In accordance with Section 36 of the Planning Act, a Public Meeting is not required to facilitate the lifting of the Holding (H) provision; however the notice of Council's intention to pass a zoning by-law to remove a holding symbol was advertised in the Brampton Guardian. The requirements for the lifting of the Holding symbol have been satisfied and therefore the holding symbol can be lifted. RECOMMENDATION: 1. I&-V1 BACKGROUND: The subject lands comprise a 3.85 hectare (9.5 acre) parcel of land located on the north-west corner of the intersection of Goreway Drive and Intermodal Drive. The property will have access to Intermodal Drive by way of an internal private drivewayconnection on other lands owned by the applicant. The subject lands are designated "Industrial" in both the Official Plan and the Goreway Drive Corridor Secondary Plan and are zoned Industrial Four (Holding) 1641 in Comprehensive Zoning By-law270-2004, as amended. Canadian Tire has been parking their truck trailers on these lands since 1998 without the appropriate approvals in place. The applicant is proposing to formalize the parking of the truck trailers on these lands through the lifting of the holding (H) symbol. No new buildingsare being contemplated at this time. The attached zoning by-law will allow the same industrial zoning requirements on the subject lands, as is permitted on the adjacent lands to the west. In accordance with Section 36 of the Planning Act, a public meeting is not required to facilitate the lifting of the holding (H) symbol. CURRENT SITUATION / ANALYSIS: The applicant has made appropriate arrangements to meet the requirements to lift the Holding symbol, by submitting a functional servicing report and concept drawings that demonstrates how the adjacent two residential properties can be comprehensively developed in conjunction with the balance of the applicant's industrial lands. The applicant's concept site plan illustrates the proposed trailer parking configuration and site servicing details which will allow the subject lands to be developed in conjunction with the balance of their lands to the north and west. An existing 30 metre wide landscaped berm separates the subject lands from Goreway Drive and Intermodal Drive. Site Access will continue to be obtained across the lands to the west, also owned by the applicant, to Intermodal Drive. The applicant has confirmed that the two adjacent owners of the residential properties were contacted and given notice of their intent to file a zoning by-law application to lift the holding symbol in order to allow for the subject lands to be paved and used for truck trailer parking. A copy of this correspondence is attached to this report. Any technical requirements for the expansion of the truck parking can be addressed through the site plan approval process. As such, a Rezoning Agreement is not required to facilitate this application. As part of the approvals process, we are also applying to amend current zoning on a portion of our property that has a 'Holding' provision. This is part of our overall plan to pave our trailer parking area. A 'Holding' provision is sometimes applied to a property to allow for orderly staging of a particular development and provide the City with adequate time to carefully evaluate the proposed development; in this case the paving of the existing gravel parking area to improve the existing condition. It is our understanding that once the City is satisfied, a Notice of Intention will be circulated notifying you of the amendment to the existing zoning removing the 'Holding' provision to permit the paving to proceed.
