser (paid by the tenant). This deposit will cover any liabilities owed by the tenant to the Association. Check payable to ST. TROPEZ-Fort Myers Condominium Association, Inc. Please be aware this check will be deposited upon receipt and if application is not approved money will be refunded back in check form within 7-14 days. 5.) Leasing application credit score must be a minimum of 675 for each unmarried adult. However a combination income/credit review requirement is an option only for those applicants who are married and whose credit score is below 675. Each following must be met. Monthly rent must be verified and must not exceed 30% of the verified monthly income of each unmarried adult applicant (monthly income of each applicant must be 4X the monthly rent). Applicants with a credit score that falls below the requirement must submit a written explanation of the recent cause for the drop in credit score, provide data showing the credit score history, and provide letters of reference. 6.) Submit a legible copy of your Contract for Purchase and Sale or Lease Agreement, signed by all parties. Submit all pages. 7.) Submit a legible color copy of your drivers license. This information is required to complete your background check.

8.) Up to two pets allowed with written authorization of the unit owner and written approval of the Association. Pet must comply with weight restriction of a maximum 35 pounds at maturity for one pet or both combined weighing 35 pounds. Pets are required to be registered with the Association including photo and a copy of current license and vaccinations. Dogs are subject to a $30.00 annual fee which should be payable to Riviera-Fort Myers Master Association. 9.) Do not fax any material to Castle Group unless instructed to do so by the processing department. 10.) Return all pages of the application and all supporting material. If an item does not apply, mark it as N/A. Please be advised that any missing required items or questions left blank on the application may cause the application to be returned, not processed and not approved.

ADDENDUM TO ST. TROPEZ-FORT MYERS CONDOMINIUM LEASES Effective 1/1/2010 This is an Addendum to the Lease between (Owner) and (Tenant), for Unit, beginning on (date of lease) and all renewals thereof. Tenancy Subject to Use Restrictions & Rules: The tenancy is subject to the provisions of the Declaration of Riviera-Fort Myers, a Condominium, together with the Association s By- Laws, and all of the Amendments thereto and all of the Rules adopted by the ST.TROPEZ- FORT MYERS CONDOMINIUM ASSOCIATION, INC... The Association has the right to take action to enforce the use restrictions and rules against the owner and tenant. The Association s remedies include, but are not necessarily limited to, fines and termination of the lease, restriction of common area usage, and eviction of the tenant. The Association is entitled to recover all legal fees and costs incurred in connection with actions to enforce the use restrictions and rules, including those incurred before suit, from either the owner or the tenant. Zero Tolerance: Violations that adversely affect or threaten the safety and peaceful existence of any owner or tenant will result in eviction by the Board and Management. Two violations of any kind of disturbance will result in eviction by the owner, Board and Management at the owner s expense. Failure of the owner to evict will result in future denial of leases. Fines for tenant violations will be charged to owners and documentation of violations will be placed in owners and tenants files. Tenants and owners allowing unauthorized residents to move in without Board approval will be subject to eviction by the owner, Board and Management. Failure of the owner to evict will result in future denial of lease. Unauthorized Occupants and Pets: Any occupants or pets that are not listed on the lease or application for approval of the lease or subsequently approved, in writing, by the Association are subject to being evicted by the Association without other cause. Towing of Unauthorized Vehicles: The Association has the right to tow any vehicles being kept by tenants, their family members or guests on the Condominium property in violation of Section 17.23 of the Declaration, including any parked on limited common elements, and the owners and tenants shall indemnify, hold harmless and defend the Association, from all fees, expenses, costs and damages related to such actions. Assignment of Rents: In the event that an Owner is in default in the payment of assessments or other sums due and owing to the ST.TROPEZ-FORT MYERS CONDOMINIUM ASSOCIATION, INC., the Association shall have the right and authority to collect the rent to be paid by the Tenant to the Owner directly from the Tenant. In the event such Tenant fails to remit said rent directly to the Association within ten (10) days from the day the Association notified such Tenant in writing that the rents must be remitted directly to the Association, but

no later than the day the next rental payment is due, the Association shall have the right to terminate the lease and evict the Tenant. All sums received from the Tenant shall be applied to the Owner s account for the leased Unit according to the priority established in Section 720.3085, Florida Statutes, until the Owner s account is current. ST.TROPEZ-FORT MYERS RULES AND REGULATIONS Regarding Unit Number MOVE IN NOTICE All Move Ins and Move Outs must be scheduled and coordinated with Management. Move Ins and Move Outs are allowed ONLY Monday Saturday from 9:00am 4:00pm. All Move Ins and Move Outs are to be done in the Service Elevator ONLY. There is only one service elevator and one parking space for the mover s truck for each building. Failure to schedule a moving date and time with Management can result in denial when your vehicle(s) arrive(s) with your articles. Non-compliance may result in fines assessed against the tenant and owner of the property. No furniture is allowed to be moved on the private elevator. No full house move ins/move outs are allowed after 11:00am. The size of any truck obtained by a resident for any reasons such as; move in, move out, have any items delivered; furniture, appliances etc., or any vendors vehicles servicing the unit may NOT exceed 28 ft. in length due to parking restrictions. Vehicles will be required to leave property immediately if over this size. DELIVERIES All couriers are required to deliver packages to the unit, you may coordinate with Management to have a package delivered to Managements office if you desire. When service elevator is unavailable all packages will be signed for and locked in the lobby closet, Management will contact residents by phone and/or email and/or note on mailbox to inform them of their package delivery. Packages are available to be picked up Monday Saturday 8:30 am until 5:00 pm from Management; security can assist in obtaining your package outside of these days and times. Furniture Deliveries or any large deliveries must be scheduled with Management and are only allowed Monday Saturday 9:00am 4:00pm. TRASH Garbage should be bagged, tied tightly and placed in trash chute (located at west end of each floor). Break boxes down flat & put in cardboard dumpster on P1. Please do not leave boxes in or near dumpster without breaking down. Break Styrofoam into SMALL pieces and put down trash chute. Household goods dumpster located on P-1 to the west of the garage entry gate.

SMOKERS No Smoking is allowed inside the buildings and elevators. Please use the cigarette urns located behind the Riviera lobby entrance in the grill area or on the West side of the property on the walkway by the water. No Smoking in P-1 or P-2 garage areas. QUIET HOURS 11:00 pm to 8:00 am. No parties, loud noises out on lanai, walkways, etc. Noncompliance may result in fines assessed against the tenant and owner of the property. POOL FACILITY RULES NO GLASS and/or NO CERAMIC allowed in pool area. No running, pushing, jumping, diving or dunking in pool or Jacuzzi. No Beverages or food in the pool or Jacuzzi, all food and drink must be kept in the designated food area where the tables and grill are located. Pool facility usage by residents and their guests only. Residents permitted a maximum of 4 registered guests per day, per condo. Pool facility opened from Dawn to Dusk (sunset). No smoking or pets permitted in the pool area. Small coolers/food permitted only in the designated food area. Showers required prior to using Pool or Jacuzzi. Unruly behavior or offensive language will not be tolerated. No external sound emitting devises permitted. Proper swimming attire required in pool and Jacuzzi. Any person who is incontinent or not fully toilet trained must wear appropriate waterproof clothing when entering or being carried into the pool. No children under the age of 12 are allowed without adult supervision in or at the pool area. No wet bathing suits allowed in elevators or lobby. No Bare feet in elevators or lobby. The pool cannot be reserved for exclusive use at any time. All residents and guest must wear or carry a pool pass wristband while enjoying the pool. Residents must pay a $10 deposit per guest per wristband, when the guest wristband is returned to management, the deposit will be refunded. You may contact any member of management or security to obtain guest bands. The pool will be monitored, please present the band when requested. PET OWNERS All pets must be registered annually with management. Pet cannot weigh over 35 pounds at full maturity. Maximum two (2) pets allowed per unit with a combined weight of 35 pounds, or one (1) pet at 35 pounds.

A $20 late fee will be applied if annual registration fee is paid after January 31 st of every year. The annual registration fee for dogs is currently $30. Cats must also be registered but there is no fee required. Resident must pick up all solid wastes of their pets and dispose of such waste appropriately. Waste containers are located at entry doors on p1 level outside and down at the liner Buildings. All pets (including cats) must be kept on a leash of a length that affords reasonable control at all times or must be carried when outside of the unit. No pet may be kept on a balcony, lanai or elevator vestibule when the owner is not in the unit nor make objectionable noise, or constitute a nuisance. BELL CARTS AND GROCERY CARTS All bell carts and grocery carts must be returned to the appropriate stations for all residents to use. Failure to return these is subject to a fine. These carts are not to be used for moving in or moving out, there are dolly s and appliance carts available for use. SMOKE DETECTORS No painting of unit wall speaker or smoke detectors (Fire code issue). Keep range fan on when cooking. Keep batteries in for proper working condition. If smoke is present, open sliding doors, DO NOT open the door to vestibule as smoke will travel down elevator shaft and set off building alarms. SKATEBOARDS/RAZORS/SCOOTER No skateboards, rollerblades, razor scooters or the similar are allowed to be used on property at anytime. OVERNIGHT GUESTS All guests staying after 10:00PM Monday Friday or anytime all day and night on Saturday and Sunday MUST obtain a visitor s pass from Management or Security. You must also register all overnight guests with Management or Security. PARKING Park in assigned space(s) only. Decal must be displayed on front windshield drivers side lower left hand corner at all times while in the garages. If the decal is not on your vehicle you risk being towed. Register guest(s) at front desk and obtain guest parking pass for extended stays. Guest must park in labeled visitor/guest parking spaces. Any guest parked on property without a parking pass after 10pm Monday thru Friday and all day on Saturday and Sunday will be towed with no warning. This property includes p-1, p-2, p-3 and the liner building lots down below. ZERO TOLERANCE.

No trailers, recreational vehicles (campers, boats, wave runners, etc.) allowed on parking/property. No person shall park, store or keep anywhere in the Community any large commercial type vehicle (for example, dump truck, motor-home, trailer, cement mixer truck, oil or gas truck, delivery truck), except temporarily in designated guest parking locations. No trailer, camper, motorhome or recreational vehicle shall be used as a residence, either temporarily or permanently, or parked anywhere in the Community. No vehicle is permitted within the Community which leaks oil, brake fluid, transmission fluid or other fluids. Clean-up will be at owners cost or in the case tenants or guests, financial damages will be borne by the owner. Leaking vehicles that are not promptly repaired will be subject to towing at the owners expense. No person shall conduct repairs or restorations on any motor vehicle, or other vehicle, or race the engine of any vehicle, anywhere in the Community. The speed limit within the parking garage is 5 MPH. Residents driving vehicles in excess of such speed or in other unsafe manner are subject to a fine. Smoking and littering are not permitted in the garage. The Board has created spaces specifically designed for motorcycles (example: M1, M2) on a first come/first serve basis and for a monthly fee. Residents who are interested in motorcycle parking should apply to management. No more than one motorcycle or motor-scooter may be parked in a single space an in no event may a motorcycle or motor-scooter be parked in the same parking space as another vehicle or between any parking spaces GRILLS No gas, propane, electric or charcoal grills are allowed on personal lanai. There are 2 gas grills on property; one is located in pool area and the other to the east of the St Tropez main lobby doors. If hey run out of gas please let management or security knows and it will be replaced. There are two charcoal grills located in the property to the west of the Riviera. CHILDREN No children under the age of 16 are allowed without an adult supervision in the fitness center Children under the age of 18 must have adult supervision to use the theatre room. An adult listed on lease or owner will be held responsible for any damages. TEL- ENTRY SYSTEM Provide local telephone cell or land line to Manager, you can be added into Tele-entry system for guests, vendors, etc. Do not provide property entry codes to vendors, friends or visitors, so to protect the privacy and safety of all who reside in the building.

You may talk to visitors if they call you through the front door system or press 9 to allow them access through the front doors. LANAI CLEANING Please do not let water run over the edge of your lanai or dump dirty water buckets out of the lanai screen when cleaning. That water and dirt affects every unit below you and dirties their lanai. Please be courteous of your neighbors and remember to inform anyone who have hired to clean your lanai of this information. BUBBLE BATH & HE LAUNDRY SOAP To help the Association with plumbing issues that are occurring, please discontinue the use of bubble bath, it does not breakdown and dissolve, if you have a High Efficiency (HE) Washer please make sure you are using HE detergent. I have read and understand all Rules & Regulations set forth in this document and understand that violation of these and all guidelines of the association is subject to a fine of up to $100.00 per violation.
