REPORT #PD-2017-32 COMMITTEE OF THE WHOLE MEETING JULY 24, 2017 REMOVAL OF HOLDING SYMBOL (H16) TREETOPS/BELTERRA ESTATES SUBDIVISION - PHASE 3 (51M-1111) TOWN OF NEW TECUMSETH FILE NO. D09-DEV-368 RECOMMENDATION That Report #PD-2017-32 be received; And further that a Zoning By-law amendment, substantially in the form included as Attachment No.2 to Report #PD-2017-32 be enacted, to effect the removal of a Holding Symbol (H16), pursuant to Zoning By-law No. 2014-126. OBJECTIVE The purpose of this report is to provide Council with sufficient information to consider an application for the removal of a Holding Symbol (H16) on lands within a Phase 3 of the Belterra Estates/Treetops Subdivision. BACKGROUND Location The subject land is legally described as Lots 185 to 192, Plan 51M-1111. The total area of land is approximately 3395 square metres (0.84 acres) in size, located on the north side of Peacock Trail. A location map of the subject land is provided as Attachment No. 1. The subject lands are located within Phase 3 of the Belterra Estates/Treetops Subdivision. Adjacent land uses include planned residential uses to the south, east and west, and a storm water management pond to the north. History On December 18, 2010, a draft plan of subdivision was approved on the subject land to permit a 1875 unit residential plan of subdivision. In 2011, a red line revision to the draft plan reduced the number of units to 1868. A second red line revision was approved in 2014 which further reduced the plan to 1857 units. A third red line revision in 2016 made additional minor changes to the plan, but did not result in any changes to the overall number of units. A copy of this, which is the most current draft plan, is included as Attachment No. 3 to this report.

Report #PD-2017-32, July 24, 2017 In 2017, a three year extension to draft approval was granted until July 11, 2020. Phases 1, 2 and 3 of the plan of subdivision have been registered to date, totally 969 dwelling units, many of which are under construction or completed. As part of the 2016 red line revisions, the size of the storm water management block within Phase 3 lands (Block 1485 on the Draft Plan of Subdivision in Attachment No. 3) was reduced, which allowed for the creation of the subject lots to the south of it, along the north side of Peacock Trail. As final approval of the storm water management pond design had not yet been obtained at that time, staff placed the Holding Symbol (H16) on said lots to prevent them from being built on until it could be determined that they would not be required for storm water management purposes. Proposal On June 19, 2017 the Town received a request for the removal of the H16 symbol on the subject lands, being Lots 185 to 192 on Plan 51M-1111, within Phase 3 of the Belterra Estates/Treetops Subdivision. COMMENTS AND CONSIDERATIONS The Town of New Tecumseth Zoning By-law stipulates that a Holding Symbol (H16) which shall be considered for removal by Council once the final design of the storm water management pond has been completed to the satisfaction of the Town Council. In support of the request, the applicant provided a letter from the developer's engineer at Gerrits Engineering Ltd. confirming that the design and completion of the subject storm water management pond has received all applicable approvals from both the Nottawasaga Valley Conservation Authority and the Ministry of Environment and Climate Change (MOECC). Copies of the permits attained from these reviewing authorities were also included, and it was noted in the letter that the storm water management facility was designed to treat the anticipated drainage area to the Enhanced Protection Level as stipulated by the MOECC and that Quantity Control is being provided within the footprint allocated to the storm water management facility. Planning Staff have circulated the request to the Town s Engineering Department, and they have confirmed that they are satisfied that the design and size of the storm water management facility are sufficient to provide the necessary quality and quantity treatment and address the Town's design requirements. As such, they have no concerns with the removal of the Holding Symbol (H16) to allow for development of the subject lots. Given the above, Planning Department staff are satisfied that the conditions for the removal of the Holding Symbol (H16) from Lots 185 to 192 on Plan 51M-1111 have been met. XX TO RESTRICTED AREA BY-LAW 2014-126 A By-law to amend By-law No. 2014-126 of the Town of New Tecumseth, to remove a Holding Symbol (H16) on lands legally described as Lots 185 to 192, Plan 51M-1111, Community of Alliston WHEREAS By-law No. 2014-126 is the Zoning By-law of the Corporation of the Town of New Tecumseth; AND WHEREAS Lots 185 to 192, Plan 51M-1111 are zoned Urban Residential Exception UR1-40(H16) by By-law 2014-126; AND WHEREAS the Town is satisfied that the preconditions for the removal of the Holding Symbol (H16) as prescribed by Section 3.5.1.14 of the Zoning By-law have been satisfied; AND WHEREAS Section 36(4) of the Planning Act, R.S.O. 1990, provides the required authorization to remove the Holding Symbol (H16); NOW THEREFORE the Council of the Corporation of the Town of New Tecumseth hereby enacts as follows: 1. That Zoning By-law No. 2014-126 be amended by removing the Holding Symbol (H16) on lands zoned Urban Residential Exception UR1-40(H16) on Schedule 1 attached hereto and forming part of this By-law. 2. That this by-law shall be cited as Amendment No. XX to Restricted Area By-law No. 2014-126. 3. That this By-law shall come into force and effect pursuant to the provisions of and Regulations made under the Planning Act.
