(2011). The Wetland Protection regulations allow a residential lot of record to reduce the wetland buffer, consistent with the lot size and in conformance with other applicable zoning regulations. This waiver request is for the construction of a swimming pool and deck. Documentation is required to demonstrate the eligibility for this waiver and additional construction requirements are necessary for lots that qualify for reduced wetland buffer areas. Aerial and ground level photographs documenting the native vegetation in the wetland buffer. An aerial photo demonstrating this reduction is consistent with the neighborhood pattern of development. A survey showing existing setbacks and structural constraints due to the lot dimensions and building lay out. A site plan for a proposed pool and deck showing the wetland buffer, the limits of existing wetland vegetation, a proposed storm water detention swale constructed throughout the wetland buffer and a setback line related to the wetland vegetation line. This results in a request to reduce the wetland buffer to 27 feet with a 5 foot construction setback to the proposed pool deck. Section 4.3 Land Development Regulations, Martin County, Fla. (2011) allows the Growth Management Director to reduce the wetland buffer upon a determination that special and unique circumstances exist, which may have created a hardship for the property owner. However, all wetland buffer standards remain applicable and a berm or swale described in section 4.3.A.5. shall be required. gmd2016l612.docx 1 of 5

(2011). This letter constitutes the waiver for your lot. This environmental waiver/exception verification is based on the information you provided the County and the rules in effect as of the date of this letter. Please retain a copy of this waiver and the approved site plan attached to it for your records. A copy of this letter should be submitted to the Building Department with your application for the pool and deck. Please be advised that if no construction occurs in accordance with this waiver, this waiver shall expire one year after the issuance of this letter. This verification will expire after one year, and may not be valid at any other time if site conditions materially change, the project design is modified, or the regulations governing the waiver or exception are amended. In the event you need to re-verify the waiver status for the activity after the one year expiration of this verification, a new application and verification fee will be required.
