The Chantilly Highlander Your Community Newsletter Serving Chantilly Highlands www.chha.org November 2012 From the President... It's November and election time is near. Now I bet you're thinking I mean our presidential elections, but I'm referring to our upcoming board of directors elections we hold every January at our annual membership meeting. I have been honored to serve as the board president this year, with a great group of seven other residents. We all serve at our convenience there s no pay other than for a job well done. With the support of a load of volunteers and less than a handful of paid positions, our Association continues to function as a low-cost, community-run, neighborhood HOA. Look around our area, and you'll see most of the HOAs being run by corporate management consultants, with their associated fees and bureaucracy, even for HOAs of much smaller size. In order for our community to continue as it does, we need a constant influx of new blood. Even if you're relatively new to our community, that s no reason not to be involved. There will be opportunities for multiple residents to join the board, and you won't have to wait until the January meeting if you have an interest we have a one vacancy right now, and you can express an interest and be seated before the year s over. Jeff Centreville Rd Development Report The CHHA Civic Affairs Committee sponsored a community meeting at Oak Hill Elementary School on 1 October to discuss the development planned across from our neighborhood on the opposite side of Centreville Road. The property was part of the original 1985 plan by EDS for multiple data centers and offices similar to the EDS (now HP) facilities along RT 28. When the need for these type of facilities was not forthcoming, alternate plans for the remaining undeveloped property were proposed. Eventually, in 2006 the county approved plans for a county park with multiple playing fields, three office buildings, residential use supporting 1,159 units and supporting retail for the remaining undeveloped part of the original EDS property. Last year the original developers of the residential property sold their rights to a new organization, who wished to change the mix of residential uses to include less apartments and more owner-occupied units. In order to do that, they decreased the number of residential units from 1100 plus to 805, and changed the mix to 85 townhouses and 720 multifamily units in 342 apartments units, 198 two-story condo units and 180 elevator condo units. The lawyer for the developers, Sara V. Mariska of Walsh, Colucci, Lubeley, Emrich & Walsh, P.C., has provided a fact sheet on the development and various illustrative views of the planned structures and amenities. Page 2 The Chantilly Highlander Chantilly Highlands Homes Association Board Meeting Minutes Wednesday, October 3, 2012 Minutes are tentative and will be reviewed and approved at the next Board Meeting, scheduled for Wednesday, November 7, 2012 Members of the Board present - Jeff Parnes, Doug David, Ken Weinstein, Chuck Munson, Bob Hirsh, Kaushik Goswami. Three (3) committee chairs (Bob Hirsh, Jeff Parnes, Bob Bevins and Wendy Osborn) were present. Call to Order - The meeting was called to order at 7:45 P.M. when quorum was reached. Introduction of Homeowners - Two homeowners/residents were present. Approval of September Board Meeting Minutes - Chuck Munson moved to accept the minutes as amended and published in the newsletter. Vote was unanimous. Acceptance of the Treasurer s Report - The treasurer, Ken Weinstein, did not arrive until after the meeting, at which time he submitted the budget analysis. The board plans to review the analysis at the November meeting. Old Business Pool Rental Regulations The review committee (Ken Weinstein, Gerard Eldering and Wendy Osborn) will be meeting to review the rental regulations and will report back to the board at a future meeting. Playground Ball Hoop John Breene was not in attendance to report any progress on his effort to determine whether the removal can be performed as a Scout community service project. State-Mandated Official Complaint Procedures Board Secretary Chuck Munson verified the request from Board President Jeff Parnes, stating that the total number of policy resolutions adopted by the board to date is seven. Jeff Parnes will be providing a write-up of this policy for the newsletter. In addition, all established community operating procedures should be included in all resale packages. Community Center Scheduling and Cleaning Wendy will turn over to Paula the Community Center Use and Maintenance lists that Chuck Munson and Wendy had developed for review and finalizing. Community Center Trash Removal Bob Hirsh arranged with Republic (AAA) for a firm removal schedule for both winter and summer that should address any problems with trash removal which occurred this past summer. Community Center Maintenance The sub-committee consisting of Wendy Osborn and Chuck Munson will be meeting shortly to review research and costs obtained for interior improvements for the community center, such as the painting discussed earlier. In a discussion regarding whether Palmer Landscaping had agreed to clean the length of gutter identified earlier as needing cleaning, Board Member Bob Hirsh and Facilities Committee Chair Bob Bevins volunteered to perform the service themselves. Community Center Communications Changes Arrangements to replace the pay phone are still being worked on by Bob Hirsh. Girl Scout Gold Award The board discussed the very generous offer from Elise Nicewick to provide the community with a sand volleyball court. The board discussed both the pros and cons, but decided because of the possible issues with vandalism (especially in light of recent events), proximity without a barrier to the playground, and animals potentially using it for a litter box, that the board should regretfully decline the offer. The vote was not unanimous with four ayes and one nay. New Business None discussed. Officers Reports President s Report - Board President Jeff Parnes requested that webmaster Greg Zilberfarb create and update a list of email addresses for all residents available in order that critical community issues (board/community meetings, dues, security announcements) receive the broadest possible dissemination to the neighborhood. The current email list contains only those residents opting in for the newsletter. Please note the new mailing list will not be for the newsletter and that residents may still choose to opt-out of the critical issues mailing list at their request. The board requested that the Association's address, current dues, date the dues are due, and the fact that our association does not have a telephone number be available on our website so that residents and prospective residents can complete necessary (re)financing forms without having to contact the association. Vice President s Report - No Report at this time. Treasurer s Report - Ken Weinstein reported that the community tax forms for state and federal were ready and had been mailed as of September 15, 2012. The board established a database committee to proceed with required changes and updating. The committee consists of Jeff Parnes, Ken Weinstein, Kaushik Goswami, and Mike Ventrelli. Secretary s Report - Chuck Munson presented the list of documents that should be in the HOA permanent records. The board reviewed it and made several recommendations for additions. Chuck will finalize the list and add it to the community records to serve as an index. He is continuing to review the contents of the community files to organize and verify documentation. Chuck will forward operations documentation that he has uncovered during the effort to organize the community documents to Bob Bevins. Committee Liaison Reports See MINUTES on page 3

November 2012 MINUTES from page 2 Architectural Control Committee - The ACC Walkthrough is continuing, however, Bob Hirsh is in need of help. Bob forwarded the formal Walkthrough Guidelines being followed to the board. In a continuing discussion, Doug David suggested that we publish the county regulation addressing grass height for the benefit of all residents. A synopsis is that on all properties less than one-half acre it is unlawful to allow grass to grow any more than 12 in height. Jeff Parnes suggested that a couple of issues that have come to light as Bob Hirsh and others have performed the ACC Walkthrough be referred to counsel for their opinion. The first regards who is legally responsible for repaving pipestem access drives when required and the second involves the repair of common pipestem mailboxes when required. It is believed that the green signs with white lettering at the head of every pipestem identifying the addresses on the pipestem and the pipestem as a Private Drive need to be ordered through the county. Civic Affairs - The meeting regarding the project construction along Centreville Road opposite both Chantilly Highlands and Franklin Farm was held October 1 st in the Oak Hill Elementary School library. Over thirty residents attended and the discussion ranged from actual design of the development and layout to questions regarding traffic impact and which schools would receive attendance of the children in the new Page 3 residences. Communications - The board postponed discussions regarding the Resident Directory and an effort to increase newsletter participation to cover other issues. Both issues are anticipated to be addressed by the board at next month s meeting. Community Events - Wendy Osborn reported that she is authoring a special thanks to the Community Day vendors which should be ready for this month s newsletter. Wendy Osborn reported that the planning for the Halloween events is progressing. She is currently attempting to arrange a Black Light Halloween Party for Saturday, with tattoo artists who will provide glow in the dark tattoos. A discussion of the event budget concluded that the existing budget should be sufficient. Jeff Parnes inquired about future events, the following one being the holiday gathering in December. Wendy suggested that, based upon last year s expenditures, that a slight budget increase may be required. She is seeking to secure the popular hayride for the date in mind. Community Facilities - Bob Bevins submitted a draft document addressing tennis court rules and etiquette for the board s review. This will be voted upon at next month s meeting. Bob submitted a draft for a revised pool contract and suggested that we have legal counsel review it prior to a final review by the board. See MINUTES on page 4

The first was a request to replace the entire fence at the baby pool area, much of which is badly bent or suffering from rusting. The second was to work with Gerard Eldering, Land Management Committee chair, to engage Palmer Landscaping to perform some necessary tree trimming. Bob reported that the tennis courts will require cracks to be filled within the next month to avoid damage due to freezing and that the court lines will require repainting in the coming spring. Bob also reported that we will need to have someone install the signage now required at the accessible parking spots in the pool parking area. We will also need concrete parking stops as well to provide protection for the sign. The board also discussed reinstating a prepaid pass system for residents to have guests at the pool. The board agreed to discuss this in further detail at a later date. Land Management - The pipeline mowing policy received the board s unanimous approval. The board approved Gerard s recommendation that a subcommittee consisting of himself and Bob Bevins evaluate the landscaping proposals as they are received. November 2012 Page 5 The How and Why of Fences Bob Hirsh, ACC Chair Good fences make good neighbors. 17 th Century Proverb Probably the most contentious area of home improvement in Chantilly Highlands is the construction of fences. The current ACC Guidelines are as follows: 4.3.1 FENCES 1. ACC approval is required prior to the construction of any fence. See Appendix A for several fence styles. Homeowners must include the following information with a completed application to erect a fence: a. A photocopy of the house site plan (plat) with a location drawing of the proposed fence. b. A drawing or picture of the fence style, its dimensions, and a description of the construction materials. 2. Only rear yard fences are permitted as defined in Section 4.2.e.2. Fences at any point may not exceed a total height of 6 feet. The fence must extend no closer to the front street than the rear house corners. 3. All fences shall be constructed of pressure treated pine, cedar, redwood, or locust. 4. Fences may be stained or be left to weather. Any colors other than natural wood or weathered board must receive ACC approval. 5. Gates must be compatible with fencing in design, material, height, and color. 6. Chain link, cast iron, barbed wire, and wire strand fences are prohibited. 7. Corner lot fencing must conform to Fairfax County Zoning Ordinance. No fence, tree, hedge, and/or shrub plantings shall be maintained in such a manner as to obstruct sight lines for vehicular traffic. The fence must extend no closer to the adjacent streets than the rear house corners. 8. If a homeowner wishes to connect to an existing fence or erect a common fence between properties, then a signed statement of approval from the homeowner's adjoining neighbor(s) must accompany the application and meet prior existing neighboring conditions (e.g., connecting fences should be of the same style and height.) Most of these items have not been problematic: nobody has asked to put up barbed wire in the two years I ve been on the ACC. The problems come from the requirement that the fence be no closer to the street than the back corner of the house. Violations of this rule usually occur in two ways. The first is the application for a fence that is the same distance from the street as the neighbor s fence, even though this puts your fence into the middle of the side wall of your house instead of level with the back corner. We almost always ask that the front of the fence be moved to be level with the back wall of the house getting the fence. This is why you see the skewed fence fronts as you drive down the street. The second, and more difficult situation, occurs on corner lots where the property boarders a street or pipestem driveway on two or more sides. By the current rules this would only leave about a third of the yard eligible for fencing, with the fence on the corner side coming out from the back corner level with the side wall instead of the back wall. Our intent is to update the guidelines to ask for 20 foot setback from the street for fences in this case, which would usually allow for a fence section and a gate to extend out level with the back wall of the house in most cases In addition to the Chantilly Highlands guidelines, Fairfax County Zoning Ordinance section 10-104 prohibits fences higher than four feet in a front yard. Fairfax considers the yard between the street or pipestem frontage and the wall of the house closest to the frontage as a front yard. For zoning purposes, a corner lot is considered to have two front yards. As always, we ask that you complete the ACC Application for Exterior Alteration form before you start any project that modifies the exterior of your home. This allows us to head off most problems before they get set in concrete (so to speak). Page 6 The Chantilly Highlander CHANTILLY HIGHLANDS HOMES ASSOCIATION POLICY RESOLUTION NO. 12-001 (Procedures Related to the Submission and Resolution of Complaints) WHEREAS, Section 55-530(E) of the Virginia Code requires the Association to establish reasonable procedures to resolve written complaints from the members of the Association or other citizens; and WHEREAS, Section 18VAC48-70-10, et seq, of the Virginia Administrative Code requires the Association to enact procedures governing the receipt and adjudication of written complaints by September 28, 2012 and outlines the requirements for the content of such complaint procedures; and WHEREAS, the Board has adopted a policy resolution requiring all complaints to be submitted to the Association s Board of Directors in writing and establishing reasonable procedures governing the resolution of these written complaints so as to comply with the requirements of the governing documents and Virginia law. NOW, THEREFORE, BE IT RESOLVED THAT the Board adopts the following policy: Complaint Must Be in Writing. The Association shall act only on written complaints submitted to the Board in accordance with the procedures set forth in this Resolution. The Board has the discretion to act on verbal complaints if it believes the matter can be quickly resolved. However, the Board reserves the right to withhold action and require the complainant to submit a written complaint as provided for in this resolution. Complaint Form. If an owner, resident or other person wishes to submit a formal complaint to the Association, such persons must complete the written complaint form attached hereto as Exhibit A and submit the complaint form to the Association s management. Where Complaints Should be Sent. All written complaints must be sent by United States Postal Service mail or hand-delivery to the Association at the following location, unless otherwise advised by the Association s Board: Chantilly Highlands Homes Association c/o Board President Post Office Box 710238 Oak Hill, VA 20171-0238 Required Information. The complaint must allege that either the Association or a member of the Association (including its Board of Directors or Management) has acted in a manner that is inconsistent with applicable laws and regulations. All complaints shall include the following information or shall be deemed invalid: The name and address of the complainant; The nature of the alleged complaint, including the relevant times, dates and places involved; The applicable laws or provisions of the Association s governing documents the complaint concerns; The name and address of any other persons involved, if known; Any other information the complainant deems relevant for the Board s review; The signature of the complainant. Acknowledgment of Receipt. Upon receipt of a valid written complaint, the Association shall provide written notice acknowledging receipt of the complaint within seven (7) days of receipt of a completed Complaint Form. Association s Form of Correspondence. The Association shall deliver written notice to the complainant by certified mail or hand-delivery, unless the complainant either has: (1) notified the Association that they consent to receiving written communications electronically; or (2) such method of communication is consistent with procedures that have been adopted by the Association s Board of Directors. Incomplete Complaint. If the Association deems the complaint to be incomplete, the Association shall notify the complainant within seven (7) days of receipt of the submission. The notification shall state the additional information the complainant needs to provide to the Association to complete the Complaint Form. The complainant shall have an additional fourteen (14) days to submit a completed Complaint Form. If a completed Complaint Form is not received within the 14-day time frame, the Association shall notify the complainant that a valid written complaint was not received and the matter is deemed closed. If the additional information is received within the 14-day time frame, the Association shall send acknowledgement of receipt as identified in Section 5 above and commence with investigation described in Section 8 below. Investigation Period. Upon receipt of a valid written complaint, the Association shall investigate and resolve the complaint. The Board may contact the complainant in order to conduct its investigation. The complainant is obligated to cooperate with the Association s investigation. If the complainant does not cooperate, the Association may close the matter for failure to cooperate. Conclusion of Investigation. The Association will conclude its investigation within 30 days of its receipt of the valid written complaint, unless the Association deems that more time is necessary to conclude the investigation. Matters Not Involving Allegations of Violations by Other Residents. Notice. If the complaint involves a matter that does not involve an allegation that an owner or resident is in violation of the Association s governing documents, or duly-adopted policies, rules or regulations, once the investigation is complete, the Board of Directors shall notify the complainant of the time, place and location that the matter will be considered by the Board. Hearing. The Board shall conduct a hearing on the alleged complaint. The complainant may present any evidence the complainant deems relevant to the subject of his complaint. After all parties have presented evidence, the Board shall meet in executive session to consider the evidence. Notice of Final Determination. A copy of these procedures shall be included in any resale disclosure packet issued after the effective date below. Annual report. The Association shall certify with each annual report filing that the Association complaint procedure has been adopted and is in effect. This policy resolution shall become effective on September 28, 2012. Page 8 The Chantilly Highlander Hello from the Treasurer s Desk By Ken Weinstein The Association s 2011 financial audit was completed on July 17, 2012. As in past years, the general audit results passed, and our annual association taxes were submitted without paying any taxes or fees. Here are the specific notes from the audit: 1.) The Association s account balances totaled $383,453 on December 31, 2011, which was an increase of $24,173 from December 2010; 2.) The two largest Association expenses for 2011, by far, were the pool and land management costs of $95,811 and $58,844 respectively. Pool costs increased over $10,000 in comparison to 2010 due to pool maintenance/repair, but land management costs were reduced by approximately $1000 because of less weather-related issues (i.e., tree removal and snow removal). Capital expenses in 2011 (asphalt repair) were approximately $36,000 less than those spent in 2010 (pool repair). For those non-accountant minded folks out there, if you are confused about the difference between capital expenses and repairs/maintenance, I suggest that you Google it; 3.) It was noted that money should be transferred from the operating fund to the replacement fund something that should occur later this year for both 2011 and 2012 budget allocations. This will be done purely for accounting reasons; 4.) The audit also commented on the independent engineering study performed in 2009 that estimated future replacement/repair costs for the Association. Based on that study, estimated costs over the next approximate 15 years (beginning from Aug 2009) would be $524,058 without accounting for inflation. Out of the 909 homes in our community, the Association has received full 2012 dues payments from all but 22 homes (2.4%). Last year at this time, there were only 12 delinquent payers (1.3%). This is not a good trend. Of the 22 delinquent dues payers, seven were delinquent last year at this time, one was delinquent in past years, and another four paid their 2011 dues in May or June in 2011. In some cases, there may be mailing address issues that will likely require home visits to resolve. If you are one of the folks who hasn t paid (or have no record of CHHA depositing your payment) please contact myself or the CHHA bookkeeper. November 2012 Page 9 CHANTILLY HIGHLANDS HOMES ASSOCIATION POLICY RESOLUTION NO. 12-002 (Procedures Related to the Mowing of Gas Pipelines) WHEREAS, several parcels of property in the Chantilly Highlands development contain gas pipelines on land owned by Chantilly Highlands homeowners association with an easement provided to the pipeline owner; WHEREAS, the pipeline easement on these parcels includes restrictions on the type of activities that can occur on the property and how the land maybe used and the pipeline owner mows the property frequently enough to prevent the growth of trees, approximately twice a year; WHEREAS, the Chantilly Highlands Homeowners Association (CHHA) does not have an obligation to mow this property, nor is it financially feasible for CHHA to maintain all of the pipeline property in the same manner as common ground parcels; and WHEREAS, homeowners with property next to the pipeline may choose to mow that property on a more frequent basis than the pipeline owner does. NOW, THEREFORE, BE IT RESOLVED THAT the Board adopts the following policy: In order to maintain the appearance of the community CHHA will have portions of those parcels subject to the pipeline easement mowed on the same basis as common grounds if: The property is within approximately 50 feet of roads including Kinross Circle, Stoneheather Drive and McLearen Road, The property is visible from those roads, and Homeowners adjacent to those properties elect not to mow the property on a regular basis. This policy resolution shall become effective on October 31, 2012. November 2012 Page 11 Vandalism Disappoints Residents I have been a resident of CH since 1991; a year-and-a-half as a renter and the balance as a home owner. My kids went through Oak Hill ES, Franklin MS, and Chantilly HS, and we have had very good neighbors all this time. However, last summer someone came into our backyard and stole a $70 bug light. I was mad but let it go. I should have reported the crime but due to the dollar amount, it hardly seemed worth it. Two weeks ago, my grandson and I picked up a couple of pumpkins for Halloween and set them on our front porch. That same night they were taken and smashed down the street in someone else's yard. Another $10 lost, and again too minimal to report. This morning that all changed. I am one of the people that like to decorate for Christmas. While not the "Griswold's, my kids and now grandkids like the decorations and many of my neighbors comment positively about our helping make the seasons more fun. Three years ago I started putting up Halloween lights, then some inflatables and other displays. While modest designs, it is again something my grandsons like and is simple to do. This morning one of the inflatable's was taken along with some lights. While the cost is around $100, more importantly is the realization that now within less than three months, someone has come onto our property three times and taken something that wasn't theirs. I am also aware that they hit a house across the street from me, but I will not speak for them. This time I have filed a police report. I cannot recover my money, nor is it likely that the perpetrators will ever be caught, but now the whole neighborhood is suffering. The reported crime goes into our neighborhood statistics. It can impact our home values, our insurance rates and the general perception of where we all live. I am not doing this to harm the neighborhood, but to put all CHHA on alert that we are all accountable for what happens in our neighborhood. There were many nuisance crimes reported early in October on NextDoor, our private social network for our neighborhood, including smashed mailboxes, pumpkins, and toilets. These crimes should be reported so the police can track trends and escalations in activity, and react appropriately. Deer are especially active during the months of October and November so residents can expect to have increased encounters with local deer. As of July 2012, there have been 59 non-reportable deer-related vehicle crashes in Fairfax County. There have also been 31 reportable collisions (damage over $1,500) involving animals, predominately deer, as of mid-september 2012. Police caution motorists to stay alert for deer in the roadways and learn more about deer to decrease their chances of a deer/vehicle crash. Know Deer Behaviors: Deer are especially active pre-dawn to mid-morning and dusk to early evening. Deer breeding season runs October through December. Deer typically travel in herds. Deer can be found throughout Fairfax County. Be Alert when Driving: Always drive the posted speed limit. Always wear your seat belt when in a vehicle. Use high-beams when there is no oncoming traffic to improve your visibility. Be aware of posted Deer Crossing signs. Be aware of Deer Crossing variable sign boards. Be Prepared for Deer Encounters: Watch for eye shine along roadsides. Reduce speed and grasp the steering wheel firmly with both hands. If deer is frozen on the road, reduce speed and flash your headlights. Never rely on hood whistles, car horns, or other devices to scare deer. Studies have shown these do not work. Never swerve to avoid deer on the road. Swerving can cause loss of control of your vehicle and greatly increase chance of more serious damage or injury. Take your foot off the brake at time of impact. This action reduces the likelihood of deer crashing through a windshield or windows upon impact. According to a Washington Post article by Ashley Halsey III, the odds of hitting a deer is one in 102 if you live in Virginia. West Virginia is ranked as the No. 1 state where you re most likely to collide with a deer, when compared with the number of licensed drivers. South Dakota, Iowa, and Michigan come in next. If the animal is injured or killed, report the collision through the FCPD non-emergency line at 703-691-2131.
